The Big Picture - Birthright citizenship in U.S.

- With congressional elections a week away, President Donald Trump on Tuesday said he will seek to scrap the right of citizenship for U.S.-born children of non-citizens and illegal immigrants as he tries again to dramatically reshape immigration policies. Reviving his support for a legally questionable theory, Trump told the Axios news website he would issue an executive order on so-called birthright citizenship, an issue that has long rankled some conservative Republicans. Trump’s previous calls to end the practice have resonated with his political base, but moderate Republicans and some legal experts say Trump is running afoul of the U.S. Constitution. Under the Constitution’s 14th Amendment, enacted in the wake of the Civil War to ensure that black Americans previously subject to slavery had full citizenship rights, citizenship is granted to “all persons born or naturalized in the United States.” It has been routinely interpreted over the years to confer citizenship to people born in the United States whose parents are illegal immigrants.

Dear Mr Frank Pereira - thanq for hosting this important topic which has lot of relevance to many in India...
Two (2) illegal aliens do not make a citizen. Birthright citizenship for illegal aliens is a common misconception. The plain meaning of the 14th Amendment means that one must BOTH be born in United States AND be subject to the jurisdiction thereof. Since there are two explicit requirements, they both cannot be met by simply being born on U.S. soil. The history of the drafting of the 14th Amendment makes clear that the language “subject to the jurisdiction thereof” meant a citizen could not owe allegiance to any other foreign power. This excludes illegal immigrants who are in defiance of U.S. jurisdiction and are citizens of a foreign power. Indians (Native Americans) such as myself were not even allowed to become citizens until the late 1920's.
The author of the 14th amendment citizenship clause, Jacob Howard, described the intent and limits of the clause while addressing and introducing it to the 39th Congress for ratification in 1866. In that speech, he stated “This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the government of the United States...”
Prof. Chaulia 👏😃

Legal interpretation ,1857,1898-alien and diplomat children.
Last man on the boat is suspect.
Why necessary?
√Question of healthcare
√Wage stagnation
√US grow up but disenchament in some quarters
√Sexual exploitation
√Democrat can better handle emigration.
Executive order
Republican oppose Obama order so it cannot oppose emigration issues.
American bureaucracy trying to put more hurdles.
This will need ratification of 2/3rd Congress and 3/4th of state.
Way Forward
=>Trump is attempting to please his base by this polarisation tactic which more likely to cause violence. It is in American self interest to reject this policy.
Thank you.🙏💕

Trump must do anything which favours his countrymen, but he must be concerned with the environment because air, water don't have boundaries.
