Just for clarification, you can’t patent a NAME. You can TRADEMARK a name. Parents are for inventions, which Lush is claiming their bubble bar is. I’ve read the entire patent from top to bottom and list nearly every possible recipe and ingredient ratio you can mix to get that hard bubble cake. Every recipe I’ve made has definitely fallen into an infringing category. Also, just because everyone is infringing doesn’t make anyone safe from being slapped with a lawsuit if LUSH decided to find you. Sure, they would probably go for bigger people first and MAYBE it wouldn’t hold up in court, but you have absolutely no guarantee of either of those things and unless you have wads of cash lying around for legal fees, potential fines, etc. then in my opinion, it isn’t worth the risk. For me personally, I would not feel good about scaling my business up with products that might be infringing if for nothing more than my own sense of right and wrong but that’s just me and as long as crafters are made aware of what laws are in place, that’s where my contribution stops. I certainly don’t want to boss anyone around, I would just hate to see anyone in the community get hurt. 💗
Ok, call me crazy but I just read everything too - if you skip sodium carbonate and instead use bicarbonate according to their process (which is the patented part) you are not in violation. Would you read it the same? They're not saying the carbonate is simply an ingredient but is THE ingredient that makes this an invention instead of a recipe. I've only ever made bath bombs and not bubble bars, but the legalities of this are fascinating to me. Quote from the patent - "The use of sodium bicarbonate in bath products has long been known. The substitution of this well known product in this type of formulation gives very surprising and positive advantages. The paste, which becomes solid with some sodium carbonate replacing the sodium bicarbonate, does not become infused with carbon dioxide during production enabling the mixture to be shaped and cut efficiently. Unfortunately I searched for this patent cant find it on the official website the gave in the article so no the bubble bars are not patent they are in the pending but til they are approved they are still legal
@@mommarichman yes. They specify that the recipe with bicarb is not new and that they are patenting the hard variety with the sodium carbonate. They also have not included SLSA in the patent combinations. Third thing I found when I compared my recipe is that my recipe has 7% cream of tartar which falls outside of the parameters of this patent. HOWEVER they have trademarked the name Bubble Bar, so if you make a bicarb based recipe you need to call it something else, which is why you see a lot of Bubble Scoops.

They (Lush) probably wants to sell other companies the ability to use their patent. I think you can buy into it much like you can buy the ability to use copyright items.
Anyone can make and sell a solid bubble bath and they do. Lush just don't want people outright copying their products. Also, I think you should do some research before you slag them off. They often want other companies to copy their methods, that's why the world has bath bombs, shampoo bars and shower jellies, even though Lush invented them. It's a lot more complicated than that, but the bottom line is they invented it so they get the rights to it and the rights to sell it just like if anyone else created a marvelous invention, pay to have it created and deserves to be making a profit for that unique creations. Anyways bubble bath is not essential and if you don't want to buy the bar from lush then just don't use it (they are not a bad company from an ethical standpoint). Or you can just use a shampoo bar for some bubbles in the bath.

I remember (a couple decades ago) when absinthe was illegal to sell, but not illegal to give away, I went to a bar in New Orleans with some friends. They bought a $8 drink that came with a free shot of absinthe on the side, because that was the only way the bar could serve it!
Usually you are ok if you are not making a profit off the item.... however I feel like this would be pushing the limit and I am not sure I would do it myself. A good idea though.

It's currently 0425 here in KY on Christmas Eve. I'm hearing the cacophony of four of my six grandchildren snoring in my living room, while their parents are resting happily in a 5th wheel outside. (Cheaper than a hotel, comfy bed and it's heated!) Our Christmas Eve Tradition, is making fresh cookies for Santa. We currently have 14 stocking hanging our wall, as the entire family (Me, my husband, our three grown daughters, their significant others and my two youngest grandchildren on top of the four here on the couch!) will be here tonight to open the ONE present that everyone (kid age) receives...a new pair of PJ's so that when they wake up on Christmas Morning to open their presents, they are in the new PJ's for pictures. Tonight will be a *very* special though... I made some paper crafted milk carton type boxes and hung them on our tree. I told everyone that there is ONE special gift in ONE box, and we'll be giving them out one by one while we all watch to see who gets the special gift. That special gift is actually for my oldest daughter and her family. She was in a highly abusive marriage for ten years and fled her home with my three granddaughters and went through a bitter divorce, custody battle, etc. She's suffered severe PTSD from all the abuse she received. She is still in counseling and therapy for it and is still very intimidated and scared of her ex. But she found a friend, who has turned into more and he loves my girls...and brings along a wonderful boy to the mix...something we've not had in our family, because we were blessed with all girls, so a boy is a new experience. So, tonight, after a couple years together and his ability to help my daughter and the girls heal and love unconditionally, understanding all the things they've gone through, and is selfless in his love for my girls...... he's proposing to my daughter. She will definitely say yes. This is the gift for my girl and her girls, who have been through so much pain in so very many ways. This will be a Christmas Eve to remember as they become a family. Merry Christmas my fellow creators, and those who just like to watch or who are learning, and Merry Christmas to Katie, the little Carson family and to the entire White Family. We all know what family means this time of year, and to have the joy and love that this house will be feeling tonight fills me with joy and tears of blessing.

You could just source the ingredients from different suppliers. Some of the stuff like washing soda and cream of tarter you can get from the grocery store. If you are a soaper you probably already have some fragrance oils and colorants!
Or you could mix equal parts liquid soap with equal parts of cornstarch and mix until u get something doughy and moldable like, u can add more of the soap if its dry or more of the starch if its wet and sticky
I work for target and they sell a brand called “More Than Magic” and they sell bubble bars under that brand. You can sell them, you just have to call them something else, same with bath bombs. Lush has a patent on them too but you still see those everywhere. It’s their formula you can’t copy.

They must not care enough to go after people because I’ve seen “bubble bath bars” at Target, Walgreens, & all over Etsy. There’s gotta be some fine print there where they can’t touch you for selling them maybe by the name or certain formula.
Patent law is fascinating, if you’re into that kind of thing. Using a different anti-caking agent can slide you out of trouble. Particularly if you haven’t engineered a new ingredient. 🤷♀️🤷♀️ Equate was built on this. I mean, we all know that washing soda fizzes. That said, If I had an Etsy shop, I wouldn’t invest in the molds and what-not if i can’t answer a cease and desist letter. To the person above though, nope. They’d go after little ones first. They know you can’t stand against them.
There are so many small businesses selling bubble bars! I could name 5 or 6 off the top of my head. Personally, I don’t think Lush care enough to do that. If there was another company on the same scale as them doing it, then maybe but small, often home run businesses aren’t worth their time

The patent issue is probably why they swapped out the ingredients and lessened the colorant in the bars. Patents are, as far as I am aware, ingredient/process specific and if you can find a way to do the same thing using different materials or processes then you are generally safe from legal action. But I'm not a lawyer let alone a patent attorney.
Mama Jacqueline actually a lot isn’t. Some use mica and some use bioglitter but a lot of people making it home made for a hobby and these kits use regular glitter.
I work a lot with plant patents but I’m sure it’s the same situation that patents are not renewable. It’s typically why when a medicine is released they only have the name brand for about 20ish years and then generics can be made when the patent expires
becboobear yeah we have a non-scientist, non-college educated person here explaining complex things to the world. She can barely pronounce chemical names correctly sometimes. The fact that you responded to a comment that offered practical information regarding patents and information I have learned while working with them to ridicule the way Katie speaks is just rude and completely uncalled for. As it stands I am a non-scientist myself and while I do have a college education, that does not mean that I myself have issues with the scientific names of things seeing as they are all in LATIN. So unless you have the background and/or a genius phonetic mind, you’re going to get things wrong from time to time. BUT AT LEAST SHE TRIES! And in the times where she has realized she has mispronounced things, she has been candid about that in videos that follow. The fact that “still watch” and “still hope” says more about you than it does Katie. In all likelihood, she will never pronounce everything correctly. If it is that bothersome to you then maybe it’s time for you to stop watching her videos. Because I am sure you reply to comments on every video she posts passing judgement on her because of the way she speaks and says things. You can do better. And if you can’t, then that is a shame.
I love the kits from Wholesale Supplies Plus! After watching your videos my son was interested in soap making so we did a few kits for teacher gifts for Christmas! Cost is definitely a hard pill to swallow but we tried to choose the kits that were reactively cheap and make more than 4. He had a blast and his teacher’s loved them!
The recipe you showed a few years ago that I bought on Etsy has been my go to bubble bar recipe. If you’re looking to make your own, I recommend the one in the video Katie did before!

Best thing if you want to make their kits: get their free recipes (make with your own ingredients) or buy a kit when they are half off (or 25-30% off).
And when they say free shipping after you spend a certain amount but they charge a handing fee on everything too? It's getting pretty pricey to shop with them!
They did raise their prices drastically this past year. Last year, the more expensive fragrance oils were $27-$28. Now they're $40! Also, note how if you add the item to your cart and it happens to go on sale, they raise the original price by a couple dollars before adding the so called discount, essentially making it less. I've seen this so many times now!

I don’t make soap, just nerd out on how to make all these cool things, but even if people want to go ahead and sell Bubble Bars, it’s good to know what’s “protected” and what’s just worth covering your butt and not risking legal action over. Lush used to use popsicle sticks but they were paddle shaped, with the larger end embedded in the product so they didn't just pop out like the dupe kit ones. I wonder if the lollipop stick works just as effectively Tbh I kind of liked the popsicle stick aesthetic. Also super jealous, I'd love to work in the Lush factory!
Miss A has bubble bars that are amazing for only a dollar. I would love to see a comparison of one of the Miss A vs Lush or homemade. I use half of one bar from Miss A and get a great smelling very bubbly bath!

It’s 4 pm Christmas Eve here in Australia and I have no idea where the day has gone, my sister is on her way over so she will be here to wake up with the family Christmas morning for the first time in probably 5 years or so and I’m excited. The lush bubble bath wand was what I used as a child, and it worked very good for me. One thing I didn’t like about it was that when it got smaller, it plopped into my bathtub, and I was left with nothing but a pink stick

I work for target and they sell a brand called “More Than Magic” and they sell bubble bars under that brand. You can sell them, you just have to call them something else, same with bath bombs. Lush has a patent on them too but you still see those everywhere. It’s their formula you can’t copy.

They must not care enough to go after people because I’ve seen “bubble bath bars” at Target, Walgreens, & all over Etsy. There’s gotta be some fine print there where they can’t touch you for selling them maybe by the name or certain formula.
Nobody has come after me but pretty sure they would go after Walmart first lol.
Patent law is fascinating, if you’re into that kind of thing. Using a different anti-caking agent can slide you out of trouble. Particularly if you haven’t engineered a new ingredient. 🤷♀️🤷♀️ Equate was built on this. I mean, we all know that washing soda fizzes. That said, If I had an Etsy shop, I wouldn’t invest in the molds and what-not if i can’t answer a cease and desist letter.
To the person above though, nope. They’d go after little ones first. They know you can’t stand against them.
There are so many small businesses selling bubble bars! I could name 5 or 6 off the top of my head. Personally, I don’t think Lush care enough to do that. If there was another company on the same scale as them doing it, then maybe but small, often home run businesses aren’t worth their time

It is possible that whomever makes the bubble bars that you’ve seen is paying Lush a royalty for the right to use their patented invention.
Us toooooooo!!! For years I used to get trouble because my mom thought my music was too loud and it was making her pictures crooked. I moved out and the pictures still did it. We finally realized it was because of all the planes flying overhead. They have been doubled sided tapped down for years!.

The patent issue is probably why they swapped out the ingredients and lessened the colorant in the bars. Patents are, as far as I am aware, ingredient/process specific and if you can find a way to do the same thing using different materials or processes then you are generally safe from legal action. But I'm not a lawyer let alone a patent attorney.

Plastic cups aren't great, but you can atleast put them in the recycling bin. While plastic glitter will go straight down the drain

ME en ik glitter is a microplastic and has been causing a lot of havoc.
Hopefully the other plastics are recyclable.
@@pogonavit The glitter used for bath bombs is not made of micro plastic. Its made of a substance that disintegrates in water so its safe.
Mama Jacqueline actually a lot isn’t. Some use mica and some use bioglitter but a lot of people making it home made for a hobby and these kits use regular glitter.

I work a lot with plant patents but I’m sure it’s the same situation that patents are not renewable. It’s typically why when a medicine is released they only have the name brand for about 20ish years and then generics can be made when the patent expires
becboobear yeah we have a non-scientist, non-college educated person here explaining complex things to the world. She can barely pronounce chemical names correctly sometimes. And cannot add the volume of ingredients before putting them in a cup to make sure it won't overflow.
Yet, I still watch, with hope...

AB Garcia I went back and forth about replying to this comment but in the end I decided I needed to. Not to agree with you, because I do not agree with you at all.
The fact that you responded to a comment that offered practical information regarding patents and information I have learned while working with them to ridicule the way Katie speaks is just rude and completely uncalled for.
As it stands I am a non-scientist myself and while I do have a college education, that does not mean that I myself have issues with the scientific names of things seeing as they are all in LATIN. So unless you have the background and/or a genius phonetic mind, you’re going to get things wrong from time to time. BUT AT LEAST SHE TRIES! And in the times where she has realized she has mispronounced things, she has been candid about that in videos that follow.
The fact that “still watch” and “still hope” says more about you than it does Katie. In all likelihood, she will never pronounce everything correctly. If it is that bothersome to you then maybe it’s time for you to stop watching her videos. Because I am sure you reply to comments on every video she posts passing judgement on her because of the way she speaks and says things.
You can do better. And if you can’t, then that is a shame.

I love the kits from Wholesale Supplies Plus! After watching your videos my son was interested in soap making so we did a few kits for teacher gifts for Christmas! Cost is definitely a hard pill to swallow but we tried to choose the kits that were reactively cheap and make more than 4. He had a blast and his teacher’s loved them!

The recipe you showed a few years ago that I bought on Etsy has been my go to bubble bar recipe. If you’re looking to make your own, I recommend the one in the video Katie did before!
For that much usd it should include scales and a lot of extra product to make more than 6.
FYI patents are not renewable. You can reapply if you have made a modification. Also the clock starts ticking when the patent is filed not issued.

Best thing if you want to make their kits: get their free recipes (make with your own ingredients) or buy a kit when they are half off (or 25-30% off).
And when they say free shipping after you spend a certain amount but they charge a handing fee on everything too? It's getting pretty pricey to shop with them!
They did raise their prices drastically this past year. Last year, the more expensive fragrance oils were $27-$28. Now they're $40! Also, note how if you add the item to your cart and it happens to go on sale, they raise the original price by a couple dollars before adding the so called discount, essentially making it less. I've seen this so many times now!

Also super helpful info to pass along about selling Bubble Bars. I don’t make soap, just nerd out on how to make all these cool things, but even if people want to go ahead and sell Bubble Bars, it’s good to know what’s “protected” and what’s just worth covering your butt and not risking legal action over. As a person who is allergic to cocamidopropyl betaine...I am so sad. I rarely shop at companies with a lack of ingredient and chemical listing (looking at you lush) , and its good to know not to order this kit! BUT I LIVE VICARIOUSLY THROUGH YOUR CHANNEL LEMME TELL YOU

I checked lush website, they do have however listed ingredients what's in there and mention in bold what's natural chemical and what's not.

@@taegra I show a mild coconut allergy but it's actually 2 impurity strains in CAPB that causes an allergy reaction but 99% brands dont label allergen purified or not so its safer to just stay away alltogether

There are a lot of sellers selling bubble bars. Confectionary Soap Co and A Pharaoh’s Kiss, for example, sell fantastic bubble bars!
No lush use lollipop sticks as well. I know this because my dad makes them for lush and I help him when it is really busy. Love your vids. Xxx ❤️
The kit used popsicle sticks there is a difference
Lush used to use popsicle sticks but they were paddle shaped, with the larger end embedded in the product so they didn't just pop out like the dupe kit ones. I wonder if the lollipop stick works just as effectively

Miss A has bubble bars that are amazing for only a dollar. I would love to see a comparison of one of the Miss A vs Lush or homemade. I use half of one bar from Miss A and get a great smelling very bubbly bath!

I'm so mad that I basically missed Christmas in 2019. I was going through my first breakup ever and recovering from my first car accident ever. It was not a good time and I really didn't feel like celebrating. I went through it like I didn't really exist, and I'm so mad at myself for that.

It’s 4 pm Christmas Eve here in Australia and I have no idea where the day has gone, my sister is on her way over so she will be here to wake up with the family Christmas morning for the first time in probably 5 years or so and I’m excited. Being 19 makes does not make me love Christmas any less than I did when I was a kid.
Christmas died in my family when I was about 16. So it kinda died for me and just turned into a chore

Wal Mart definitely sells bubble bars as well as Target..... But anyway this is ridiculously expensive and this company is getting a bit greedy..... The amount of money they make is ridiculous because the items they sell are cheap. And they have the nerve to continue raising their prices... I don't buy from them anymore...

The lush bubble bath wand was what I used as a child, and it worked very good for me. One thing I didn’t like about it was that when it got smaller, it plopped into my bathtub, and I was left with nothing but a pink stick
