If a relative was divorced, then died and no financial order was in place (for argument's sake), does the ex-partner have a claim on their estate? What happens if they died intestate? What is the position of wills?

if i issue court application, is it still possible not to go through the long court process and settle through arbitration?

You can settle matters at any stage. The courts would prefer parties to reach an agreement between themselves, if possible! - LQ
