  • The Supreme Court released its ruling in the case Warhol v. Goldsmith - and it has significant impact on artists and creators of all kinds! I absolutely love copyright law and it was a main focus in my degree, so I've been fascinated by the results of this case. It's complex, so I hope this helps you understand why it's so important.

If you're new to my channel - welcome! I started my business on my 18th birthday selling paintings I made in my free time. I continued to run and grow it throughout college and graduate school, and into law school at Duke University. Now I'm running the business full time, law degree in hand, and I wouldn't have it any other way! I sell my art on my website, wholesale on Faire.com and I license my work to be sold in stores including Home Goods, Marshalls, At Home, and World Market.

If the property belongs to someone it does not matter how much they charge or if they are keeping it for themselves. Just because someone calls themselves an artist doesn't give them some special right to make claim that someone is charging too much for their property..........smh

If you mean that in response to the dissent’s point about exorbitant licensing fees stifling creative freedom, the counter is that copyright protections are granted by the US Constitution *only* to “promote the advancement of science and the useful arts”. So if copyright starts inhibiting creative expression by granting broad monopolies, then it is no longer achieving that purpose and is actually counter productive!

When it’s not your work and you know you are intentionally using it for the actual purpose of financial gain, I do say you should reach out to the rightful owner to ask permission and yes also pay for their work. I don’t know why people think you should be allowed to use trademark or copyright materials for their own financial gain. If I didn’t put in the time, effort, and creativity to do the work, then I’m not entitled to it. It’s good you went but some things are just common sense. Even celebrities know this. So why on earth would it be okay to use another person’s intellectual property?
