    'Unnecessarily loud machines' implies the existence of both 'necessarily loud' and 'unnecessarily quiet' machines.

      Sirens are "necessarily loud".
      Electric cars at low speeds would be "unnecessarily quiet", so they added something extra that is just "necessarily loud".

      Nope. Logically, it implies the existence of only one of the two, which in practise that would be 'necessarily loud' machines, for which there are countless examples (e. g. rescue helicopters).

      Make the insurance cover the activities and conditions that farm and maintenance vehicles are made and used​for rather than force them under unsuitable policies for road vehicles.@@olmostgudinaf8100

    My ride-on lawnmower has a sticker saying something like "extra-silent" with 55dB or something like that. The thing is that you need it only a few times a year. So these machines become very old and spending much more money for a BEV doesn't make much sense. You'll also need electricity to keep the battery warm enough in winter -> energy costs. But very many places where they're kept don't have electricity. Where I live, you don't have so big lawn in town that such a machine makes sense. It's for properties outside the town where you don't have electricity (except for some high-voltage powerline where you don't want to connect a Schuko plug by yourself...).

    I wouldn't call a chain-saw an "unnecessarily loud machine".
    The makers of chain-saws spend considerable time and effort in trying to make them smaller and quieter. But you simply can't have a big muffler on them for safety reasons, as one of them will burn you in no time. Additionally chainsaws need serious power in a light package, as weight directly impacts usability and controllability.
    As for electric chainsaws; those are not really working good enough yet for professional use. Fuel simply has a much higher energy density and much lower price than lithium batteries.

      Stihl or Husqvarna?
      And for our business the answer is Husqvarna 550 XP. With 50ccm it is the classic "Fichtenmoped".

      @@thestarjonSo how do you propose cutting large diameter wood then?
      A chain-saw is by far the best and most efficient tool for that job. Unless you want to bring in a big harvester, which incidentally also uses a chain-saw, just a hydraulically driven one, to cut the stems.

      I don't own one, but not because I don't need it but because I know that the nearest rental place is less than half a mile away.
      And for full transparency: I don't actually need a chainsaw, but I do technically own one I inherited. Not that I ever touched it or half of the tools in the shed it sits in. But the rental place is real and really there.

    I have insured these vehicles in my private liability insurance. This will certainly also be the case with other insurance companies,
    The only problem is that it is not compulsory insurance and around 20% of people in Germany do not have this type of insurance.

      Are you sure it's included in all private liability insurances? If not, the number of people where this isn't covered is most probably higher than these 20% add up to.

      @@LEJapproach I have just had a look at the rate components of an insurance comparison calculator.
      Here is the result:
      ⇒ Working machines (e.g. lawnmowers) and ambulances with and without engine without registration requirement
      insured (1599 tariffs)
      insured up to 20 km/h without registration requirement (12 rates)
      insured up to 20 km/h (30 tariffs)
      not insured (4 tariffs)
      Even if work machines up to 20 km/h are not currently insured, this clause could certainly be included by the German Insurance Association (GdV) at a reasonable price at a later date. My tariff, which includes it, costs just 50 euros a year.

    especially for Farmers this would have been another blow. They would need to have insurance for all of their "Selbstfahrende Arbeitsgeräte" like Forklift, Frontloaders and Combines. Most Farms have several of these and I would estimate this sums up to 1k+ € easily. Right now damage caused by these is payed through the Betriebshaftpflicht, so no real issue here. Just additional paperwork and loss of income.

    Has an automatic wheelchair to be insured? It seem to fall in the category, because they don't go faster than 20 km/h. But they almost exclusively are in public.

    Andrew, first off, I have neither a chainsaw nor a blasted leaf-blower (I hate leaf-blowers), but I challenge you to regularly mow 3000 square metres of grass with a push mower.
    Secondly, and it's something you hinted at but didn't pursue, the proposed legislation wasn't specifically for sit-on mowers: over the years I have known a number of travelling entertainers who have lived in Bauwagen and travelled around towing those Bauwagen behind old tractors, officially limited to 25 km/h. As such they are allowed to drive on the roads but are not required to have insurance.

    One of the rare instances where I agree with the CDU, I must admit. While I'm not a big fan of all the noisy apparatus Germans (but not just them...) have, this would have been over the top bureaucratic.

    In Switzerland you need till a few years a insurance for you bike.
    That was solved like that. You bought in your supermarket a sticker
    you put on your bike.

      very good law. A friend did not know about insurance, caused an accident with her bike and had to pay two years long to cover the car's damage. Now she has got a private liability insurance

    Interestingly most of these "slow speed motor driven devices" (eg Fork Lifts, Lawn Mowers, Electric Mobility Scooters, even large Farm Tractors and Harvesters) ARE required to have a Concessional Registration plate attached to be allowed to venture onto Public Lands. This is relatively cheap but does include the general Compulsory Third Party Insurance component of all registrations.
    Heck! That must put us up there with the Third Crikey! 😱🙄🤣🤣

    I've said for ages that there needs to be a legal distinction between driving along a road and driving across a road. Those are very distinct usage scenarios, both in the type of technical equipment needed and the type of risk posed.

    Another thing I noticed is that the electric scooters have number plate. So they do count as motor vehicle.
    And on the "car owners play for lawnmower accidents"
    That is like how vehicle taxes are paid for owning a car, not for driving it on the road. So no matter how much you drive on the road, you have to pay the tax.

      Wrong. You pay vehicle tax for the right to drive on the road, no matter how much you use that right. But for a car that is never taken out onto public ground, you don't need to pay it.

      It might take a role that guns have in South USA. Completly unnecessary. You have to know people don't have such huge properties, nothing like a golf course to need such a oversized lawnmower. But they buy it anyway, just for their feeling to move huge machines.
      They cannot afford a bulldozer or caterpillar, but a lawnmower fits in their garden.

    I have a chainsaw here in the UK, as it saves me a huge amount of effort using a bow saw and age is catching up with me. It is, however, a civilised battery powered one that is plenty powerful enough for my needs. All of my powered garden tools, with the exception of the power washer and shredder are battery powered, and those last two are electric. They are also about as quiet as they could reasonably be, and nobody comes bothering me about excessive noise, whatever time it might be so long as it is daylight.
    In any event, I believe that California has passed a law which will make the selling of petrol (gas) powered garden tools illegal. I am, maybe, a bit surprised that Germany is not in the vanguard of such things.

      The "Alpha" thing would be to put a massive house on a suburbs bulding lot and build a pool in the backyard.

    This would be a headache for me and my boss, as my work does lawn equipment repairs, with a pickup and delivery service.
    From what i remember when i started driving, i needed to be put on the insurance to drive my parents cars, unless the insurance gets a notice, which would give me permission for a short time to drive it, or in situations like a emergency.

      Motor vehicle liability insurance can be purchased with both options. The standard case is "all drivers with a valid driver's license". There is the option to insure only certain drivers and get a bit of a discount.

    But first of all, lawnmower is a gardening appliance, a tool, not a vehicle. If it is left unattended and involved in an accident, it should be considered just like some other tool left on the road. If the person was on it, it's simple as a pedestrian handling said tool. Same goes for mini-baggers and all.

      It has an engine, and said engine is propelling the mower and it’s operator, hence, I think, the category of vehicle is appropriate

      @@CULater000 all power tools have engines, be they ICE or electric. The propelling of the mower is not the main purpose though, but powering the blades is. Transportation of an operator is a byproduct feature.

      @@theod0r but it doesn't do the transporting purposeflully, that is the idea behind "byproduct". Meanwhile pretty much everything is legally defined by its function. If you look up the definitions, they most likely to start as "smth - a mean of..."
      Shoes are more of a transport than this. And they allow for greater speeds too. 20 km/h set as the limit is marathon winning pace. Never seen a lawnmower travel as far as 40+ km. And yet even so they are not, therefore even less of a vehicle is a lawnmower. Which is currently reflected by how few types of roads they are allowed on: basically those, where pedestrians are.

      Nope, it's a race car :-) The kids here in my neighbourhood using daddy's lawnmower regulary to drive around (yes on public road!) and to ride to their gandparents aprox. 500m away. They have never the intention to use this mover for gardening. It's more used like a electric wheel chair, for transportation. So lawnmovers may have a lot of hidden uses.

    I doubt the CEOs of insurance companies pay for their own insurance.
    As for the TV and radio licence, that is disgusting. I haven't watched TV or listened to radio for more than 27 years. I stopped while I was in the UK, and when I came to Germany, saw that it was much worse, but yes I have to pay.
    Apparently we all "have the right" to watch/listen, so we all have to pay for the rubbish.
    Newspeak, possibly?
