    Chandrashekhar Sir, a fabulous session which not only gives us knowledge on conveyance and deemed conveyance, redevelopment and mainly self redevelopment. Many societies feel that instant tea is the best model not realizing that builders can cheat in small as well as in big projects. Worst is not getting your redeveloped flat back in years/ decades ahead. staying on rent without any rent from builder. Self redevelopment is a much better option which should be understood and implemented by many societies. Sir, I request you to please share a video on the funding process of self redevelopment projects, how can a society avail the funds from a NBFC or Financial Institutions. Thank you very much Chandrashekhar Prabhu Sir.

      Thanks for the kind words. There are a few videos uploaded on this channel on the funding of self redevelopment. Some discussing how to do it without help of banks. We are still talking to NBFCs and HFCs. They have taken feasibility reports for studying. They intend to start with pilot projects first and then extend the facility to all. Until then we may not be able to say much. Once we see many successful case studies, we shall talk about the role of NBFCs in their successful handling of the self redevelopment financing.

    Hi sir thankyou for sharing such videos it's very helpful for the younger generation who do not know about redevelopment
    I am a 30yr old who do not the official term , chairman of a small society in goregaon east we want to get conveyance or conveyance deed so we approach the landlord and had a meeting so he agreed but is demanding for maintenance money which he had spend around 4 lac for conveyance we are a 15 member society 4900 sqft and building is 30 yr old
    So what should we do ? We came to know that deem conveyance take time there is no time frame and if we go for self redevelopment with deem conveyance then the landlord can stay the project ? Sir plz spread some light on this and we the society is willing to go for self redevelopment because of major repairs required and will also help others society of area who are struggling sir need your guidance

      Thanks for your comments. It’s high time the younger generation takes keen interest in the managing of the affairs of the society. The deemed conveyance laws were passed because the erstwhile landlords refuse to convey the lands and demand money, which is totally wrong. You have been wrong information that deemed conveyance takes long time. I have known societies where the entire process of deemed conveyance was completed within four months. In others it has taken six months. In worst case scenarios it may have taken a bit longer. In order to expedite the processes the government has very clearly laid down the norms which require the concerned officials to complete all the formalities within six months. I have guided more than 500 societies so far and our experience has been very encouraging. I am happy that you are thinking of self redevelopment as the preferred option. I can guide and advise your society. My services are totally honorary and I do not charge any fee for the advice given. Wishing you all the best in your endeavours. Hope many more young people come forward and lead their societies to take the correct decisions.

      Once they know that no one is making ill gotten wealth by looting other people and also that self redevelopment is for sharing benefits with all society members they will do your work.

    Good evening sir,
    It has been more than 4 to 5 years we are waiting for the Deemed conveyance process to get completed..we have appointed prabhu associates (vasai) for the conveyance and have handsome amount to them as their fees.
    I individually, has lost hope in prabhu associates... please guide us with what should we do in near future.

      I do not know the company you have appointed for conveyance. No middle man is required for deemed conveyance and no amount has to be paid to anyone for the same. I cannot understand why you have paid the amount. If you have lost hope, remove them and do the conveyance on your own.

    Hello Sir, I wanted to ask, who is the responsible authority in-charge of approving plans + giving permissions etc for societies that have a deemed conveyance in Suburban Mumbai? Is it MCGM or MCGM-MHADA combined? Our obtained IOD is partial that doesn't house all the tenants and the developer is using the corrupt K/West Ward to demolish our building by categorizing it as C1 and repeated submissions of our C2B reports since May 2022 have gone missing from the ward office. They are not even willing to give it in writing via RTI so that we can submit to court in out ongoing Civil Suit litigation.
    We are victims of the developer-MCGM nexus and we see no solution or end to this problem while our Civil Suit is ongoing, developer has also filed a performance review petition against the society, trying to extort us wherever possible. He has also usurped 35% Incentive FSI offered to cesessed builds existing prior to 1969 (probably under 33-7-A/B) and tired to add it to his free sale component. We fear our OC will never come if we let the developer proceed with his current plans since he will try to load this illegally. Even security deposit is on 5L as compared to 25% of project cost as should be u/s 79A of CHS Act. Hence in order to not get caught red handed, he has got only a partial IOD and not full IOD where even 1% extra has not been allotted to the residents in the elevation plan.
    I have emailed you a synopsis last week. Would be great if I can just have a meeting and discuss my options with you. Since a highly one sided DA has already been signed, I don't think we have any remedies apart from going to HC, but need some guidance and list of discrepancies that we can flag in our affidavit or to our advocate.
    Our society is dysfunctional and almost bankrupt sadly.
    We have lost trust in the developer and even if these issues of security deposit, 33-7-A, FSI claimed, plans reworked etc are resolved via HC in the next 2 years, we believe the developer will do a very shoddy job since most of his excess profit will be cut down. Hence we want to remove the developer, annul the DA if possible, repair the building for now, and opt for self-redevelopment but we are so paranoid of finding PCMs and advocates who can be trusted after what we are going through. Even our existing society lawyer never informed us of our rights because his dues were being compensated by the developer even after I placed my verbal objection, since this was a major conflict of interest.

      If the land belongs to mhada then mhada approves the scheme. Societies on any other lands get approvals from BMC. I have already replied to your emails so I do not want to repeat the contents. You are well within your rights to annul the agreement with the builders if you are convinced that you are being cheated or if enough information about other schemes were not given to you before signing the agreement and hence there has been a deliberate suppression of information with a view to benefit the builder. However it is up to your members to initiate such action. I can only guide you if you opt for self redevelopment.
