    Get a lawyer and make them fix it!!! I totally agree with you, i have a small excavation company but my full-time job im a Investigator for Marshal’s Office over Environmental Crimes and you are 100% correct the City is violating the law!!!

      Part of the problem, I have to spend money on lawyers to get them to do their job. They get lawyers paid for by us and nitpick and delay, delay,delay.

      I wouldn’t want to open a can of worms where they could twist the law and make the landowner responsible for the clean-up, but….
      What would the State do if you reported it to them?
      What would the Feds do?

      Fyi the lawyers are part of their law system. They technically work for the government and have to follow the laws created for us.

    Stanley you are 100% right the city and state government should be held accountable the only way for you to stop it is to go over the city’s head and talk to a representative and maybe get something done or take them to court I wish you luck I am a farmer and I understand your pain we farmers have to deal with changes all the time and we get sick of it to but we just try to survive

      I'm one of those midwestern licensed attorneys that sometimes used to get involved in such issues. Problem is once the pot gets stirred up then it's war. Each municipality can set its' own rules which much also cooperate with State and Federal Rules [ie. DNR Wetlands Act] Whether a municipality may have liability for civil damages is a tricky subject to establish by law. Water runoff issues are always fun and expensive litigation where really only ;the lawyers win because they get paid.

    Yoou NEED to have that water tested by a licensed water/chemical company, one that is licensed by the city/county/state. Use their own rules/laws against them. Just a shot in the dark as they hold the cards and can & will enforce these codes by force if needed. Be Safe Brother, stand tall.

      Lawyers can be so expensive so not a route to take lightly but you've got serious things going on. I would least contact a good attorney specializing in land issues and get their opinion if they think it's worthwhile to pursue. Same attorney may be able to help you or refer you to another attorney as them coming on your property with guns and the quantity of people that showed up so hopefully you got some cameras showing them coming to your house. If you do have pictures or video of that happening I would post that and let it go viral and see if that creates any action. Good success.

    We've had something similar happen. Trying to remove diseased pines from our creek. Finally got an attorney and won along with money for damages. Bought a new cat 249 with the money and have no more diseased pines.

    Quick set concrete in the end of the pipes?
    I had a telephone trunk running thru my front yard. During the summer it was hit by lightning, phone company came out and fixed it, backfilled reseeded my yard all was great. Come December they decided to replace the line and put a splice on a pole in my front yard, there wasn’t any snow and the ground was frozen, they ran a new line and filled in the trench leaving a 15’ diameter pit with a huge circus tent for the splicing crew and went on Christmas vacation. January after it snowed they finished up the job filled it with snow and a bit of dirt and hauled away the extra. After calling repeatedly since spring to have them come out and finish the job I finally told them you can fix it if you want otherwise I’m tipping your pole with the splice into the hole and getting it filled myself. Guy showed up with the littlest dump truck I’ve ever seen with a bit of topsoil. He backed up to the hole looked into the 4’ deep 12’ diameter pit and laughed as he dumped the topsoil into the bottom of the hole. It instantly disappeared into the water. 5 full sized trucks later they graded off the top with subsoil and called it done. Took another year of complaining to get some grass seed

      I wouldn't use concrete, it could be translated by them as "malicious destruction of government property" a better option would be rubber plugs, and when they come out he wouldn't be on the hook to repair/replace the pipes that he sealed off. But it would achieve the same level of seal just be removable.

    The scales of justice are not equal. For a person to get justice, he needs to get everyone in the criminal justice system to cooperate with him. However, if just one person, important enough to the process, decides not to cooperate, that could end all of the hopes that a person has to get justice, And there are no possible criminal consequences to a person in authority for refusing to cooperate with a person trying to get justice. Everything is up to that person in authority's discretion. This is a system of justice only for people of wealth and/or status. For the rest of us, it's an injustice system rigged against us.

    If you caught someone dumping waste i.e., solid or liquid...on your property you could sue them for littering etc... This would apply as well to the city where it is there responsibility. Sue them!

    I can’t cut dangerous trees on “my property “ without a permit from the town I pay taxes to within five feet of the road but yet they don’t mow five feet off the road on my property ……I’m fed up too Stan god bless 🙏🙏🙏

    I feel ya 100% Stan. I catch flack from my local city for what shouldn’t be an issue . But when I challenge them on the Same matter at a immediate neighbor’s property or city owned parcel- nothing is done, but they’ll push me left/right…. Even up to the point of making statements of next step is court hearings…..

    I have property way back in the woods, and I have to get permission just to dig a pond. But a neighbor who just happens to be the retired county district attorney can dig ponds and put in roads all through his hundreds of acres, no questions asked. He has two new roads through a pine plantation one called Harris highway and the other Bidens Biway. So I put up signs on my trails two in drainage areas that say Draining The Swamp and two that say Trumps Trail.

    Unfortunately, once the city sticks their nose into your business and they are truly to blame for their mistakes, they first never admit guilt, they never take responsibility , and one always has to sue them to get them into compliance. Why do we pay them for this action? The process is the punishment, and everyone on the city payroll or others they use get extra money, ie. lawyers, surveys, experts. Its a racket of control, just terrible.

    I got a $1000 fine when one of my bags I had on my truck from a fall cleanup broke open. Once I noticed it, I stopped and cleaned it up, but the police still gave me a fine. While they were giving me the fine, a group of " illegals " stopped their tuck and dumped 5 bags of garbage. I looked at the police like WTF, and they just shruged their soulders. It's not just the top doge that have a different set of rules. it's just the honest, hard-working AMERICANS

    As an ex volunteer fireman for 15years, we've seen too many fatalities from falling dead trees, primarily from Ash. I could go into more into detail (wish I could to back this up, but the internet frowns apon that) Long story short , we got with the road commission and state DOT to address it
    .....which has helped tremendously

    Take samples of the water, soil, and have them tested/analyzed to determine what is there and maybe contact the DNR to determine if the city is in violation regarding the drain type, design, construction.

    YES, and completely agree with you! The laws are supposed to be for "ALL" not just for thee but not for them! I'd sorry but I will be documenting and getting a special lawyer and forcing them to follow the law! Agree, civil unrest is right around the corner. I don't have the room to write all that been through. Stay strong and all can say is keep track and photos to back all up if/when it goes to court.

    Fellow Minnesotan here with a neighbor who destroys the wetlands on our property and don't get me started on when the city came out to look. . . they sent out these true city folks who had on heeled office shoes and we were all wearing muck boots because it's a freaking wetland!!! through a dense forest.
    However, when the cops or rather SWAT basically came with assault rifles just like they did to your house and my father who did three tours noticed them getting out of the vehicles before they even took positions and he walked out of the house to ask why they were there. . . . . .they literally had the wrong address. We live a country mile apart. People use google maps and have never had a problem finding my house vs the neighbors, but the fricken cops don't know one address from the next! My dad walks out there and they tell him why they are there and he tells them they want the F-head next door who steals from us, shoots wildlife for fun, and pushes his unwanted dirt into the wetlands or rather onto our property as he caused a mudslide on his by removing every tree on a hill. . .that had been forested for 100+ years. SWAT couldn't find the right house in MN. Glad they at least found yours. 1 and 1 in my book.
    Where I live we tried the "good" way of doing things where we get permits and even after they were approved the inspectors would come out and then decide to "unapprove" what they had approved and then our neighbors just came and spoke to us and they said "We don't say anything and no one ever asks as long as it looks professionally done". Everyone else's barn, second garage, shed, etc was never permitted and the city never has asked any questions in 30+ years so when people go to sell or anything everyone is clear "that building has been there forever, I don't know why you can't find it in your records" and they have grandfathered it in every time. If you ask they never let you do it the right way, but if you cheat then it's the only way you ever win at building outbuildings in the MN city where I live. Make that make sense.

      It's not just your City in MN that doesn't want you building an out building. I fought with my Twp. Mainly the supervisor to get a permit I was lawfully entitled to. Instead they sat on my application and changed the ordinance. I ended up filing to run for his position. That got me a misdemeanor zoning charge less than a week later. My story has a happy ending. I beat him in the election, charges were dropped, and I got my out building. Ohh...and he died shortly after, apparently it was too much for him to lose his grip on power.

    Parents have a seasonal spring through their property..... It's been about 20 years since the spring has ran through the property because a dairy upstream is capturing it and using it. The area is fenced off, ditched, maintained with two gravel pathways on either side...... and no water ever goes through it.

    A legal precedent has been set about storm water impacting landowners. On Tuesday, The Supreme Court ruled in favor of a landowner whose property saw increased flooding because of barriers on the interstate somewhere near Houston. If the state cannot divert flood waters onto someones personal property, surely a municipality cannot as well. The Supreme Court paved the way for landowners to seek compensation under the Takings Clause of the Fifth Amendment, "nor shall private property be taken for public use, without compensation".

      Back in the day, polluters of the Chicago river got their pipes, concreted closed, and the sewage backed up into their properties causing untold damage. Don’t get caught plugging there drainage pipes or you will be the bad guy .they never caught the river fox.

    Does the city have an NPDES Permit? Did the city 'redirect' the natural path of drainage? do they have a Storm Water Management Plan? Do they follow a BAT (Best Available Technology) plan for treatment of Street Waste?

    I think you nailed it Stan it all starts at the local level. Even more local than your community. I had the Good Fortune of working for a demolition contractor for years. There was a pretty lengthy time that we did demolition for Dow chemical Freeport Texas area. I once asked a supervisor that was over me why they had so many seemly stupid safety rules and regulations. He was very quick to agree that some of them were very egregious, adding that their rules and regulations all stemmed from at one time or the other some stupid person doing something very stupid resulting in a work comp case.     Stan, I worked a large site job for a new H.O.A and the road was going to be private owned by the H.O.A and we had to jump through hoops to catch the storm sewage, then road became owned by the city and let’s just say that all the storm sewage plans were cut by 3/4 of detail. There are always two different laws.

    I hear ur pain/ disgust! They may have drainage easement, I clean drains and water out flows for living...I do believe u and the country can resolve issue...have someone come out, walk it...good luck!! There has always been two sets of rules!! Ty

    Yes the city i used to live in even harassed me over a wild flower bed. They measured the tops of the flowers and one was 13" tall . So the codes inforforcement officer told me that I could not have a annual flower in my yard that was taller than 12"s . So I pulled the flower up and threw it in the yard. Then I looked at him and told him it's not over 12 inches anymore. Then he said I still have to send you a violation notice to get it taken care of.
    Of course it's ok for the city to have annual flowers that are over 12 inches tall.

    Document any and all damages over time and keep records of all correspondence with the city. Get all your ducks in a row and speak with a lawyer. Politicians tend to drag their feet until lawsuits get involved.

      The republicans have been destroying all of the good things that our taxes do for society as a whole, thereby convincing a lot of pf our fellow Americans that government doesn't work. There was even short shutdown today, because so many house republicans are still trying to convince you that they should rule, not represent. I mean, keeping the government from shutting down is the very basics of the job *We* hire/vote for them to do.

    I had build a wood shed for my fire wood, Roughly 10x24x 8'tall. it was to close to the property line but also there are old ready to fall down sheds and garages right on the property line or right on the alley that were "grandfathered" in... But yes. 1 rule for them, 1 rule for us. I hate the government. I had to remove my shed.

    232nd! A big part of the ongoing growing problems/issues is the number of growing "busy bodies of complainers" submitting reports that "something really bad is happening", needing to be acted upon! Using your armed guards showing up at your doorstep as example. Whoever submitted the report must have NOT submitted a simple report of request of investigation! Instead, that report MUST have included lots of crazy words of details that was very false in reporting. People get very "butt hurt" when they investigate and determine that reported information is false. This leads to the investigators attempting find crazy ways make truth to the false information! You (Stanley) have seen & experience this when working. Situation example of a neighbor keep calling the local code enforcement officers that your landscaping action with your customer is NOT following building codes! There needs to be "accountability actions" for people the submit multiple attempts of false information! Yea! 🍀🙀🌟 😇

    I had a similar issue with a neighbor illegally dumping waste water into a public right away, which flooded my yard and created a mosquito breeding ground.
    The neighbor was friends with the city liaison, so I took photos and video, went to a public meeting and used that platform to address it, so the problem could no longer remain hidden.
    It worked, kinda like the video you took to address your problem. I will advise to know your ordinances, rules, codes, and administrative codes, as well as how well they all jive together, if they waste too much of your time you may be obligated to bill them.

    I have two customers that the city drains storm sewer into their retention ponds. I brought it up to a city official and was told to keep my mouth shut and not tell my customers.

    Its easy for me to say from whwre I am. But I dealt with a similar situation here. Im a GC. I pushed the issue with the local powers that be to the point I actually filed a lawsuit. They’re currently trying to figure out how to get me to dismiss it. But that’s not happening. I will say on my other jobs I deal with inspectors routinely what’s going on has gotten around and the way they are toward my company is different. Different good. In the past I’ve always kept a good working relationship with inspectors but I don’t allow them to be unprofessional or be overbearing and out of the scope of their job and jurisdiction.
