Fair Dealing
Source: www.gov.uk/guidance/exception...
Certain exceptions only apply if the use of the work is a ‘fair dealing’. For example, the exceptions relating to research and private study, criticism or review, or news reporting.
‘Fair dealing’ is a legal term used to establish whether a use of copyright material is lawful or whether it infringes copyright. There is no statutory definition of fair dealing - it will always be a matter of fact, degree and impression in each case. The question to be asked is: how would a fair-minded and honest person have dealt with the work?
Factors that have been identified by the courts as relevant in determining whether a particular dealing with a work is fair include:
* does using the work affect the market for the original work? If a use of a work acts as a substitute for it, causing the owner to lose revenue, then it is not likely to be fair
* is the amount of the work taken reasonable and appropriate? Was it necessary to use the amount that was taken? Usually only part of a work may be used
The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.

The concept of fair usage exists within UK copyright law; commonly referred to as fair dealing, or free use and fair practice. It’s a framework designed to allow the lawful use or reproduction of work without having to seek permission from the copyright owner(s) or creator(s) or infringing their interest.
Fair dealing law is not only applicable to text-based works; it applies to musical, dramatic, artistic, literary and typographical works too. However, it does not cover the copyright of printed music.
As an exception to British copyright law, fair dealing is governed by Sections 29 and 30 of the Copyright, Designs and Patents Act 1988, which outlines three instance where fair dealing is a legitimate defence:
* If the use is for the purposes of research or private study;
* If it is used for the purposes of criticism, review or quotation;
* Where it is utilised for the purposes of reporting current events (this does not apply to photographs)
A statutory definition for fair dealing does not exist; it will always be a matter of fact, degree and interpretation in every fair dealing case. Nor is there a percentage or quantitative measure to determine fair dealing. The Intellectual Property Office lists the key factors used to determine the validity of whether a particular dealing with a work is fair as follows:
* Has the use of the work impacted negatively on the market for the original work? If the creator or owner has lost potential revenue through the re-use of their work, it is not likely to be fair.
* Was it reasonable and necessary to use the amount of work that was taken?
The Copyright, Designs and Patents Act 1988 also outlines the potential fair dealing defences that permit the use of copyright works without permission from the author(s) or creator(s) under UK copyright law. Развлечения

Great list 🎉 I knew most of these, especially the older artists. I always thought Carl Douglas was German (like Milli Vanilli and Bony M) so I learnt something today
Thanks! Yeah i was surprised by a couple myself making this list!
Billy Ocean was British? wow I didn't know that. That surprised me. In fact a few surprised me.
Born in Trinidad but moved to Britain as a young kid and definitely has dual citizenship. But i think a lot of people thought he was American anyway lol. Thanks for watching
@@Media_Ranker Yep I thought he was American.
Probably british don´t know. Richie is a british artist who lived in Brazil for decades. He was a succesfull singer here in the 80s. He used to sing in portuguese.
Oh wow yeah i dont know if he is known here at all really, ill definitely look into his career. Cheers
Some of these definitely surprised me. Great list. Your probably my favourite music list RUclipsr at this point.
Appreciate it mate thanks!
I hope there will be part 2 later, let's make british music great again 🇬🇧💂🏻♀️
White town young women sounds like the imperial march
It does a bit actually! lol ive never noticed that. Thanks for watching
Few dodgy classification of british in there, but how did people not know tom jones was welsh?
This was really just about initially, hes even talked about everyone assuming he was american with his singing style and type of music/voice. Cheers
Great list! You could probably narrow it down a bit taking out such as The Police, Billy Idol, Eurythmics and Amy Winehouse and a few others
But very few made me go “Come on. Who doesn’t know that?”
Some were absolute shockers like Hot Chocolate, Ace, Average White Band.
Funny. 30 Rock did a live show where Jenna played Dusty Springfield and she played her with a Kentucky accent “Howdy Yall I’m Dusty Springfield!”
For the west coast version of the live show….someone must have told the actress that Dusty was British.
Thanks. In fairness its easy to assume she would be american, especially with that name too. Cheers
The only surprise for me was Eddy Grant. I thought he was Jamaican.
He is Guyanese-British but has now been in England for almost all of his life. Cheers
How can u not know Amy Winehouse was British? XDDDDDD
This was about people not knowing initially, at least in most places when she first got really big, cause she had that old american Kazz soul voice basically. Cheers
TIL a lot
You’re counting the UK 🇬🇧 Commonwealth countries as well?
Just any artist who has British as (or part of) their nationality basically. For example Billy Ocean was born in Trinidad but moved to England as a kid and is a British national. Cheers
I thought the Bedingfields were from New Zealand, that Katrina's from the US but not the Waves and that the Nightcrawlers were from continenal Europe. I remember thinking John Waite was American and being surprised to find out he was British. I knew all the rest of these were British or part-British with other nationalities, yes like the Bee Gees,Eddy Grant and Billy Ocean.
what about tears for fears? or spice girls?
Possibly, i think you can hear it a bit in Tears For Fears accent when singing, both Roland and Curt. And with the Spice Girls they blew up so quickly they were doing interviews around the world straight away lol even if you couldnt tell from the singing itself etc. Thanks for watching
Dusty was irish
Was she, you must mean her parents were then? She was born and raised in England no? Cheers
Carl Douglas, Kung Fu Fighting was a surprise
Yeah i didnt know until quite recently too actually! Cheers
Sade is Nigerian. Eddy Grant is Guyanese. Carl Douglas is Jamaican. Billy Ocean Trinidad.
They all have british citizenship and consider themselves british too though, spending all (or the vast majority) of their lives in Britain. Tt cant just be about overall heritage either if you see what i mean. Thanks for watching
You can be both.
Sade was the name of the band. The singer's mother was white English and the rest of the band were all English.
Sade is British, through and through. Her father was Nigerian. She grew up in Essex. Eddy Grant is British and was brought up in the UK, as was Billy Ocean.
