Badi hi aasan language or easiest way main PMLA ko explain kiya .or public jo samjhti thi ki jise bhi ED ne arrest kiya hai wo thik kiya per actually ab pata laga ki ye to law ki dhajiya udate hue legally offence PMLA ker raha hai. Aisa lag raha hai.

This was a much needed video and I am so glad it is in Hindi. My family does not speak English. So when a program involving legal jargons is made in English, it is not possible for them to understand and very difficult for me to explain it to them. Pls continue making such videos in Hindi as well so as to cover a larger section of population.

You should file a case to challenge the schedule of PMLA , all whereabouts should annex with ECIR as well as Ed must mention all statements of that men, whom gave statements before ED officer, in ECIR. Moreover, ED should record a uncut video during investigation with witnesses or accused.

There are many loopholes in the criminal justice system. There are even several portions in crpc where prosecution can evade and deprive the accused, however the accused may be innocent or very ignorant of very petty offences done or tried without intention.
Magistrate takes cognizance as the police have implicated or inducted him
506 offence is non cognigable offence but in up it has been made cognizant by notification 40 years back.
As per clause I offence is punishable for 2 years and non cognizable while as per clause ii if threat is for life threat or property burning is punishable for up to 7 years becomes 506 cognizable.
What does the police do in some cases where they are inclined with so-called victims who are criminal or influential, can lodge FIR means as cognizable offence.
I have come into the case. A executive authorised to ask some professional violation from any organisation member or person talks on phone clears his name and position first and greets the other side a member/ person starts provoking and irritates instead of giving information. Out of the irritation executive up chief said you are avoiding mischievously I will beat you there without any intention of mens rea.
The member and miscreant group lodged FIR u/s 504, 506 without meeting correct definition of 506 part 2. The magistrate takes cognizance as per allegation of police. High courts usually do not scrap or stay the Fir lodged and cognizance taken as they say that prove yourself not guilty. How a citizen how correct he is will escape from false or petty offences. In trial there needs 8 years. Accusations will produce each and every in 313 but after 5 years minimum.
This type of cases may be lodged daily in crore numbers because in streat, in industry, in इंफ्रास्ट्रक्चर, एंड अनर्गनाइज सेक्टर मोर 3 करोड़ labour can file cases because like some talks are done daily

In USA even to detain a person on suspicion of a crime, police have to articulate the reason for the suspicion. Even then they may only detain I believe for 20 minutes while they are investigating. But i may be wrong.

This PMLA act should be changed.when certain sec were declared un constitutional then same clause was retained through a bill passed in loksabha. Why this clause can not be re declared as un constitutional again in view of rights of individual as guaranteed by constitution.
Sir when the rule of law then be established. Why not the interpretation of law on the basis of intent of the legislator? As you discussed here that PMLA on the basis of international convention to control drug and terrorist funding. And PMLA now being applied on basic criminal and financial transactions. Judicial review of the law should be done. Please do something sir.

It means the court assisting government in power to take revenge from a person who is standing in opposition.
This is shameful in part of judiciary.

Okay, so it is clear that the PMLA is an absurdly draconian law; but, my question is: Weren't these provisions (wasn't this law) even there during the previous UPA govts? So why not say anything then? Why all this brouhaha only now?
