  • In this Indic Samvad, Sai Deepak shares his personal journey from an aeronautical engineer to an Intellectual Property Rights advocate to one of the most renowned lawyers for Indic causes.
    Sai elaborates on whether the Constitution of India is an anti-Indic document? Is it a problem of document itself or has it been misinterpreted in a particular ideological fashion? He explains how the position of constitutional morality varies with contemporary dominant ideology. He advises that independence of the judiciary must accompany judicial restraint for its effective and impartial functioning. It is imperative that ‘right based discourse’ of the judiciary must be balanced with ‘duty aspect’ of judicial restraint.
    He argues that in India, looking at recent judgements, the highest court of the land which swears by democratic values is constantly undermining any dispensation which has the mandate of the public. It is therefore losing the confidence and trust of citizens, thereby forcing them to look at an alternative model of governance.

    Very well expressed. We require a judiciary that is a functional organ of the Constitutional democracy, not one that evolves into a super-state. So, its independence has to be wedded to accountability and not to absolute autonomy.

    Thank you Sri J Sai Deepakji and Sanjayji. This conversation between you is a very crucial high quality discussion devoid of rhetoric. It is Very frank to the point and expresses the thinking and feeling of all Indians in particular who understand this game of breaking India. I hope the Judiciary is listening to this as it has dire consequences for them and the integrity of India. They are very much part of breaking India forces. The Indian judiciary is divided along Secular, Christian ,Dalit and Christian lines pushed by Congis. Unfortunately no body is standing up for Dharmic tradition of India.
    Thank you again to the joint producers Jaipur Dialogues and center for Indic studies with a request to produce or translate in regional languages for this critical election year.

    Yes I understood Mr SAI the reasons for Ur change of course midway of Academic career from wanting to b a AeroSPACE Engg to Law. Xlnt Logic Rationale n strong passion Reason too. Yes I agree a civil servant Hardly can go by his WISDOM n strict Rules but manytimes has to yield to political pressures n it gets habituated n part of his DUTY..your loyal n ROYAL Lawyer PROFESSION can surely has d potential to help argue well for d real fight of social cultural n Religious justice n constitution well functioning . !!     It is the same SC , many years ago ruled that legislature cannot amend the constitution to change its nature. In my academic years I used to hold our SC in highest esteem. Recent years there appears to be complete chaos in its functioning. The same court doesn't practice its ruling when it comes to interpreting the constitution. So we've the situation that legislature which represents the people of this country is restrained from amending constitution beyond its nature the c they gave for them selves but the court when interpreting the constitution can go beyond the intended nature and force it's view on the people knowing there is no constitutional redress against court.
    The secular aspect of our constitution, as Indians like me understand, was required only to signal to the western world and to one of the minority groups ( in the context of partition) that the country will respect pluralism . From ancient times pluralism and free thought has been the way of life in this land unlike in the medieval l West where religion stifled free thought and liberty, and hence a mechanism through constitution had to be put in place. No one then thought that the constitution will get interpreted to mean that Hindu traditions and faith have to give way to western notions of equality, gender parity, environment, animal rights etc, because secular state doesn't accept religion except of minorities which are constitutionally protected. This amounts to a betrayal of the Hindus and their way of life.
    Now, this is made possible in a sense also because there are hindus and hindus of all shades, and brainwashed by the abrahamic religions they are exposed to in a modern society, many of them have lost the inherent hindu ethos of pluralism. so much so, a Arya samaji or a Sai Baba denomination may not only not appreciate temple traditions but worse (;leveraging narrow individual rights) they will seek to impose their belief on how temples should run. A wise judiciary with deep understanding of constitution and it's background would actually see the myriad faiths of hindus as themselves requiring support from this tyranny of homogeneity. After all that is why we fought and got independence after 1000 years of alien rule! Not only this, in the absence of fundamental citizen duties the emphasis on individual rights can soon suffocate the society, and hence the need for upholding fundamental rights of groups in a democracy. We don't want to be a Nordic country where parents can l be prosecuted for cruelty based on a neighbour complaining the infant cries always.
    Now, who will bell the cat? I'm sure the SC judges are well aware of all these conversations , and are intelligent and perceptive to understand the nuances. If only they will believe that their role is to settle disputes , foster harmony and preserve the civilisationsal ethos as guaranteed by constitution ( so beautifully touched on by J Indu Malhotra) then we will be rid of all the senseless litigation and backlog piling in our courts. Second, I see our High courts much wiser in this respect probably because they are close to ground and the people. Unfortunately, as a common citizen I see these days the SC encroaching on the sanctity of HC by encouraging all sorts of appeals to it , only because hierarchically (not necessarily functionally) it is above HC. So many HC decisions get reversed as though there was no proper analysis and application of mind there. By respecting , empowering and holding HC accountable, the SC can further reduce the senseless backlog of cases and make for itself precious time to function as truly wise guardian of our constitution as envisaged by the constituent assembly. And if they genuinely believe there are new values or reforms the country will do well with, then they can always work with government and the people through civilised debates and democratic approach for constitutional amendment wherever necessary. After all,constitution is people's document and they should be able to amend it by due process to reflect changing times. This would be a far more acceptable approach than SC donning a reformist role through its judgements
    Everytime a new CJI swears in I eagerly look for changes that will restore the aura of this institution for common citizens like me. And I do hope it will happen sooner than later. Let our respected judiciary not miss the woods for the trees. Vande Maataram

      Sir also there are contradictions in constitution itself
      For example
      If acc. to IPC if we have right to live with and if we do anything illegal and immoral
      One judiciary has rights to punish it
      Also in constitution we have all the rights to practice and promote our religion
      So if there is a religion
      For example islam in which acc. To their faith their duty is to kill kabir that is all the non-muslim , agnostic and atheists
      So here constitution will support whom
      And is it possible to resolve this contradiction in near future

    Sanjay is well informed, but should guard against leading the person interviewed towards a stand he approves of. The result-the opportunity is lost as a different lens is lost. Besides, the listener would not get the opportunity to listen to the expert taking you to his core strengths and views. All he does is take a stand on the ideas expressed by Sanjay

    The constitution of India is colonial. A copy of the govt of India act -1935 made by Sir KC Benegal, a loyal servant of the empire and another loyalist Ambedkar who was the law minister in the Viceroy’s council !
