Sejak 1966, pemimpin Tanah Melayu mahu mengambil alih Pelan Benua Sabah dan Sarawak. Mereka meluluskan Akta berikut, Akta Pelantar Benua 1966 dan Akta Perlombongan Minyak 1966. Bagaimanapun, ia tidak boleh dikuatkuasakan di Sabah dan Sarawak. 13 Mei 1969 Rusuhan Kaum tercetus di Kuala Lumpur.15 Mei 1969 Darurat diisytiharkan di seluruh negara. Parlimen digantung hampir 2 tahun. Kuasa mutlak dipegang oleh Pengarah Operasi. Banyak Ordinan dan Warta yang dikeluarkan melalui PERINTAH. Antaranya Ordinan Darurat (Essential Powers) No.7 1969 bertarikh 2 Ogos 1969, Semua Wilayah Laut dikurangkan kepada 3 Batu Nautika sahaja. Dengan Ordinan ini, Wilayah Laut Sabah dan Sarawak juga dikurangkan daripada 350 Batu kepada 3 Batu Nautika. Berikutan Ordinan ini, 2 Akta telah diwartakan untuk dikuatkuasakan di Sabah dan Sarawak pada 8 November 1969 iaitu Akta Pelantar Benua 1966 dan Akta Perlombongan Minyak 1966 Bermakna Kerajaan Persekutuan mengambil alih semua Wilayah Laut Sabah dan Sarawak di luar 3 Batu Nautika. Apa-apa sahaja di luar 3 batu nautika adalah milik Kerajaan Persekutuan Tindakan ini diambil dengan kuasa KECEMASAN dan bukan melalui Perjanjian Sabah dan Sarawak. Kuasa Sabah dan Sarawak untuk mengeluarkan Lesen Perlombongan juga telah diambil alih oleh Akta Perlombongan Minyak 1966. Beginilah Minyak dan Gas Sabah dan Sarawak DITIPU oleh kerakusan pemimpin dan elit Malaya

Act 750 violates the specific protection provisions of the Constitution for Sabah and Sarawak. the state has lost all grounds to claim the economic benefits of its territorial waters in any negotiations with the federal government Meaning that PETRONAS is now operating illegally in the Maritime Territory of Sabah and Sarawak
