- Tensions rose as an MMDA clearing team started to remove a car wash from the sidewalk, beside a Barangay hall.
After this incident, the Barangay Chairman was summoned by the DILG, taken by the PNP for inquest and the car wash was smashed down.
Aside from obstructing the sidewalk which is intended for pedestrians, any customer using this car wash will further obstruct the road itself. This is a busy Mabuhay Lane in Manila City.

Well it was in the news already.
He was summoned by DILG and also taken by PNP for the inquest.
The car wash was also smashed down (photo in the comment section of my Facebook post)
A lot of people just don't understand that the administrative route is really the most effective option in that scenario.

I don't think DILG have publicly announced what action they're planning to take... yet.

This incident was already reported to the DILG.
The PNP also arrived and started the process of investigating the alleged physical altercation.
The problem is DILG is stupid like abalos🤣🤣🤣 DILG is blind when it comes to money🤣🤣🤣

The very reason why my blood boils with this kind of official imagine he’s only a barangay level official and yet acts like he owns the streets, what more if he’s elected to a higher position. Abusive officials shouldn’t be tolerated and be dismissed right out.
Just imagine how much traffic could be caused when a car decides to illegally park, so they can make use of this sidewalk carwash.
And then consider the amount of water and electricity that will be used, and the amount of damage that the road will suffer, after being left wet and soapy all day, every day.
Is it still worth the ₱5 per 3 minutes?
That is why manila esp, is a hard city to crack down... they just don't back down even against government authorities. They feel that sense of power when they have kagawad/chairman/police/even some councilors to pampered their illegal doings.

Not only do the trucks obstruct the road, but they continuously break the flow of traffic by running back and forth between the trucks and the warehouse, unloading a few sacks at a time.
Their customers also block the road while they buy sacks of rice directly off the back of the trucks.

That's why people were asking if the DILG will take an official position on this, now that they're renewing their focus on clearing public roads.
The national law says it's not allowed, but the LGU will give a MOA or permit that says it is allowed.
The MMDA clearing teams have pretty much always been told to respect the autonomy of the local government.
Although in some extreme or dangerous situations, they won't honor it.
GA we hoping that there is a follow up here regarding that Chairman, masyadong mayabang eh, illegal naman yun gawain.
then why isnt this cleared right away, if the owner of the carwash is not a brgy official, im sure the clearing would push through.

I hope there will be an update of the result of the case in regards to this. These guys were too overconfident about something to push the MMDA aside. I hope justice is served.
@@edwinamazona5474 the Question is what would cause sir. Nebrija to back out when he usually is dominant and intolerant to nonsense which I liked about him. But why back out now and allow these people to even bargain keeping their stuff when it should have been confiscated.
I think maybe jurisdiction or said laws by the local or municipality of that city that made him back off and review the case. So MMDA will be back with full authority and backed up by the DILG

this why in my opinion baranggay offiials should not be elected but rather appointed by DILG... the baranggay captain should be replaced by an administrator who is not from the same barrangay to minimize situations like this.
It is disgusting what elected Barangay officials expect to get away with. They are a law unto themselves.
It makes a mockery of what little law there is here in the Philippines. The DILG is complicit in this as it is much to rare that they discipline these wayward officials

Under Philippine law "any willful attempt or threat to inflict injury upon the person of another, when coupled with an apparent present ability to do so, and any intentional display of force such as would give the victim reason to fear or expect immediate bodily harm" yan ang assault. Hindi man nakita sa video ang assault sa dami ng witness n kasama ano sa tingin mo sino mag sisinungaling? ang corrupt na opisyal na yan or mga mmda na andoon lang para magbaklas ng illegal structures?
My first reaction is who the f*ck is that guy in black polo shirt. In my opinion, MMDA should have confiscated the equipment since it's a legitimate clearing operation prior escalating to DILG because of the incident. Imagine that person holds a public office in baranggay level what more if he's on a city, province or let's just say national level. They only care about their personal interests.

There was an update released earlier. Apparently the Barangay Chairman was already summoned by the DILG.
I already saw the PNP arrive on scene and start the investigation/report of the alleged physical altercation.

This is a great example of why so many laws in the Philippines are ignored by the people. When their elected officials break the law, why shouldn't they?

Just wow! The chairman refuses to be the exemplar of discipline. I wonder how his constituents views this behavior. Probably his unadherance to the law is being emulated by his ka-baranggays. Disappointingly, the wrongdoer is even more agressive than the righteous!

It only takes a Padrino to settle the case. You guys are the implementing agency and the power of the law is on your side.. That chairman should have been apprehended straight away for not submitting to the authority, just like you do to any vioalator or the law.

this is because to my knowledge, no brgy official has ever faced consequences of obstructing the sidewalks, even not clearing the sidewalk for their constituents.

i admire the calmness of this MMDA officer. He knows the right thing to say to most people.
If it was a common man, they will immediately confiscate the items. But because this idiot is a barangay official, they just removed it and returned it to the offender. Unfair justice.
I'm not so sure about that. Because there's a "common man" also operating a sari-sari store on the sidewalk near the Barangay hall. Their stuff wasn't taken either.
MMDA SCOG are generally far more lenient than DPS. They do sometimes confiscate items, especially if they already gave a LOT of warnings. But most of the time, if the owner is there, they just make them take the obstruction inside their house, or to roll away.

It's clear that the officer who expressed the dynamics between 2 business operators and the right to establish legal ownership of a shared space... It was commendable how the officer negotiated a peaceable outcome in an otherwise volatile situation.

Baranggay captain is supposed to uphold and enforce the law. No need for major discussions. The law is the law!!! They don't own the sidewalk.
That's why they didn't waste their time fighting with the barangay.
It's simple and quick to file a report with the DILG.
That's why the chairman was summoned by the DILG. And because of the alleged assault, he was taken by PNP for the inquest.
The car wash was smashed down and the sidewalk is clear.
A lot of people just don't realize the administrative route is easier if you're dealing with the barangay instead of an "ordinary" person.

That's the sad reality. If you sit in your office and stay quiet, you can have an easy life in the Government. But if you go out and really do your job to the best of your ability, many people will get angry at you.
And some people will even get jealous and say you're showing off, because you do too much compared to them 🤷♂
