At this point, Nintendo is a legal company with a side business in gaming. Nothing anyone can say to me would make me feel bad for pirating their games. I pirated TotK as soon as I could and I don't regret it in the slightest.

Nintendo usually doesn't sue for patent infringement. There's a sort of code of homor among game devs that they can use each other's patents, and nobody takes legal action. The patents are in place so that some random person can't patent them first and then sue game companies for using their patents. So, either this is a counter sue that Pocket Pair started, or Nintendo is suing for another reason and using the patents to get it started.
If Palworld is infringing on Pokemon, then Donkey Kong was definitely infrining on King Kong.

Apparently that is an option. There is a patent from Throwing an object in a 3d space to catch a creature, written in more legal terms. We don't know exactly what patent they are using, not even Pocketpair knows which I think is bs, but is surprising they managed to grab that one.
Some elements in Legends Arceus, like transitioning from the field to combat after throwing a pokeball or in Scarlet/Violet like sending a Pokemon to gather items automatically are patented by Gamefreak.
So that is probably what they are suing over, I honestly don't think that would be enough to win a case, so there is probably some other things they haven't mentioned yet.
But if Nintendo really has no case then this would be excellent for gaming, it would set a legal precedent and make things like Namco patenting loading screen minigames or the Nemesis System EA patented not valid anymore and more games would be able to use elements like those.

The fact they waited to do it when the hype died down makes me think they might have a valid claim that they found after doing some digging. If they really just wanted to bury Palworld, they could have done it when it was still new, even if their claims would be frivolous, at best.
There are a lot of people that still care for PalWorld so it’s not a dead game. It manages a player count of 20k a game on steam alone and for a game of that size that is pretty sustainable.

It always makes me wonder why it takes so long to get these lawsuits going. The minute I saw the Palworld trailer I was like, awe Nintendo is gonna sue these dudes into oblivion. So the only surprise here is, why’d it take this long?

The way you catch and train, the subtle difference of each creature, how the playable character looks, the gameplay. All has to be considered in the case otherwise Nintendo would not make a claim

Since it is a joint lawsuit between Pokémon and Nintendo, that narrows it down to 28 cases filed by both companies, and while there are 4 patents filed after Palworld's service, these are enforceable against Palworld because they were filed in addition to the other ones.

Which likely won't work because they're far from the only game to do so and aren't even the first one (that would probably be the first megami tensei).
Even digimon technically predates pokemon in the form of tomagachi variants directed at boys.

Hopefully more than just that, otherwise it would have made much more sense to go after them over the fact many of the monster designs are blatantly just slightly modifications of established pokemon rather than something mechanic-based.
