- Donald Trump defense attorney Todd Blanche was interrupted during his opening statement by objections from the prosecution that were sustained by the judge and resulted in a side bar at the bench. Rachel Maddow talks with MSNBC legal correspondent Lisa Ruben and former Manhattan prosecutor Catherine Christian about whether Blanche showed his inexperience as a defense attorney or whether he deliberately stepped out of line to plant ideas in the jurors' heads.

The truth has just one defense, a lie has many. No innocent person says “I didn’t take those secret documents and it’s fine that I did because I was allowed to and they weren’t secret any more because I declassified them mentally and the police probably planted them there and the movers mistakenly put them in the boxes.” Can’t be all of them.

after the third or fourth objection is sustained, and the attorneys are called to the bench, why not make the offending attorney explain to the jury what law he just violated?

My idea is to increase the cost of trying to influence the jury by making inadmissible claims, since they can't be unheard, even after a successful objection.
Forcing a lawyer to say to the jury "the Judge disallowed my assertion because when making it I knowingly broke a prior commitment about what could and could not be said to you. In short: I'm cheating to help my client." would so damage a lawyer's credibility with the jury that it would not be worth risking.

If this is Blanche's defense tactic to put an idea in the "head" of a juror, it is plainly stupid knowing that there are 2 lawyers in the jury. They can actually "explain" the situation to the other jurors should the issue arise.
Arguments are not allowed or included in opening statements. Advice of council defense has to be announced before trial.

Charge the lawyer $1,000 for each approach to the bench. Then make the lawyer and the predecessor stay at the end of the day until the lawyer pays his fees for the day. He ain't got no money cuz the predecessor is charging the lawyer by the hour to be in the predecessor's presence.

I was a member of a jury where exactly the same thing happened, and we heard something that we were not supposed to. The whole jury was dismissed, and a new jury called.
That is called a mistrial and nothing happened that raised it to that level.
