Sponsored Video Gone Wrong: Why L’Occitane Made Me Take Down My Video

  • Back in March, was set to produce 2 sponsored videos for L'Occitane En Provence. After one video, they not only asked me to remove the honest information, but refused to pay me for my work. I'll show you screenshots of my contract and emails between myself and the PR company representing L'Occitane so you can decide for yourself if you feel L'Occitane was in the right or not.
    For those saying I'm pronouncing the brand incorrectly, please watch the official video from the brand on pronunciation. I'm saying it the way I was instructed BY the brand. Skip to the end of the video to hear the owner of L'Occitane pronounce the brand name. They spell it out lox-ee-tan - • Video

      Well technically they’re only cruelty free because China requires foreign products to be animal tested not because the company is animal testing

    • @ItsMOMOBitches
      @ItsMOMOBitches 6 лет назад +109

      They are cruelty free in every single country EXCEPT China. And only because they can't work around their laws, so I understand that point of view, but then they could... Idk... NOT SELL IT IN CHINA. 🤷🏽‍♀️

    • @beautytryouts
      @beautytryouts 6 лет назад +43

      @@naomicarndid1631 They aren't TRULY cruelty-free if they KNOWINGLY Provide their products to a country ~FULLY AWARE that that particular country tests their "cruelty-free" beauty line not only CRUELLY, but also with ZERO regard for the welfare of the animals that are being tested on. Those animals are not only being cruelly held against their will in a cold & sterile environment(which is FURTHEST from their natural habitat that they would typically live & thrive in)inside cold metal/or glass enclosures with literally No room to barely even stretch out their limbs fully...let alone have Any room to pace back and forth~ALL DAY LONG...DAY IN & DAY OUT, and they are constantly being ripped away from their mothers and family groups, and then they are continuously subjected to the abusive forms of "testing" where they're very Cruelly poked and prodded OBVIOUSLY without their consent, & they are forced to endure painful injections with potentially lethal ingredients/& or they can receive topical treatments, where these un-tested ingredients within the product is applied on the top layer of their skin, & they are also forced to injest whatever the particular product that is being tested...which can typically result in death...however ultimately, with the suffering that these poor/innocent/defenseless creatures are forced to endure... I'm sure that they would GLADLY welcome death, knowing that the pain and suffering that they've been dealing with, will FINALLY come to an end! And who wouldn't want to be peacefully put to rest...knowing that all of the pain and suffering & the Agonizing pain that their skin is going through...from head to toe...which is a constant feeling of a nonstop burning sensation, & many develope a painful rash where it also feels like constant burning without relief/or the itchiness is so bad that when lab workers return the next morning, the animal had quite literally scratched & chewed through their own epidermis layer of skin literally down to the bone. And let's not forget the typical symptoms of nausea/vomiting/diarrhea/bloody stools/ insomnia/chills/shaking/fever/the list goes on & on...
      -But the point is that when their cruelty free status becomes compromised because they want to maximize on sales via China, where it is well known that countries in Asia have an enormous market for any and all beauty products ~due to the obsession of trying to obtain the "perfect skin"(which is obviously the case for ANY country...however that dollar amount is doubled/tripled...many times over in comparison to most everywhere else.)Although in Asian countries...especially Japan/China/& Korea, their focus is more on obtaining the most "perfect" flawless skin...as I mentioned. Therefore as far as the beauty industry goes...their money market is focused on skincare products. Whereas in the western world(for example in the U.S, the $$$ market is more geared towards the cosmetics industry...and makeup is king!) Either way... it's extremely sad and BEYOND disappointing, that a massively well known company such as L'occitane would actually sacrifice their standards/ethics/& morals SOLEY for the $$$ ...that is SO SHAMEFUL ❗The fact they're actually willing to let their standards & belief system all go out the door just for the money is so irresponsible...smh. That fact alone dictates that they no longer have the right to call themselves cruelty-free! They have No right to stand next to the other companies...ESPECIALLY the smaller brands who've worked TIRELESSLY & have put their blood, sweat, & tears into their baby(their company) to make sure that things are done correctly(to make sure that the correct ingredients are used to protect their consumers; they're healthy/organic/sourced locally to support local business regardless if it isn't as cost-effective/& to not do the easy thing and get the cheapest product from Taiwan/etc...regardless if there's lead/etc...They've made sure that they're sustainable goods, and that they're ethically made and purchased, they've mase sure that their product and it's ingredients are 100% CRUELTY-FREE...So that they can lay their heads down at night free from guilt & have pride in their product! L'occitane is a huge Mass-produced company...they have EVERY RIGHT to refuse to sell their product to a certain country that refuses to uphold their standards and practice! That truly wouldn't have even made barely a dent in their revenue...but CLEARLY they don't care about their standards and ethics...because they're a bunch of sellouts❗And It's quite sickening...smdh.

    It was cheaper for the PR company to pay you, keep your attorney out of it, and keep L'Occitane as their client. That is why they did it this way.

    • @melissalask5253
      @melissalask5253 5 лет назад +46

      C Folse right. Bottom line, the contract was with the PR company. She was responsible for her contractual obligations to THEM, and would be getting paid via them. The PR company then has a separate contract with L’Occitane as to how they recruit and direct influencers to review/support the product in question, and how L’Occitane will source the compensation for potential contracts with influencers.
      Jen was in complete compliance with her contract with the PR company. They legally had to pay her for the completed work, regardless if L’Occitane was going to pay THEM. She had no legal obligations to or agreements with L’Occitane directly.
      It should never have come to all of this, and the fault of the PR company is in how they handled it as the intermediary firm. They should’ve told her to take down the video that Friday, saying “ we will discuss this on Monday.” That Monday, the conversation should’ve been “you fulfilled your contact with us. You will be getting paid for work done per the contract we have with you, although there will not be any further work for you per our client (L’Occitane).” And done.
      They knew they had a legal obligation to pay her regardless of whether their client was going to source that money.
      Jen, if you’re reading this, well done. I found you by a fluke, and am already subscribed for more of your reviews - my support for you is entirely based in the integrity you feel is *inherently necessary* to what you do, *not optional*. Thank you for sharing this and sticking to what you know is both legal AND ethical. 🏆♥️

      I've got a sample L'Occitaine's Vetiver , because of what a well trusted reviewer had to say about it,
      and I am very happy I did. For the price it sold for, a whole bottle, I would recommend it;
      even if the price was higher. Because of that, I sampled a few other , and they were decent .
      I liked the Vetiver the best . Sadly though, it has been discounted .
      I consider myself to have a good nose.
      All that said, sorry for your experience with the company.
      Also, I wouldn't spend what lots of people spend for skin cream.

    As a scientist, I appreciate the thought and research you put into your reviews, Jen! I had the chance of watching your L'occitane review and it was a fair assessment of their skincare. Its their problem if they were not happy with your video and it shows me me what kind of company they are. I am sick of luxury skincare brands pushing ingredients without evidence of their benefits.

      I wholeheartedly agree. We get airbrushed advertisements and pie in the sky promises to buy products and it is refreshing to have someone give just the facts and not waste our time, money, or emotions (because skincare can be deeply emotional for people). The fact that theyre annoyed with the facts means, to me, that it is on them to change those facts. Become a truly cruelty free brand, prove that the ingredients are what they say they are and in a verifiable way.
      In the end, they did more harm than good on this one - in my eyes. It showed their true colors and that is something viewers won't quickly forget.

      I am so angry for Jen. She’s not a scientist and yet she puts in so much scientific work for her videos that she DOES NOT have to do. L’Occitane (or their PR team) should have done their own research about the person they hired. High-end skincare brands often contain ingredients that are 1) not proven helpful or 2) proven harmful. We go to Jen for the truth. If they want 100% positivity they should go seek out someone like Nicol Concillio who never has a bad thing to say about a product. I’m honored to be subscribed to someone who is so principled.

      She just explained at the end of video why that would be unfair. L'Occitane never asked for a glowing/positive review in the contract, and they green-lighted creative control to the creator, so the honesty of other reviewers was not necessarily compromised. Other reviewers probably didn't mention the ingredient list or their cruelty free status therefore their honest opinions weren't problematic for the company. It's not the fault of other reviewers at all when they were offered good contracts to begin with.

I'm not a doctor or a scientist or anything but I aspire to be an aware consumer, and your channel is such a great place to learn about makeup. If L'Occitane is ashamed of their ingredients they should change them, and if they don't want people to be angry about their cruelty free status they should stop selling in China... I expected better from a brand like them and I don't feel like buying any of their products.

    I never ever comment on youtube, but I really felt the need to speak on this. I worked for L'occitane for almost a year some years ago and eventually bailed out because of the way the company treats their employees and customers. They actively bully and shame their employees to sell the immortelle line (specifically their most expensive product the Divine Creme which comes in at like 90 bucks a jar, and each of us had to sell at least 3 a day minimum or we got lectured from management and potentially had our hours cut. I personally had this one happen to me) to every customer, even though the product only benefits a very small amount of skin types. If your store did not sell enough of the divine cremes in the day, you were blasted the next day on the internal email to your region. I even heard rumours in our region about staff being fired for not selling enough. I finally had enough when I was bullied by my manager into selling an immortelle divine cream to a woman who barely spoke English and couldn't have been older than mid 30's with perfect skin, and who I'm pretty sure didn't really even understand what i was talking about. I felt so guilty as I rang up her purchase. The number of stories I heard from customers while i worked there about how they had been coerced by staff at other stores into buying the immortelle line (which means it wasnt a store specific issue), only for it to make their skin worse, with a lot of people saying it made them particularly oily, and so they had come back in hopes something else would work. No employee should have to feel like they have to lie and coerce people into buying something that isnt right for them. I don't have an issue with sales targets, they are useful for companies and can even help motivate staff, but to have such a strict target for a very specific product that will only work for a small number of your customers and can be afforded only by a very very tiny fraction of your overall client base is just stupid. My store was set in a mall, so a lot of days we had little to no activity in the store, so how is it fair to the customer and the employee to be forced into hard selling such a specific and very expensive product to absolutely everyone who walks through the door, whether they need it or not? It's not and it PROVES that L'Occitane care about nothing but their bottom line, not their staff and certainly not their customers. How they have you treated you Jen just confirms for me that nothing about their business model has changed after almost 5/6 years since I left them. Just sad and i really hope one day they either change how they run things, or just drop off the face of the planet. It's quite sad because what L'Occitane was built off of is so different to what it has become.

      She just mentioned their cruelty free status and some information about the ingredients because reviews should be honest.. that doesn't mean it's negative or that she didn't like the product. She was not told it has to be completely positive, they can't deny her money for doing what was within the contract. Mentioning some pros and cons is not going to turn people off from a product, on the other hand if every product review is 100% glowing it's obvious they aren't being honest. Having products featured on a popular channel gets the brand name out anyway. They would have been better off not denying her money and avoiding losing a lot of people's respect. Her review was in no way negative.

      Rhiannon Ruth What was so negative about mentioning ingredients and cruelty free status?!?! That's not negative! They don't want her mentioning that stuff because they don't want people knowing it. They want people to blindly purchase their products! They came to her knowing how she does her reviews, and asked her to do the video! She even let them know what she'd talk about before hand and they accepted and went forward with signing the contract! She fulfilled her obligations. They did not! It is not "taking" money from them either. Do you have any idea how much time and work these influencers put into making content? She earned that money. Just as Stephanie Marie earned hers! Being honest is not the same as being negative. She never said she hated the product or that it was bad or anything! She gave ingredients information and cruelty free status. If you think that's negative then idk what else to say to you because that's ridiculous!

    I had L'Occitane do something similar a few years ago where they wanted to send me some products. I did some research on them and found out about they sold in China. When I got back to them and said that I wasn't interested in trying or reviewing their products because of their non-cruelty free status I was rudely informed that I was wrong, and they tried to convince me that selling in China didn't change their cruelty-free status.
    I'm not shocked L'Occitane behaved this way at all. They seem to have no understanding of how the YT/Blogging community works. If they want to behave this way then they should just pay for a famous actor/model to endorse them.

      Actually, they probably wheren't lying. A lot of brands claim to be cruelty free, but to sell in China, have another company test the products with the Asian ( often the formula changes depending on where it is sold for not just skincare and cosmetics but food and drinks ) formula to be sold in China on animals to get around the claim. It is really deceiving and it sucks but technically not lying I guess? I still feel pretty bad about the poor animals though, and I think that these brands should be more transparent about these things.

    I had a very weird experience with that brand too
    I work in radio broadcasting and they wanted “very simple commercial- read few sentences about one product, price and store address with soft Mediterranean music”. This is also the cheapest kind of commercial. So my colleague and i put this together and it sounded really great. They send it back and told us the music wasn’t soft enough. We changed the music and they send it back again cause my voice wasn’t gentle enough. I said ok I’ll read it once again, slower and softer. We send them that newest version ( yes, they keep sending it back with complaints whole day) and they were still unhappy with final production.They said my voice is too rough and asked if we can provide some other female voice sounding more light and clean. We tried that with our colleague. That didn’t fly for them either. They said we should change the music again and that woman should speak more slowly. We said well maybe this commercial should do some other radio station, thank you, bye.
    They were offended and never contacted us again. And yes, we are really grateful for that.

      nina d maybe you should start taking deposits just in case something like this happens again, and then when they finally get the commercial they are happy with, they'll just pay the rest of the fee. And maybe also sending an email with different music samples and a few different sample voice clips all saying the same sentence such as "this is an audio sample" and they just pick from there basically building their own commercial, then you just put it together. If they don't like it maybe give them a set number of remakes till you start charging a little bit more for all the extra work you're doing. It sucks that you had to deal with such a sucky company and that they didn't even end up paying you! I don't think they're ashamed of their cruelty free status. Cruelty Free labels sell really well, often costumers are willing to pay extra for cruelty free products. It's all about the money, it has nothing to do with caring for animals.
      Also, if their product would be made in China, they could still be 100% cruelty free. The law for testing on animals is only for imported products. If they would actually care about animals, they would build a small factory in China or hire a third party to produce the product for them. Many other big brands do this, why not them? Because testing on animals is quite cheap, that's why.

    Anyone can create a version of the Immortelle line. Buy organic cold pressed. rosehip seed and jojoba oil. Add half of each to a glass bottle. Add 1% helichrysum itallicum essential oil. It’s pricey, but a 2.5 mg bottle will make 3 bottles of 2 Oz serum. You can also add a few drops of frankincense, lavender, or ylang ylang. Plant therapy makes good essential oils.

    • @valeyard6650
      @valeyard6650 4 года назад +42

      @Fiona L as a biochemist, I think it’s very important to clarify what that extract does and does not do.
      It *can* aide in cellular turnover which in turn boosts collagen production, but in NO WAY SHAPE OR FORM does this “produce collagen” in and of itself.
      you know what also aides in collagen production and cellular turnover?
      like, literally and scientifically the same amount?
      washing your face with a gentle abrasive like a sponge and then restoring the natural PH balance with a toner.
      Serums can affect the cellular walls so that a product can be more penetrative, but ACTUAL anti-aging is based on internal factors.
      There is no product on the market or has ever been developed that can do the things the cosmetics and skincare industries claim.
      We pfaff around in the lab and come up with different formulations that all basically do the same thing:
      The APPEARANCE of change without ACTUAL progress.
      Essentially, it’s ALL placebo and ALL marketing.
      I just saved you thousands of dollars. You’re welcome.
      Don’t buy into the hype and then dispense those lies to the world like it’s fact. It’s just very good and successful PR.

The PR company paid you because if they don't pay you, then there's a breach of contract, voids the contract, meaning you can put that video back up as it's no longer paid for or sponsored content, it's just your content now. It was by your good grace that you took the video down. Honestly, you could have said that you weren't going to take it down unless they fulfilled the contract and paid you.
    It's an interesting problem for them, and it's better to pay you and ensure that you have a reason to keep the video off your channel. Just some info for you regarding, in my opinion, the most likely reason they decided to pay.

    As an influencer myself I actually appreciate your honesty as it pertains to brands and their quality, etc.
    Unfortunately in this space you see a lot of people who are willing to compromise for these companies.
    Ive always found that if I have something negative to say about a brand, it’s in how I frame it that the company seems to care about. For instance, I had some hair sent to me and the hair felt nice, but when I tried to color it, there was some chemical on it that reacted badly with the bleach. I simply informed my subscribers of what I liked about the hair, but was sure to advise them not to purchase it if they intended to do any color or perms, etc on the hair.
    By the sounds of it, you were VERY thorough, and in my opinion the company should appreciate that.

I was the only customer in the afternoon. I was sad that I could not freely check out their brand . I love to go to Sephora and swatch makeup. I am not an online buyer. I like to feel and touch things ( old school style )
    I was not messing up displays . I have worked in high school and college in retail so I respect sales people. Now hearing this I definitely will not support them .

      Lashlove16 I had same experience 38 years old wearing my nursing scrubs. I’m not a thief but they were watching me like I was. Sad

      I think it’s just one of those stores, like Mac, that wants to have the salespeople really involved and interacting with the customers. I don’t think she was being that way because she thought you were stealing, but because she wanted to push products on you. I find their technique really annoying and I refuse to go in their stores.

      Becky Shaknovich I know MAC well. She just wanted me out of the store . I never have felt so uncomfortable. I was in the store for maybe 5 Min

    What a shame. The L'Occitane hand cream is one that I use and swear by but no more. I can't stand when large companies try to do in the little people. It's bad enough that they are not cruelty free (since, in this day and age, there seems to be absolutely no reason not to be) and now they have shown themselves to be underhanded.. Great video, Jen. This is why we trust and watch your videos!

      Pre de Provence is a very similar brand, no animal testing and better quality ingredients (no parabens) ... better priced too. Jen should do a review of them and those other brands they asked her not to mention lol

      Look up La Chateleine hand creams on Amazon- they have the same 20% shea butter content that makes the L'occitane ones good for 8.29 a tube vs 12, and they smell Sooooo goood, the lavender one is heavenly (very natural calming smell).

    Be careful thinking the PR company is the hero in all of this. I truly believe the miscommunication was their fault and the contract was between Jen and them, not L’occitane. It was their obligation to pay.

      Sandy Rogers | exactly! This PR company is clearing spinning their own mistakes. This is all on them, not l’Occitane. PR companies are good at wording things, but the fact that they paid her, shows that they know they are supposed to pay under the contract.

      Exactly! I said the same thing. Jennifer had a contract with the PR firm directly. The PR firm was trying to mitigate their loss because of whatever miscommunication they had with L'Occitane and not lose any money they were now not getting paid.

    Your integrity is way more important than $.
    Good on you I imagine not everyone is so honest.
    Just keep your chin up. Your awesome.
    So sick of big companies treating us in the 'mob' like nothing.

      nishtha gupta Agreed, totally. It’s one thing to be honest, and quite another to be thoroughly researched and tested on top of that honesty. These videos by the children - the ones who use “honest AF” as a headline - spend more effort creating their own drama than doing the research and long-wear testing integral to creating a unique and informative review. I’m going off because I’ve had it -officially! :) - with the misuse and overuse of the word honest in the beauty community.

    SO GLAD you know this is illegal. I see so many you tubers that don't know anything about law and get swindled. If their side is breaching the contract than you can absolutely force them to pay and threatening a lawsuit goes a long long way.
    As someone who went to law-school I encourage everyone to stand up for yourself and know your rights! Trust no one to protect your rights except yourself.

    I believe if we don’t have integrity, what do we really have? I’m so impressed with your professionalism. Even the way you spoke on your video telling the story, so so good. Good for you for standing up for yourself. No matter how much money, it was the principle of the thing.

    I think you handled the situation in the best way possible!! Your integrity is so admirable ❤️ Side note: I have a friend who was raised and currently lives in Paris, and she said that Loccitane is more of a low-end skin care brand over there, and they can’t believe how much more expensive it is here in the states 🤷🏻‍♀️ idk, just one persons opinion, but I thought it was interesting

      Maddie Bartley I'm from Belgium and I Can confirm what your Friend told you. L'Occitane is really far from being considered a high end brand over here
