  • At Friday's hearing, Kohberger met his new judge -- and the new judge is tough.
    Bryan Kohberger is accused of a heinous crime: murdering four University of Idaho college students as they slept. Kaylee Goncalves, Maddie Mogen, Xana Kernodle and Ethan Chapin were stabbed to death in the middle of the night in a home in Moscow, Idaho.
    Kohberger pushed for a change of venue, claiming local Latah County jurors could not be fair. His Latah County judge, Judge Judge, moved the case to Ada, where it was assigned to a new judge, Steven Hippler.

    Judge Hippler was the chief administrative judge for ADA county during the Daybell trial, so if anything, he knows how to manage a high-profile trial. He did an interview with Nate Eaton during the Daybell trial.

    I think I am going to like this Judge. My biggest concern is that he will be able to keep AT in line and from trying to run the Courtroom. I liked Judge Judge too, but I didn’t think he was able to control AT, I think she has a very big tendency to try and “brow beat” the Judge, like a dog with a 🍖 bone!! IMO, I felt that Judge Judge just gave in to her to shut her up. Hopefully, this Judge will have a strong enough personality to stand up to her.

    It seems to me that if a juror can be swayed one way or the other by what the defendant is wearing, they shouldn’t be on the jury. 🤷🏼‍♀️

      Agree. Thankfully the little schoolgirl outfits and haircut didn’t work with Carly Gregg’s case. A good jury looks right past the defense’s “theatrics.”

      I'm guessing you aren't a defense attorney. EVERY aspect (no matter how small) that associates the defendant with guilt is to be avoided. Remember the mandate? They are INNOCENT until proven otherwise. Why would you advertise your client in clothes that indicate guilt? It's a no-brainer.

    I love this new Judge. Judge Judge was a bit too soft and allowed Anne Taylor to intimidate him, (I am NOT a fan of Anne Taylor) Imo. This Judge is a much better fit for this case.

      I never thought Judge Judge was intimidated by AT; if anything he was too eager to respond to WT's theatrics, and bending over backwards to indulge the Prosecutor's reasons for delays, toletate and fail to criticize the FBI's intimidation tactics on the Defense's witness. WT is the one who has been withholding evidence, he's the one who got the judge to side with him over stopping that crucial survey which by the way clarified "untruths" that he didn't want revealed, and got JJ to actually stop that survey for two weeks, and want what WT wanted, to remove those few questions, and start over w/o them! One of which revealed there never was any evidence that BK stalked the victims, or anyone else (ooops, there goes the motive, right?) Now WT has to paint BK as an even more psychopathic homicidal maniac choosing offhand a very congested parking lot on a big weekend, w/people coming and going, all evening and early morning, avoiding a DD delivery, and carrying a huge 'weapon" in his hands to a house he's never been in or associated with in any way (and he loves dogs, too)....can this new judge NOT be better than one beholding to a tight UID community and it's insistence BK is the 1? This one may be a graduate of UID, or a parent of one, or somehow connected to it, but AT is just as smart and hardworking as the best of 'em; if he's intimidated it will be w/WT and his already weak presentation in front of him! Uh, I don't know, umm, Ms.?
      (Assistant) should be able to speak to that..., is it all new or is it redundant? Referring to that huge amount of recently delivered ¥aπ∆ing 'evidence'? My bet is that there's nothing "new", and the theatrics are yet to come from his direction. Its2025 almost, even if the judge was 75 dealing with a smart, respectful woman in Idaho shouldn't be a problem, and perceiving a flimflam job easy to detect; if he hasn't already wondered at the improbable coincidences/missteps in that investigation WT was involved in leading haphazardly, but actually intentionally to this defendant.🤔

      @@nomadscavenger absolutely!! Everyone seems to think Anne was “brow beating” JJ… I never ever saw or felt that way. The defense shouldn’t have to fill (so far) 18 to compel to get evidence.. it’s the state that’s delaying.. I guess people are watching a different case than we are.

      👍💯%He doesn't seem to suffer fools either. And it's been WT's tactic to stall, or create a mess so that it LOOKS like the Defense is stalling when WT throws his "mt.of evidence" in total disarray on AT's desk taking months to put it together, then just recently turning over an additional (?) 398 gigabytes of more of his evidence which he cannot attest to being new or already included in his first dump, withholding crucial evidence, losing/deleting others, and forgetting what happened to the video and transcript of BK's "exonerating" proof he gave in that one MPD interrogation of where he was that night, and it wasn't in Moscow. Oddly, everything that could prove he was someplace else, and the actual route he took that night has disappeared. But it's the Defense with a good many witnesses on his behalf, and her continued conviction he's innocent AFTER going through it all that's stunning. And it looks like there will be more witnesses to come for him. Just who is going to come forward for WT and that DP is the real mystery IMO.

But I think this Judge is gonna run a tight trial which I think is a good thing, considering how IMO, under Judge Judge, who I liked but I don’t think he had a strong enough personality to deal with AT. As a retired Paralegal, I definitely saw her just “brow beat” Judge Judge to get her way! It also seems to me Thompson has just checked out of this case altogether! Heard he was going to try to assign another Attorney to try the case, but that’s just a rumor going around!

    You do a really good job summarizing the case which keeps me from having to watch court tv all day! I truly enjoy your channel and am amazed that you have kept your channel going even with what you have had to endure this year. I pray that the families gets justice even if he is found not guilty. All that any of us want is justice for victims.

    This judge seems like the perfect fit for this case. He came out swinging! All his points are practical. Definitely not as easily charmed as Justice Judge sometimes was 😂.

    The judge was changed because the last paragraph of the order granting change of venue quoted 21(c)(2)(B), which indicates that the judge does not wish to continue on the case.
    "Kohberger's Motion to Change Venue is granted pursuant to Idaho Criminal Rule 21(a) and
    21(b). Consistent with the language of Idaho Criminal Rule 21(c)(2)(B), this Court orders transfer
    of venue "without specifying the new place of venue" and refers "the case to the administrative
    director of the courts for assignment by the Supreme Court to court of proper venue in another
    judicial district and assignment of specific judge to preside in the criminal proceeding."

      @@terripetre8159 There is absolutely a reason for delays! Bill will not turn over evidence the defense is entitled to in order to defend their client.. There will be more motions to compel and this Judge will not tolerate Bills excuses.. or it simply won’t come into trial and that means reasonable doubt.

      In the end it does not matter. Chad Daybell was allowed civil clothes before trial. It did not change anything. He was convicted to death anyway.

    This case needed a tougher judge. This case has had so many stall tactics… as for his clothing.. there’s been countless high profile cases where the accused had to wear a prison jumpsuit.. why would kohlberger deserve special treatment? If that’s the new standard.. it should be allowed for all defendants otherwise the difference in treatment can also skew the public’s opinion. Kolberger wears a suit and Richard Allan is brought in with prison garb, dog collar, leg shackles, shock vest, hand restraints and 5 huge guards… how does that disparity affect public perception??

    Here's an idea: he pleads guilty and gets life in prison, instead of wasting all of that time and all of Idaho's money on defending him. I hope the prosecution isn't holding out for the d. penalty and not accepting a plea deal. It's fine with me if he rots in prison for the rest of his life; he thinks he's smarter than everyone else in the room and he can think about that for the next fifty years.

    As long as this judge is ethical I am happy. The Wilson vs Moscow law suit and the Giglio Brady law enforcement made an trial look iffy in Latah.

    I am disheartened with all the negative and derogatory comments about Anne Taylor. My good people, she is only doing her job. I don’t know if BK is innocent or not, but whatever the case he should receive vigorous counsel because for our system to come even close to working everyone should have access to competent counsel. Wishing that BK gets roughed up in prison, or that the new judge will sink his right to a defense is a ridiculous stance to take when there hasn’t been a trial. None of us right now know all the facts, and until we do I will withhold my personal judgement.

    I disagree with you about the clothing issue. I mean I have several people make the statement that they couldn’t tell if the defendant was even in Court because it looked like BK was just another attorney sitting at the defense table. I also think AT is already trying to push the trial farther out!! Also, look at how long Sara Boone has been on jail before her trial and the defendant in the Delphi case. Charles Manson wasn’t “trussed” up like Richard Allen!!

    Anne Taylor said in a hearing in Moscow some months ago that, for the mitigation during the penalty phase, her investigator has to go back THREE generations to get what is needed.

      That is what mitigation specialists do. They investigate the defendant's history to find anything that can mitigate the penalty phase.
      "Because no person is able to recall, describe or even know all the ways in which they have been impacted, mitigation investigation relies on the collection of information from various sources including records, archives and subject research. Document collection spanning at least three generations of the client’s family is undertaken to make sure that patterns of behavior, medical conditions, generational trauma and other impacts can be seen and understood in the context of the client’s development."

    :/ ..that Judges' comment causes concern because it might be a consequential comment for a mistrial. Nowadays defense attorneys are looking for any kind of comments etc.. for "mistrial". Especially in cases like this.

    A mitigation expert? Doesn't that imply the guilt of the defendant? I thought mitigation provided a reason for why the accused did what they did...

    Great video. Agree with your opinion, 25 defense experts are a lot. And length of trial seems excessive. Why is this trial so expensive? Already has cost more than Lori Vallow and Chad Daybell trials. AT needs to not be allowed to have such lengthy testimony from her "experts" as she did at hearings.

    The court doesn’t understand, the preparation for this trial will take longer than any other preparation that’s ever been prepared before, this case is more complicated than any case that’s ever existed before, and Brian is more innocent than any defendant that’s ever been tried before… Just let her prepare for trial till 2030, whenever she’s ready! We’ll all just wait!!

    There is a significant difference whether case is tried in May or September. Justice for surviving victims and victim families. Secondly, one expert already passed away waiting for a trial

    Is it really the prosecution's job to provide "contradictory precedent"? Surely not, that is the job of the defence. Else you may as well impose a Continental European system of justice where one lawyer acts for both plaintiff and defendant.

    Seems opinions are very different amongst lawtubers. Did you notice how everyone held good posture once that judge started to state HIS rules. First lawyer that mentions BK likely could be a target? 25 experts? Joe Shmoe, suspected of murdering person X who also is presumed to be innocent I am sure won't get his 25 experts ...
    This is my issue. Fairness applies both ways.
    I'm bothered about the 'want, want, want...and then some, attitude of the defense? What tangeable have
    So just consider 'but what if he did?'
    And why be such an angry contrarion when we don't know all the facts and what evidence we will be shown.

      The trials starts most probably next september. There are no jurors and they surely don't talk about jurors now.

      She didn’t have a choice, it was assigned to her. She is a private lawyer now but she’s still on the list of lawyers that was death penalty certified public defenders that can be lead counsel on the case and she is the only one that serves the northern Idaho area.
