Craziest thing I ever saw in my 20 years of real estate. During the 08 crash I was working in San Diego California. There was a high rise build, maybe 90 units if I remember right. At the time the units were going for $650k base with a $375 HOA. Prices started dropping fast. They fell all the way to low $300s. The HOA went all the way up to $1500 a month. What was happening was the HOA wanted to keep what they saw as "lower class" people from buying the units. Eventually the city DA got involved and it was found to be a discriminatory practice. During discovery it was found the HOA has 15 years of reserves due to the over charging.
I live in a gated townhouse community and there is good and bad with the HOA.. They take great cares of the grounds but I draw the line at being told what to have on my deck or front door.
The hoas in Florida screen the person buying a home. The buyer has to pay to apply and have to be approved by the hoa first. (This also happens for each tenant of a property. Each tenant has to be approved by the hoa first)They do a background check, credit check ect. They want a picture of your dog/ pets, they ask for your marriage license, and list of the cars. It’s probably the most intrusive application I’ve ever seen.
HOA’s. Are responsible IF. It is noted in Bylaws & CC&R. Which GOVERNS it self. The problem is when you have a board that self elects itself . They are investors and a little bit Little it’s 80% investor own 20% owner own here in California. A court has ruled in our favor for owner own and occupied. Only owner own and occupied can vote investors cannot because they don’t live here. Our homes were built in the 70s. A little by little children who didn’t want to keep the property sold it, and unfortunately fell into the wrong hands. Not to speak ill of realtors, but it’s also their responsibility along with the mortgage company. To work together with the HOA and the covenants that rule them.

The theory of an HOA is great, the practical application of it is nothing more than micro-government with wasteful spending, over-regulation, and a drain on people’s money and patience.
In most states you need to be 90 days delinquent before you can even file for eviction. Then you have to spend months in the costly foreclosure process. Plenty of time for owners to contest in court, especually if reason for foreclosure was unsupported.
An HOA is a great way for a first tine hone buyer to question why they bought, HOA is worse than having a landlord. At least landlords have some responsibility
I’m in a single family home. Hoa pays for lawn and insurance and some other common sewer stuff. The fee went from $330 in 2022 to $525 in 2023/2024, and $845 for 2025. they ruined the community
Same thing happened to us. The HOA was to high already at $1162/month including utilities in New York. But then with only a two month notice, it went to $1700.00 for only a 1-bdrm, 1 ba appt. They are claiming to be in arrears. If anyone has any information, please share.
The problem with HOAs are many boards members have no real estate or financial experience and make poor decisions. The owners in most states have to have at least a majority to change HOA by-laws. IL requires 2/3 votes in favor, and if an HOA evicts, they have to buy out your property
No one is talking about condo HOAs not having sufficient insurance. Lenders are denying financing, will not allow basic insurance only , want broad & special insurance.
We live in a 55 plus development, we absolutely love all the activities and how beautiful the grounds are, so we put up with our 235.00 HOA but I don't recommend it for younger people with families. We keep voting for the HOA to be run buy the builder, because they are doing a great job. We have the choice. Ours only allows rentals for 6 months or longer. My previous house had no HOA and we had the next door neighbor from hell. We had to sell in the dead of winter because we didn't want the buyers to see that the neighbors never mowed the grass. They do allow 20% under 55. And adult children can live with their parents, and unfortunately there is a lot of that, 100% of them male. The HOA does drive around fining people for mostly excessive lawn ornaments. We have 15 pools and zero lifeguards.
There’s a couple that are renting in this one undisclosed spot and the management keeps getting fined for random things like not having a decorative crossbeam on the front of the fence on the lower third third of the fence.
I have a story that will amuse nd scock many. Like " remove your potted plants from upper deck immed. They are too heavy. Um...well they weigh about 270 lbs combined and deck is 10 ft with 5 2 by 6 joists in great shape. That holds about 3,000 lbs. This hoa is gonna get 224 owners in dire straights soon. Got us BLACKLISTED from all fed ins loans due to negligence and breach of fiduciry duty . total value drop to all units combined is approx 9.6 .million.

Prices didn't drop much in Louisiana and other states like Texas because they hadn't been inflated yet. The prices were normal but now that Texas has had its boom that will change.
Stop buying from builders who put in a HOAs. We need to start new alternative companies. An alternative to HOA's are more compact city governments who offer tax rebates for taking care of their properties.
These developments are occurring because the largest purchase, specifically mortgage rates, is being impacted. Your home represents the largest purchase, with all other expenditures following suit.
We have an HOA which is actually our CC&R's (but called HOA). A group of people (About 50 our of 300 owners) want to take on a million dollar road that leads into our community (But is not our responsibility). I know this is totally illegal and have stood up to this group. Our CC&R's say we are only responsible for three roads in our community. The road they want to take over will cost $1,000,000. Do you have any recommendations (besides getting a lawyer) on handling this? I feel it is totally corruption (and the past president was actually taking our money).
Tod, so you actually mentioned something similar that you went through. But the million dollar road IS NOT in our HOA. They will actually hurt all the fixed income people into a foreclosure.
I 100% side with her. An HOA preventing people from renting is good!! It's one of the only ways to fight against company's buying up houses. He is 100% wrong here. If you don't like it don't live in an HOA.
What about the everyday hardworking common folk who buy their 1st house, live in it for 3-5 years, they work hard and save up for another down payment to then keep their first house in order to rent it out and move into their 2nd home? Should they be penalized by these rental eliminations or limits too?
Todd, you need to read the by-laws before buying, and realtors are the worst at not properly informing buyer to have an attorney review the terms. We have a rental freeze, unless you were grandfathered in. The owners voted for it to protect their assn from becoming a rental neighborhood. It made it possible for federal loans for new buyers and protected our values during GFC.

Maybe those comps were sold to buyers who were willing to pay over asking. If that’s true then I’d rather for Zillow to continue to be honest about the true market value rather than the over asking value that some of the greedy sellers would rather sell the house for. In the end, the usually inexperienced buyer is left holding the bag. On the false listing prices, the taxes and insurance are able to illegally increase. We’re talking about old houses/shacks that need exponential amounts of work. Some of the houses are just money pits that need total rehabilitation.
If your buying into a HOA Give them your contract. Let then abide by your rules. A contract will hold these bylaws and board members accountable because it will be binding.
I live in an HOA and I don't really like it very much. They're behind on maintenance but I'm paying my dues each month. I have not been popular because I pointed this out so they made sure to have the annual meeting when I can't be there. Dealing with our president is like being bit by a snake. I don't recommend buying in an HOA after this experience. I'm going to rent out my condo and move away. We don't even have a board which is against our bylaws.
@@yorsan2240FL condo laws should have been in place years ago, as the HOAs have been under allocating for maintrnance. Now current owners have to pay for those years of unfunded repairs. Never buy unless there are sufficient reserves for future repairs
By the podcast giving consumers the numbers of the ideal checklist when looking for a helpful realtor. The problem as I see it is that the buyer or seller doesn't have the same financial interest and and that sets up a tension in the entire process.
Never again. Our HOA hired a property management company who wrote up infractions and then fined homeowners AND kept the fines. This is not unique. Also, the property company applied homeowner payments to fines first, then dues. Big problem, because you could lose your house for non payment of dues. I believe a law was enacted to correct this priority of payments issue. Also, you cannot force HOAs to abide by their own rules or bylaws. You can get a lawyer (good luck with that), but then the HOA will also get a lawyer. Know where the HOA gets that money? From the homeowners. I actually sat on the Board for my HOA (other fed up neighbors talked me into it and voted me in). I have never seen such awful humans. I couldn't get outta there fast enough. Finally, our HOA had limits on dues increases and did not have enough money to maintain the pools and public spaces. Never, ever again.
58:34 - in this instance where you are talking about a HOA dictating who you can and can’t sell your house to, Krista is using coops in NYC as an example of HOAs telling you who you can sell to. You can’t compare coops to regular real estate. There are big legal differences, With a coop, you are buying “stock shares” in a building which is a totally different transaction than regular real estate. With a coop you get a stock certificate and not a deed. Coops are also not eligible for FHA financing just because the coop boards can decided who buys into the building. Believe it or not, there are pluses to coop boards but there are a lot of negatives
I disagree with Kristina. We do need condo rules/HOAs in apartment condos. BUT we don’t need HOAs in detached single family homes. Depending on the layout of a townhouse development, you don’t need them there as well. I know. I lived in a 1930s row house in DC with no HOA and it was a beautiful community.
HOA is the perfect vehicle for grumpy old Karen's to weild power. HOAs power should be curtailed to controlling common areas and general cosmetics in a broad term, not at micro level.
HOAs simple democracy. They represent the will of the majority of the owners. They are neither good nor bad. The problem is no one reads the documents of the HOA to see what the rules are before buying. No one looks at the financials to see if it's solvent. The problem with the HOA is the ignorant buyer that never does the research.
That is not true. It’s not a democracy. It’s your obligation when you buy an HOA just like I have before and currently live in to Red when that mortgage company has you the CC &R and bylaws. THAT IS YOUR RESPONSIBILITY AS AN OWNER IN OUR CASE WE HAVE 80% INVESTORS WHICH THE JUDGE RULED IN OUR FAVOR. AND IT MUST GO DOWN TO 20% INVESTORS. THIS WILL PROTECT OUR SENIOR COMMUNITY And under age. Living was not part of our original CC and R. Or bylaws.
HOAs are not a democracy. You either abide and agree to their rules or you don’t. The majority of the homeowners in the HOA didn’t just sit around and make rules as to what color you can paint your front door or what shrubs you can plant or how high your fence can be or if you can build a pool in your yard.
HOAs are here because local municipalities love having the huge tax revenue coming in from these massive, city size HOA developments without having to pay for sidewalks and roads within the development. The problem is the HOAs not only bring in tons more people without the HOA paying to expand the main road arteries, bike paths, sidewalks, schools, etc but they dictate what you can or can’t do to the property you own. The local municipality gets all this wonderful “free” revenue but after a couple of years the government pays out the nose to add schools, deal with extreme traffic, police, fire, etc. HOAs are a lose-lose for everyone
HOAs would work well if they stuck to the basics such as garbage collection, snow removal, maintaining common areas, roads and sidewalks in the HOA. The problem comes in when they dictate what you can and can’t do with your own land and outside of your home. The other problem is that HOAs all have some idiot that drives around with the HOA “rule book” in hand looking for violators. Every single condo and HOA development have these “rule book” people. HOAs also impact housing values…the higher the fees, the lower the property values.
Nobody would rent if they have responsibilities with maintenance and repair. For many, that is the only reason they rent. If the landlord can't afford to own the home without a tenant in the home, the landlord is in over their head. In other words, that is a slumlord. Nobody wants an irresponsible landlord

@cfoster6804 I spent 20 years in metro Detroit. I was raised there. I had to leave metro Detroit for a better life in silicon valley. I would have rather stayed in Detroit, but it's dead. It's been a dead city since 1967 when the blacks rioted & destroyed the city. That is the cold hard facts. Since I was a child, everyone has been saying Detroit is coming back. A simple check on Google maps will show mile after mile of destroyed homes and empty lots. You do such a disservice by deceiving people into thinking Detroit is gentrifying. I wish it was true. But that is a bald face lie , and it will get decent people hurt who decided to visit detroit.

In Most cases the builders can't get the neighborhood approved by the city/county unless they establish an HOA, they really don't have a choice.

Retaliation is a common problem in HOAs.
I have 1 townhome only 800 sqft in Houston, have to pay for them 330 $/ month for HOA ,l ask them why too much ,they said too much for them repair

You can’t compare coops to regular real estate. There are big legal differences, With a coop, you are buying “stock shares” in a building which is a totally different transaction than regular real estate. With a coop you get a stock certificate and not a deed. Coops are also not eligible for FHA financing just because the coop boards can decided who buys into the building. Believe it or not, there are pluses to coop boards but there are a lot of negatives

I disagree with Kristina. We do need condo rules/HOAs in apartment condos. BUT we don’t need HOAs in detached single family homes. Depending on the layout of a townhouse development, you don’t need them there as well. I know. I lived in a 1930s row house in DC with no HOA and it was a beautiful community.

HOAs power should be curtailed to controlling common areas and general cosmetics in a broad term, not at micro level.

HOAs simple democracy. They represent the will of the majority of the owners. They are neither good nor bad. The problem is no one reads the documents of the HOA to see what the rules are before buying. No one looks at the financials to see if it's solvent. The problem with the HOA is the ignorant buyer that never does the research.
That is not true. It’s not a democracy. It’s your obligation when you buy an HOA just like I have before and currently live in to Red when that mortgage company has you the CC &R and bylaws. THAT IS YOUR RESPONSIBILITY AS AN OWNER IN OUR CASE WE HAVE 80% INVESTORS WHICH THE JUDGE RULED IN OUR FAVOR. AND IT MUST GO DOWN TO 20% INVESTORS.

HOAs are not a democracy. You either abide and agree to their rules or you don’t. The majority of the homeowners in the HOA didn’t just sit around and make rules as to what color you can paint your front door or what shrubs you can plant or how high your fence can be or if you can build a pool in your yard.

HOAs are here because local municipalities love having the huge tax revenue coming in from these massive, city size HOA developments without having to pay for sidewalks and roads within the development. The problem is the HOAs not only bring in tons more people without the HOA paying to expand the main road arteries, bike paths, sidewalks, schools, etc but they dictate what you can or can’t do to the property you own. The local municipality gets all this wonderful “free” revenue but after a couple of years the government pays out the nose to add schools, deal with extreme traffic, police, fire, etc. HOAs are a lose-lose for everyone

HOAs would work well if they stuck to the basics such as garbage collection, snow removal, maintaining common areas, roads and sidewalks in the HOA. The problem comes in when they dictate what you can and can’t do with your own land and outside of your home. The other problem is that HOAs all have some idiot that drives around with the HOA “rule book” in hand looking for violators. Every single condo and HOA development have these “rule book” people. HOAs also impact housing values…the higher the fees, the lower the property values.

What about vicarious responsibility by the homeowner to the renter.
Nobody would rent if they have responsibilities with maintenance and repair. For many, that is the only reason they rent. If the landlord can't afford to own the home without a tenant in the home, the landlord is in over their head. In other words, that is a slumlord. Nobody wants an irresponsible landlord

I would have rather stayed in Detroit, but it's dead. It's been a dead city since 1967 when the blacks rioted & destroyed the city.
That is the cold hard facts. Since I was a child, everyone has been saying Detroit is coming back. A simple check on Google maps will show mile after mile of destroyed homes and empty lots. You do such a disservice by deceiving people into thinking Detroit is gentrifying. I wish it was true. But that is a bald face lie , and it will get decent people hurt who decided to visit detroit.
