We really need to replace the DCMA with a new law, it was written at the infancy of the public internet by people who did not really understand what it was. Filing a false DMCA takedown is an act of federal perjury. It is already illegal as fuck. The issue is the total lack of enforcement. RUclips doesn’t want to ask people for proof and are happy to enable these crimes as part of their “hands-off” approach as they mistakenly believe it indemnifies them.

    • @KazeMemaryu
      @KazeMemaryu Год назад +180

Honestly, I disagree. While the DMCA system is certainly lagging behind, the more driving issue is RUclips's implementation of it. They decide that the accused carries burden of proof instead of the accuser, mainly in the interest of big media companies, music labels, and publishers. They don't want their claims to be fought, they want to have their way, right or wrong. And to an extend, it's fair to throw them a bone in regards to illegal reuploads of their stuff. But because RUclips makes that the entire modus operandi for the system in place, it's insanely easy to abuse it with falseflagging.
I could go and slap a DMCA claim on this video right now, claiming to be a rep of the creator. It would go through first and flag the video, no verification required whatsoever. And the worst that could happen to me as a consequence is my account getting banned, and even that doesn't happen consistently.

I saw "Give me $40,000: The Video Game" on sale on Epic Games when I went to claim the current free game. I made a joke to my friend in a Discord call about the price of the game. They then got curious and looked the game up, wondering what it was about. From there, we saw the bare bones Steam page, the fairly suspicious positive reviews, and the more accurate negative ones, one of them being yours.
We saw the dev response on your review, and you mention that you had a video on this game, and we got curious once more, and watched your video on the subject and were surprised to learn the game was even more of a scam than we suspected.
Anyway, at least something good came out of this game, because we started watching the rest of your videos, and look forward to more.

Advice to Game Devs: Just take your licks. You can bounce back from a bad game, maybe listen to criticism to make something better. Being known for false DMCA claims? That's when you're burning your own reputation and you're going to have a very hard time going back from that, not to mention the Streisand Effect.

Easiest thing, they have to put money for that in a safe location, which goes to the accoused. I would say, they have to say the damage that the violention males, and half of thst has to be deposited (maybe full).
Than the accoused can do the same, or leave it in 2 ways: saying is okay, and the other sides get the money back (and the video goes down), or can say please sue, and the money stays looked, but the video goes down. After the court, if the video is allowed to stay up, the money goes to the attacked. If it has to stay down, the attacker gets the money back, plus a small fine for the sttacked.
(If the attacked take the money to counter, than the video stays up, and the attacker gets the money back until the court decides, and of it has to go down, the attacker gets the money the defender put into it, and if the video is allowed to stand, than the attacked gets the money back (+fine for the attacker)

This is too common an occurrence. RUclips should address this issue:
Claimants need to prove they actually own the "infringed" item.
They must prove the copyrighted material was infringed (reviews and satire fall under fair use).
They should be required to pay a fee to cover RUclips's investigation. The payment can be recouped if the material was indeed infringed, through small claims court.
This approach would act as a deterrent in both directions. If I infringe, I risk losing money. At the same time, it adds a cost to making DMCA claims.

So kinds new to watching and I saw that video. Just like every other one, you break down in detail how it operates and give as much info as possible. None of it appears to be false as it literally is just a black screen with random noises and a bunch of stolen(ish) assets. The devs getting this mad they're getting exposed is crazy

when they said that steam cant allow high discount, i literally seen the lowest price other then being free is 49 cents while the original might be 99 cents. now im not sure if that is high in Turkish pricing but that's extremely cheap to purchase.

    "Steam doesn't allow big discounts"
Valve sells their highest rated games for only 1 dollar every few months..
You can even get their ENTIRE library for only 40$ on their extremely common sales

I clicked the video and thought someone made a Powerwash Simulator clone NFT game for a second. But it’s just more from a Dirty Dev. Not the first channel I’ve found from a Dirty Dev, but I still love finding cool new channels from them.

Haha, I just had to find some game to play as B-roll since I can't show the original game (not like it had any gameplay anyway).

I have to say, Jauwn. It's 2025 already here. I'm playing Spyro Reignited at 1:30AM with a bottle of wine after having dinner with the family. This is my first recommended video on RUclips for the year and I love your channel so why the fuck not. I've already watched this video but whatever. I'm a little bit drunk I might say.
I just want you to know that you are doing a great job and I can't wait to see what's next.
Happy new year from Spainnnn :)))

Sounds like the scam developer is a WINNER. He got everything he wanted and had absolutely no repercussions for his scam.

Wait..waitwaitwait. They actually said Streisand Effect in their com with you? B-but, that would mean they would know what that means, which means they...but for that to be true they wouldn't then do...I don't even. H-hh--how? How is...how do they...HOW?!
Edit: Indeed, one "fun" and potentially useful part of lawsuits is that they can backfire spectacularly on the instigator, though how badly depends on the court system involved. I do hope things don't get too out of hand tho. A legal battle is still a battle after all. Good luck Jauwn.

I think they just learned what the Streisand Effect was the other day because Sid said it in his video

That my problem with AI dudes. They're all so insufferable and can't comprehend the concept of "not all of the 590 images the program spits out needs to be posted, just post the best ones". Any place that allows it gets flooded by it.
