Game companies successfully patenting game mechanics like this will KILL this industry. The whole point of video game development is to build off of each other to make a better game for everyone. What's crazy too is pokemon itself isn't that original(still fun tho). They copied Digimon(yes digimon came first as toys) and a japenese kaiju catching show.
When I saw this happening I immediately thought of when I was sued at 18. Long story short, it was 1 day before my 17th birthday. Brakes on my car went out and my car blew through a stop sign hitting a car coming through the intersection. I was left with sever brain damage and retrograde amnesia. Because the brakes on my car went out I was deemed to not be at fault by the police. However the day before exactly 2 years from the accident (which is the cutoff time for civil lawsuits) the man my car hit sued me for 1.2 million claiming a permanently injuring his leg which made it so he could not work anymore. I fought the case hard for a little over 2 years. It was a nightmare due to me still being seriously screwed up mentally because of the amnesia. I quite literally don’t remember anything from before the accident or after it by about 6 months to a year. I have become paranoid of strangers because of the lawsuit and it’s difficult to drive due to the ingrained trauma from the accident. The lawsuit came to a close because I found out he had faked his injury (faked hospital visits among other things.) He sued me because he just wanted money. Lawsuits are f*cking horrifying.
Digimon, Yokai Watch, Monster Hunter Stories, Atlus since everyone wants to hold to them making creature capture games. If monopoly just means doing better than other billion dollar IPs then they need to break up Nintendo, Steam, Playstation team, Apple, and Disney. Then again after that you’ll have to break up Epic, Microsoft, then move on to studios.

They have cryopods in ark too which are basically pokeballs. Multiplayer ark, when cryopods released, many were calling them pokeballs. Instead of taming with tranqs, u use the cryopods mechanic to tame in Palworld, so why isn’t ark suing palworld? How about that take. Pokémon can’t claim using balls to catch monsters. It’s like street fighter claiming u can’t do uppercuts or have characters in fighting games. U can’t monopolize a genre like that. Well with luck nintendo will take the hint and make an actual pokemon survival game. But the fact is pocketpair has always been a lazy company and did deserve to be sued, even if not for the thing it is being sued for. The system is broken and doesn't respect artistic design as an IP, which is what palworld really should be getting sued for. Not enough effort being put into making a more unique design. But that won't happen so mechanics will have to do. I hate nintendo. I really do. But acting like pocketpair deserves all the money it is getting or like it would be an even remotely more ethical company than nintendo, or even that they were ever going to drive nintendo to manage pokemon better as a legitimate form of competition given pocket couldn't be bothered to put a bit more effort in their designs is all ludicrous and you should genuineky feel as ashamed as nintendo should.
When you think about it, the fact that Palworld being on Steam, XBOX, and soon to be released on the PS5, Nintendo perhaps can't cope with the idea that an IP so similar to Pokemon being on other platforms, thereby potentially rivaling, if not surpassing, their exclusive Pokemon IP in popularity (and sales). Thus, Nintendo wants to nip this in the bud in whatever way they can.
I think it's more insidious on Nintendo's part. My totally off the brain theory is that the saw it made loads of money and pocket pair became more valuable so Nintendo is suing now to get a bigger paycheck if they win the lawsuit. If they did this when palworld was in still in alpha and unreleased they wouldn't get as much.

The whole concept of capture unreal creatures with a spheric object is the only thing that maybe could bring problem but the whole game has a lot more mechanics and goals. Like, Pokemons don't die, don't carry guns, has never been used to work (at least not as core thing and only seen in the cartoon) and specifically, the games have no survival features in any capacity so this is just BS and Nintendo being Nintendo. More on topic however, I think it was Pirate Software during a podcast one time said that the way big corporations like Nintendo crush smaller ones is they hold off on an immediately lawsuit/cease and desist and just slowly build up more and more of a case. If the pal ball throwing is the only thing they have to stand on for the infringement, the ark could sue every game that ever did taming after them. It's unfair ground to stand on. And Nintendo needs to just focus on a creative answer in gaming rather than legal actions to try and tank a company.
So..... if you hadn't paid attention, Nintendo attacked G mod this year, they went after all mods in general that had Nintendo characters. THEN they have finally went after Palworld once they pushed everything else related to Nintendo. i think that the reason that nintendo is suing now rather than earlier is because they didn't want the case to be seen as a vengance case or a case to make them feel seen as a company that didnt want any competition. but i mean there are a lot of pals that look like a direct copy of some pokemon
The only thing that I can think of, is Palworld made Nintendo and The Pokemon company get off their ass and actually made some meaningful changes to the Pokemon formula. Let's just make Fortnite, but it's a Survival game, also there is literally basically Evergaols form Elden Ring. Change assets or art style? Why? This is only what i happened to read on another video comment seciton, so grain of salt and all. They stated, with confidece, that this is about game mechanics present in Pokemon: Legends Arceus. Throwing balls to capture, using flying mounts (doubious at best when you can fly in Ark), and relaeasing the creatures into the overworld (another dubious one). Nintendo can't or shouldn't have patents for these simple concepts. Also Palworld is a survival game with pokemon inspired creatures, not pokemon with guns. Thats been my opinion since the game came out.
Legal proceedings do take a long time, and with Nintendo they want to have a completely airtight case and spared through no expense to see what they could dig up. 9 months may seem like a long time, but Nintendo's willing to ride this out for however long it takes for them to win, or unless Pocketpair can actually win, which... I doubt they'll be able to given how small they are.

Them taking a long time to pursue legal action makes a lot of sense when you considering collecting the evidence, cobsulting legal professionals and overall taking all the time needed to solidify your case. Especially if you believe there is a chance that may not win.

Some Pals have similar designs as Pokemon. Other than that, they are extremely different games. Pokemon is a creature collecting turn based RPG. Palworld is an action survival crafting game that implements base building and creature collecting. They are VERY different games. If the basis of the lawsuit is plagiarised designs, then fine. There's something there to explore. If the basis of the lawsuit is that palworld is "Pokemon with guns", I call BS.
There actually was a Pokemon spinoff of you a human being a Pokemon called Mystery Dungeon, that was more than a decade ago but concept was brought back with an anime having Serena becoming one of her own but not to extent as those games. I literally want a modern MD or Ranger, I see myself as a Ranger rather than Trainer or Gym Leader because I'm more empathetic and prefer capturing but allow freedom for the target Pokemon.
Palworld is nothing like pokemon. Some of the designs for pals are similar but not similar enough. Pokemon has been kind of dry but for me the main problem is, i wish there were more games like it on xbox and ps.. I can think of a few series that could do it well, but i like pokemon as an rpg and the series that created the "creature collector" genre essentially. Theres just arent many games like it, i think palworld is more of a survival game with creature collecting mechanics, whereas pokemon is the creature collector. I dont think patenting game mechanics should be a thing.
Claiming that Pokemon hasn't innovated is the biggest and most damning mark against it. They really haven't. Gamefreak doesn't seem to understand WHY people like their game. They implement gimmicks, ways for your Pokemon to go Super Saiyan or throw out one really big move. And that's it. The idea of the trainers also fighting, that's completely out of their wheelhouse. The idea of you building a base and having to defend it from wild Pokemon attacks and bandits? Completely out of their wheelhouse. There could be a Pokemon game with these features, if you whitewashed them a bit. But Gamefreak is too lazy. Nintendo may win this lawsuit, but they're not beating the real allegations.
I think the infringement would have to be if the specific Pals that resembled certain Pokemon, as I think the designs are copyrighted? Like some other folks have said though, if that were the case, Nexomon/TemTem would probably be in the same position right now. It also seems weird to happen now as currently there is the small build up to the Switch 2 release. Is this maybe forcing Nintendo/TPC's hand on one of their upcoming projects? Or did they maybe not have something lined up back in January but pivoted to make something in this wheelhouse?(I'm in no way an expert, just my random jumble of thoughts)
If Nintendo does that, they're opened to be sued by Squeenix and Atlus because Dragon Quest and SMT were first. Pushing through that patent, means no one else can make a game like that. And both titles are still alive and popular for both compa nies.
To add to this, literally all of gen 1 pokemon designs were stripped directly from classic dragon quest, Nintendo didnt even try to hide the fact that thry literally copy and pasted their designs lmao. Nintendo can get sued for that alone.
I’m not sure how true it is, but asmongold put out a video that the patent Nintendo is attempting to sue over has to do with the ability to “throw an item at a monster and capture it”. He also mentioned something about the patent not being created until May of this year. Again, not sure how true that is, but if Nintendo had to create a patent to sue over, it could explain why the lawsuit took so long.
If it is somehow about the pal ball, i have a okayish change idea they could use instead of a ball, lean into the guns and make a one time use gun called "the pal Wrangler" with upgraded varients like "the large pal Wrangler" or the fast pal Wrangler" when shot, creates an energy net around the pal you are trying to catch with different challenges based on the one you use, like if using the quick wrangler, you gotta rapid tap a button on your controller / keyboard, strong being how much strenth you got on your character, so on basic Wrangler having no challenge and just chance
Pokèmon should be ashamed of itself on bullying other monster franchises like Digimon, Monster Rancher, Yu-Gi-Oh, Neopets, Yo-Kai Watch, Palworld, Bakugan, Monster Hunter, TemTem, Monsuno or Moshi Monsters for Pokémon to monopolize the monster taming genre. That's coming from me liking Pokèmon.
I think you underestimate the value Pokémon has to Nintendo; they don't need the money as Pokémon alone is worth more than $120 Billion globally. A little game like Palword is just a drop in losses. Sadly, Nintendo though is really the bully of the video game industry as seemingly gets away with it because they do make bangers.
Whilst PalWorld may be fun and was better than anything Pokemon has done in the past decade, it’s hard to argue against the fact the game is creatively bankrupt. The similarities between the designs are uncanny and whenever you have to describe the game it is described as “Pokemon with guns”. It’s hard to imagine a world where they haven’t infringed on patent and copyright, and ultimately Nintendo has the right to act on that.
Throwing an item to capture a monster, is a patent of Nintendo. Also, tap on device and holding to let a monster use skill, is also a patent of Nintentdo. This kind of shit is what they are suing.
Why now? Because preparing a lawsuit of this size, that multiple companies are involved in takes time. (the pokemon IP is co-owned by gamefreak, the pokemon company and "creature" I believe and Nintendo on the other hand owns 1/3 or so of the pokemon company)
More like they prepare the ammunition to be used , in this case , this year they created a bunch of patent and this is long after Palworld start its development and both palworld dev and Nintendo have been in contacted for a long time in order to avoid any potential issue .
It is rather obvious that the developers of Palworld would 'play dumb' to anything copyright related. The second you make a connection, guess, or even an implication...you shot yourself in the foot. No, I am not defending Nintendo, just stating how messy copyright law is.
There are plenty of pokemon like games where you capture monsters with balls or cards or other pokeball replacements, on pc and mobile that have not had issues with nintendo. Theres an online mmo pokemon like game called TemTem that also had no issues. The only thing Nintendo could try to sue for is say that Palworld directly copied Nintendos Pokemon designs.
I think they're going to get them on character design somehow. Wasn't there a video talking about how they used A.I. to create some of the designs or something? They might say that the A.I. they used stole from Pokémon designs, and go after them for that.
For me the worst part is that craftopia which released in 2020 had mechanics that pokemon patented in 2021. Palworld was already in development at the point. So if it's aiming and throwing mechanic it's bs. It's because of palworld entertainment. It was going to ps5 was going to go beyond gaming.

I always tell my son not to get himself in a situation that he will need to get himself out of. Pal world is a good game. I haven’t played but it looks like something I may play one day. But… WHY WOULD YOU MAKE A GAME WITH CHARACTERS THAT LOOKS SO MUCH LIKE A FRANCHISE GAME?????? That’s the issue. And to answer your question about why now for the lawsuit. As a parent I now understand why sometimes my punishment was not instant and was long after my crime. You let your child think they got away with something. They get comfortable and think all is forgiven. They snuggle under you again. Then when they feel at their most comfortable and they are sleeping close to you, you slowly turn to look at them… the Joker music starts playing in your head… you get the Joker grin… then everything goes dark! That’s Nintendo right now with Palworld.
No the reason why it took so long for Nintendo to sue is cause Japan takes forever to get anything done. The amount of paperwork just get the process of a lawsuit started is insane

I'm wondering if it's tied to Legends Of Arceus. I've never seen anyone compare Palworld to it, but it has some strong similarities. Still don't know the tie to patent - but I can see it.
A very basic assumption would be the "Pal Sphere" Capture mechanics.....which they used in a previous game anyways (Craftopia) that was less successful than palworld is. Traits, stats, the skill system, etc. are all used by a billion different games, heck, world of warcraft even has (had?) minion battles based on pokemon, and other titles (TemTem, Casette beasts, etc.) all copy pokemon's design more closely than palworld does. Not knowing specifics doesn't really matter here, i'd say. Traditionally you can't "Selectively enforce" when it comes to your patents and the like once you get to a certain point (Cartridge/disc based game consoles, streaming services, televisions, engines, etc. all being examples) and pretty much any minor discrepancy in design or system can sink you If it's about the whole sphere thing or something, the fact that the sphere floats up and displays a percentage bar rather than falling to the ground and rocking around during capture, and the sphere's don't "Open" to release or capture a pal the same way can seriously be enough difference. Legal stuff is funky, but this reeks more of trying to sink them through monetary means (Expensive court battle('s)) more so than actually hitting them on a patent claim. Which would be fully within nintendos standard practice.
If Nintendo actually had a claim, they'd have taken on "Nexomon", "Pocket Morty's", "TemTem" and "Casette Beasts" as well.
They clearly just want to get rid of a potential competitor.

When I saw this happening I immediately thought of when I was sued at 18.
Long story short, it was 1 day before my 17th birthday. Brakes on my car went out and my car blew through a stop sign hitting a car coming through the intersection. I was left with sever brain damage and retrograde amnesia. Because the brakes on my car went out I was deemed to not be at fault by the police. However the day before exactly 2 years from the accident (which is the cutoff time for civil lawsuits) the man my car hit sued me for 1.2 million claiming a permanently injuring his leg which made it so he could not work anymore. I fought the case hard for a little over 2 years. It was a nightmare due to me still being seriously screwed up mentally because of the amnesia. I quite literally don’t remember anything from before the accident or after it by about 6 months to a year. I have become paranoid of strangers because of the lawsuit and it’s difficult to drive due to the ingrained trauma from the accident. The lawsuit came to a close because I found out he had faked his injury (faked hospital visits among other things.) He sued me because he just wanted money. Lawsuits are f*cking horrifying.
Once a monopoly is in place it will seek to maintain that monopoly with the least amount of effort possible.
It's also a Japanese company I don't know there monopoly laws if they even have any to stop Nintendo for bullying everyone.
Digimon, Yokai Watch, Monster Hunter Stories, Atlus since everyone wants to hold to them making creature capture games. If monopoly just means doing better than other billion dollar IPs then they need to break up Nintendo, Steam, Playstation team, Apple, and Disney. Then again after that you’ll have to break up Epic, Microsoft, then move on to studios.

Well with luck nintendo will take the hint and make an actual pokemon survival game.
But the fact is pocketpair has always been a lazy company and did deserve to be sued, even if not for the thing it is being sued for. The system is broken and doesn't respect artistic design as an IP, which is what palworld really should be getting sued for. Not enough effort being put into making a more unique design. But that won't happen so mechanics will have to do.
I hate nintendo. I really do. Like, Pokemons don't die, don't carry guns, has never been used to work (at least not as core thing and only seen in the cartoon) and specifically, the games have no survival features in any capacity so this is just BS and Nintendo being Nintendo. More on topic however, I think it was Pirate Software during a podcast one time said that the way big corporations like Nintendo crush smaller ones is they hold off on an immediately lawsuit/cease and desist and just slowly build up more and more of a case. The longer they wait supposedly the more money they get in arbitration. So you sit and let them cook for a while, then right before it hits that time of year where money starts pouring in, you slap them with that lawsuit and take them for much more than what you would have gotten if you had filed the suit immediately. If the pal ball throwing is the only thing they have to stand on for the infringement, the ark could sue every game that ever did taming after them. It's unfair ground to stand on. And Nintendo needs to just focus on a creative answer in gaming rather than legal actions to try and tank a company.

This is only what i happened to read on another video comment seciton, so grain of salt and all. They stated, with confidece, that this is about game mechanics present in Pokemon: Legends Arceus. Throwing balls to capture, using flying mounts (doubious at best when you can fly in Ark), and relaeasing the creatures into the overworld (another dubious one). Nintendo can't or shouldn't have patents for these simple concepts. Also Palworld is a survival game with pokemon inspired creatures, not pokemon with guns. Thats been my opinion since the game came out.
They should be sued by WotC and Enix for ripping off dragon quest and MtG

Legal proceedings do take a long time, and with Nintendo they want to have a completely airtight case and spared through no expense to see what they could dig up.
9 months may seem like a long time, but Nintendo's willing to ride this out for however long it takes for them to win, or unless Pocketpair can actually win, which... I doubt they'll be able to given how small they are.

Pokémon is the number one media franchise on the planet. It took them this long cause they just won a different lawsuit
It's well known that Microsoft does not like Nintendo so you best bet they're going to step in. I got a feeling it this is going to be a ugly ass fight between gaming companies all because Nintendo is trying to create a monopoly for themselves and they don't like competition
One can only hope, for once I hope Microsoft pounds Nintendo into dust on this one, Nintendo is truly just another EA and Activision, they just have a different and more sunny disposition about it but they are still pure corpo evil.

I've looked at Pokemons patents and yes two-three weeks ago they refreshed their patients for throwing a item using three different inputs to interact with a creature in a space
That is literally illegal lol. No court on earth is going to accept the claim of "we patented this particular gameplay!" Especially as, according to other comments, ARK was doing similar mechanics YEARS before Pokémon was even a thing so they have no grounds to stand on

Them taking a long time to pursue legal action makes a lot of sense when you considering collecting the evidence, cobsulting legal professionals and overall taking all the time needed to solidify your case. Especially if you believe there is a chance that may not win.
Curious if Nintendo also waited long enough to make sure Pocket Pair had enough money to be worthwhile to sue. Definitely saw this writing on the wall, but also just as surprised it took so long
Some Pals have similar designs as Pokemon. Other than that, they are extremely different games.
Pokemon is a creature collecting turn based RPG. Palworld is an action survival crafting game that implements base building and creature collecting. They are VERY different games.
If the basis of the lawsuit is plagiarised designs, then fine. There's something there to explore. If the basis of the lawsuit is that palworld is "Pokemon with guns", I call BS.

There actually was a Pokemon spinoff of you a human being a Pokemon called Mystery Dungeon, that was more than a decade ago but concept was brought back with an anime having Serena becoming one of her own but not to extent as those games. I literally want a modern MD or Ranger, I see myself as a Ranger rather than Trainer or Gym Leader because I'm more empathetic and prefer capturing but allow freedom for the target Pokemon.
I don’t get there claim ARK has similar mechanics..when you tame a Dino/monster you can put them into cryo spheres.
Some of the Pals are pretty much a ripp off of Pokemon. Like Lucario there's quite a few others that look similar lol

Palworld is nothing like pokemon. Some of the designs for pals are similar but not similar enough.
Pokemon has been kind of dry but for me the main problem is, i wish there were more games like it on xbox and ps.. I can think of a few series that could do it well, but i like pokemon as an rpg and the series that created the "creature collector" genre essentially. Theres just arent many games like it, i think palworld is more of a survival game with creature collecting mechanics, whereas pokemon is the creature collector.
I dont think patenting game mechanics should be a thing.
Claiming that Pokemon hasn't innovated is the biggest and most damning mark against it. They really haven't. Gamefreak doesn't seem to understand WHY people like their game. They implement gimmicks, ways for your Pokemon to go Super Saiyan or throw out one really big move. And that's it. The idea of the trainers also fighting, that's completely out of their wheelhouse. The idea of you building a base and having to defend it from wild Pokemon attacks and bandits? Completely out of their wheelhouse. There could be a Pokemon game with these features, if you whitewashed them a bit. But Gamefreak is too lazy. Nintendo may win this lawsuit, but they're not beating the real allegations.
Win or lose, Nintendo's not coming out of this looking good.
I think the infringement would have to be if the specific Pals that resembled certain Pokemon, as I think the designs are copyrighted? Like some other folks have said though, if that were the case, Nexomon/TemTem would probably be in the same position right now. It also seems weird to happen now as currently there is the small build up to the Switch 2 release. Is this maybe forcing Nintendo/TPC's hand on one of their upcoming projects? Or did they maybe not have something lined up back in January but pivoted to make something in this wheelhouse?(I'm in no way an expert, just my random jumble of thoughts)
If Nintendo does that, they're opened to be sued by Squeenix and Atlus because Dragon Quest and SMT were first. Pushing through that patent, means no one else can make a game like that. And both titles are still alive and popular for both compa nies.
To add to this, literally all of gen 1 pokemon designs were stripped directly from classic dragon quest, Nintendo didnt even try to hide the fact that thry literally copy and pasted their designs lmao. Nintendo can get sued for that alone.
I’m not sure how true it is, but asmongold put out a video that the patent Nintendo is attempting to sue over has to do with the ability to “throw an item at a monster and capture it”. He also mentioned something about the patent not being created until May of this year. Again, not sure how true that is, but if Nintendo had to create a patent to sue over, it could explain why the lawsuit took so long.

If it is somehow about the pal ball, i have a okayish change idea they could use instead of a ball, lean into the guns and make a one time use gun called "the pal Wrangler" with upgraded varients like "the large pal Wrangler" or the fast pal Wrangler" when shot, creates an energy net around the pal you are trying to catch with different challenges based on the one you use, like if using the quick wrangler, you gotta rapid tap a button on your controller / keyboard, strong being how much strenth you got on your character, so on basic Wrangler having no challenge and just chance
Pokèmon should be ashamed of itself on bullying other monster franchises like Digimon, Monster Rancher, Yu-Gi-Oh, Neopets, Yo-Kai Watch, Palworld, Bakugan, Monster Hunter, TemTem, Monsuno or Moshi Monsters for Pokémon to monopolize the monster taming genre.
That's coming from me liking Pokèmon.
I think you underestimate the value Pokémon has to Nintendo; they don't need the money as Pokémon alone is worth more than $120 Billion globally. A little game like Palword is just a drop in losses. Sadly, Nintendo though is really the bully of the video game industry as seemingly gets away with it because they do make bangers.

Whilst PalWorld may be fun and was better than anything Pokemon has done in the past decade, it’s hard to argue against the fact the game is creatively bankrupt. The similarities between the designs are uncanny and whenever you have to describe the game it is described as “Pokemon with guns”. It’s hard to imagine a world where they haven’t infringed on patent and copyright, and ultimately Nintendo has the right to act on that.
Throwing an item to capture a monster, is a patent of Nintendo. Also, tap on device and holding to let a monster use skill, is also a patent of Nintentdo. This kind of shit is what they are suing.
Why now? Because preparing a lawsuit of this size, that multiple companies are involved in takes time. (the pokemon IP is co-owned by gamefreak, the pokemon company and "creature" I believe and Nintendo on the other hand owns 1/3 or so of the pokemon company)
More like they prepare the ammunition to be used , in this case , this year they created a bunch of patent and this is long after Palworld start its development and both palworld dev and Nintendo have been in contacted for a long time in order to avoid any potential issue .
Pokemon is owned by Gamefreak, Creatures and Nintendo. The Pokemon Company oversees and manages the brand
It is rather obvious that the developers of Palworld would 'play dumb' to anything copyright related. The second you make a connection, guess, or even an implication...you shot yourself in the foot.

There are plenty of pokemon like games where you capture monsters with balls or cards or other pokeball replacements, on pc and mobile that have not had issues with nintendo. Theres an online mmo pokemon like game called TemTem that also had no issues. The only thing Nintendo could try to sue for is say that Palworld directly copied Nintendos Pokemon designs.
I think they're going to get them on character design somehow. Wasn't there a video talking about how they used A.I. to create some of the designs or something? They might say that the A.I. they used stole from Pokémon designs, and go after them for that.
For me the worst part is that craftopia which released in 2020 had mechanics that pokemon patented in 2021. Palworld was already in development at the point. So if it's aiming and throwing mechanic it's bs.

Nintendo and GameFreak are absolutely scared shitless and feel threatened by Palworld. Remember how they reacted when Yokai Watch came out? Changed the entire anime just to compete. They wanted to keep a monopoly on creature capture games so that they didn't have to put in any effort.
Isn't Pokemon one of the highest grossing entertainment properties of all time? Video games, shows, toys etc.... wonder what their real intent is in regards to this lawsuit. I always tell my son not to get himself in a situation that he will need to get himself out of. Pal world is a good game. I haven’t played but it looks like something I may play one day. But… WHY WOULD YOU MAKE A GAME WITH CHARACTERS THAT LOOKS SO MUCH LIKE A FRANCHISE GAME?????? That’s the issue.
And to answer your question about why now for the lawsuit. As a parent I now understand why sometimes my punishment was not instant and was long after my crime. You let your child think they got away with something. They get comfortable and think all is forgiven. They snuggle under you again. Then when they feel at their most comfortable and they are sleeping close to you, you slowly turn to look at them… the Joker music starts playing in your head… you get the Joker grin… then everything goes dark! That’s Nintendo right now with Palworld.

No the reason why it took so long for Nintendo to sue is cause Japan takes forever to get anything done. The amount of paperwork just get the process of a lawsuit started is insane
I don’t really care about either Pokémon or Palworld and There’s no side to root for in this situation, Nintendo can’t seem to get Gamefreak to fix Pokémon, Pocketpair as a whole seems shady.

A very basic assumption would be the "Pal Sphere" Capture mechanics.....which they used in a previous game anyways (Craftopia) that was less successful than palworld is.
Traits, stats, the skill system, etc. are all used by a billion different games, heck, world of warcraft even has (had?) minion battles based on pokemon, and other titles (TemTem, Casette beasts, etc.) all copy pokemon's design more closely than palworld does.
Not knowing specifics doesn't really matter here, i'd say. Traditionally you can't "Selectively enforce" when it comes to your patents and the like once you get to a certain point (Cartridge/disc based game consoles, streaming services, televisions, engines, etc. all being examples) and pretty much any minor discrepancy in design or system can sink you
If it's about the whole sphere thing or something, the fact that the sphere floats up and displays a percentage bar rather than falling to the ground and rocking around during capture, and the sphere's don't "Open" to release or capture a pal the same way can seriously be enough difference.
Legal stuff is funky, but this reeks more of trying to sink them through monetary means (Expensive court battle('s)) more so than actually hitting them on a patent claim. Which would be fully within nintendos standard practice.
