His fingerprints are in the car, so instead of going and interviewing him as a potential witness, you just straight up, arrest him?!?! What was on the arrest warrant?
Highly unlikely. He would be lucky to get a couple grand for the weekend in jail. None of the circumstances, such as police brutality, that would lead to such an award are present. The city, police department and investigator would hide behind qualified immunity, which is not negated by his laziness/incompetence, as his fingerprints were found in the victim's vehicle. Making an award less likely is the fact that once the investigator finally watched the security footage, after being pressed by the mother, he did release the man. Note: I am not saying that he doesn't deserve something for what he went through just that the deck would be heavily stacked against him if he tried to get financial compensation.
@@Steph-qg4iw Again not that easy and, again, qualified immunity would likely prevail if he attempted to pursue such a claim. How did they publicly defame him? Did they so maliciously and can they prove it? Most importantly, did they fail to correct their mistake in a timely manner? The lead investigator ordered the charges dropped and his release the same day he saw the footage. Again, I am not saying he doesn't deserve something just that a defamation case would likely quickly be tossed out of court.
A lot of people like to put all the blame on the cops but I’d also like to ask what judge signed this warrant. The only person at that stage that can hold the cops and DA accountable for flimsy evidence is the judge who signs the warrant.
Excellent point. It does seem that many judges do have a 'rubber stamp' for this. And we know that to be true as many cops have said over the years that they will take warrants to particular judges BECAUSE that judge will just 'rubber stamp' the warrant.
They obviously didn't bother to do any investigation BEFORE arresting somebody, *especially since this guy had ironclad proof that he WASN'T the criminal.*

Actually it’s very serious because if it wasn’t for his mom having a camera he would be spending the rest of his life in jail for a crime he didn’t commit while the real perpetrator still walked the streets, it’s beyond serious, and it’s extremely alarming when you think about how many people didn’t have a camera to give them an alibi and they are sitting in prison right now
