    I'm a Filipina 4.5 feet tall, third shift stocker suing Walmart for Retaliation without a lawyer. Walmart's lawyers tried everything in their power to dismiss the case. They almost cry in the courtroom last hearing on May 11, 2017 because the judge order to send the case to trial. The trial will be on June 29, 2017 before the special referee. I am up $5000.00 already. I will focus on retaliation after, settlement and ambush confidential agreement.

    your lawyer is sapoda b helping u not u helping them. the employee is damaged needing help but u must be persistent with your lawyer and understand what you mean...be 100% honest.

    Thank you for providing valuable information. I was "laid off" today after emailing my fit-for-duty letter to my employer. I had a back fusion on November 22, 2016. My FMLA expired on January 24, 2017. I requested additional time off through the ADA the week prior to my FMLA expiring. on January 31, 2017, a letter was sent to me informing me of the approval of my request for additional time off. In the same letter, I was also told that they (my employer) was hiring a new person in my position due to me requesting additional time off. This letter was drafted just seven days after my FMLA expired. I hadn't had my 3 month post-op yet. I live in Michigan and I want to make sure I choose an attorney that will represent me because they believe I have a case vs. an attorney that will only represent me if it's a cut and dried case. I have all emails and letters and feel very confident with filing a suit for harassment/discrimination /retaliation. What questions should I ask to make sure I choose the correct attorney for me?

      Hi, Tina. Thanks for sharing your situation. I would start with asking people for a referral to a good, competent employment attorney. Some other things that you should be looking for are someone who you feel comfortable talking too, someone who isn't too overconfident or pompous, and someone who seems to be knowledgeable in the relevant area of law.     manager made derogotry comments about my religon, ethnic background. i complained to management and they never did anything. after i complained to HR and they never did anything. i was fired shortly thereafter. in my email to HR i complained of harassment but didnt use specific situations. will those come back and haunt me?
    HR told me i was fired for performance issues what can i do?

      You should discuss your termination in greater detail with a good local employment attorney. More facts are needed to determine your legal and practical options.

    What if I was sent home for an unknowingly 6 days after a discrimination complaint, so they can look into it, then having to call back on the 6th day because I received no calls, texts or letters. I was told to come in, then I was fired. Fired in retaliation of my discrimination complaint.I strongly believe. Also on the unemployment claim they lied and said I quit. Which was 100% false.

      It's possible that you have a legitimate claim, but more information is needed to determine that. You should contact an experienced employment lawyer to discuss your legal options.

    If you can prove that you were rejected from a position for an illegal reason before employment began, could you still press charges?

      You can make a case for illegal failure to hire. Those cases are more difficult for several reasons - (1) any wage loss is speculative, since there is no way to tell how long you would have been working for; (2) the employer can come up with a variety of reasons of why they chose to hire someone else, and disproving it as often an uphill battle to say the least.

      Hello, sir. I am not familiar with your specific situation, but I believe that a lawyer should listen and then explain to his client why the client is not correct or is not doing the right choice as far as pursuing any legal claim or legal strategy. If they lawyer and a client cannot agree, then they should not continue working together.

      1. I was appointed as Floriculture officer in the department of Floriculture in a state called Jammu and kashmir in India.in year 2006 on contractual bases.
      2. After a period of about 2 years ,I was forced verbally to do tampering in service records of one of employee in my office.
      This verbal pressurization was done by concerned director of the department followed by district officer concerned .
      3. The case of that employee was lying in court for regularization.
      4. I hesitated to do so and cleared the reason before the director,that I request for some written instructions for the matter.as the concerned employee's case is subjudice.how can i touch his service records.what justification should I give in the court,if asked for.and I am on contractual bases,How can I take the unofficial step like tampering.
      5. i requested the concerned director to shift me to other place untill the job is done by any willing official.
      6 .After all this happened. The concerned director terminated me from my service without giving me a single notice.
      7 .From that day my service case is in Hon'ble court.from last eleven years I am waiting for justice.
      8 .i can't understand how to make my lawyer to fight the case effectively. I am Fed up with judicial system in India particularly in our state Jammu and kashmir.
      9 .Many times I decided to withdraw my case but at the same time my soul doesn't allow me to accept injustice.
      10 .In these years my life has been changed into a hell.
      11. i am confused what should I do.plz guide.

    none of this applies to Native American Tribes...WHY?? you cannot sue a tribe or its officers...who made them gods??
