It depends. If the car backing out has it's view blocked by, for example, a van with no windows, people coming down the street should recognize their view is blocked and stop when they see the car easing out. If the car trying to back out has a passenger, that person can get out and serve as the driver's eyes to tell them when it's safe to back out. This situation is more about reading the environment and being courteous than what a specific law states.
