If you are approved for Federal Disability Retirement and Social Security Disability Retirement, the first year you would receive both benefits. Because SSDI would be considered the primary benefit, there would be an offset every year after. I am a 63-year-old postal employee and have been on OWCP work comp for well over two years. I received monthly disability checks from OWCP, what should I do? Just keep receiving these checks? I am still physically on the USPS roster. I received my pay stub every two weeks. I don't know what to do here. I've been a postal employee for about 26 years.

I was recently approved for FERS Disability Retirement, and have been on LWOP for 8 months. What happens if I cannot find work, reapply for SSDI and get approved after the 1 year mark? Do I have to pay back any back pay and interim payment?
This situation can be a bit complicated and really depends on the specifics of your case, like the timing of your SSDI approval and how it overlaps with your Disability Retirement benefits. I also work for USPS 25 years in, I was just denied and I feel so bad, because of my disability in both knees, I can’t walk or stand for long periods of time. I was denied at my first request for disability retirement, a few days ago, they said I can appeal though. Unfortunately I had to quit my job in July 2024, because they couldn’t find me a job with reasonable accommodations. Now I’m scared, because I have been denied, my savings account is dwindling and besides APPEALING THE Decision, what can I do? I’m disabled how will I be able to find another Job? Do most people get approved the SECOND TIME? Please please help me!?

I do have two questions: - First, On 15:36 you mentioned that after 20 years of service after age 62 you get a 10% bonus. How does that work? If you get 32 years of service you get an extra 10% so instead you’ll retire with the equivalent of 42 years of service. - Second question, If you don’t meet the 5 years minimum time of FEHB, can you request a waiver from OPM and that way you can get FEHB during your retirement? Thanks for the info.
Referring to the years of service, when you retire at age 62 and you have more than 20 years of service, you will receive a 10% bonus to your monthly annuity payment. The 10% refers to your retirement payments not your credible years of service. Yes, you can request a waiver from OPM after retirement approval if you don't meet the eligibility requirement for FEHB.

Can the caseworker enforce you to put your check in and check out times of your workers compensation medical appointments, I was told, by my caseworker that I do not get the full 4 hours allowed for my doctors appointments, she stated that it is up to 4 hours, as an federal employee with the Va in Texas

Questions Once released from owcp, do you have to activate your opm fed disability retirement immediately? Or if not loose it, or it will always be there, inactive frozen when ready ? Example - you feel ok after therapy and surgery and you try to go to work, and days,weeks,months later you cannot continue working, can you activate your opm retirement then ? And if therapy has been requested many many times, more then a year and no response from owcp - is that grounds for getting a lawyer for compensation ? Thank you
If you were already approved for Federal Disability Retirement benefits, you don't need to immediately start them upon finishing OWCP. You can defer starting FDR as long as you continue to work or receive OWCP benefits. In the example used in the video, $446,400 would be how much John would receive from his Disability Retirement payments between the age of 47 and 62.
I cannot seem to get a straight answer from any of the representatives. Thank you for this. My question is: what high 3 amount is used when transferring to regular retirement to disability. For example- my high 3 when I started disability in 2007 was $66,626. When OPM gave me an estimate- they started with this number- calculated 36 years, which at age 62 (2025) I will have. They came up with $2058 per month… but… I thought that the original $66,626 would be increased by the COLAS, which would give me a starting high 3 of about $90k and would be apt more than the $2058 per month. Right now, my gross disability annuity is $1755 gross. Difference from the 2007 high 3 and the 2007 plus added COLAs gives me a very different amount… one is $300 more and the other is at least $800 more. I’ve been desperate to get an answer for years… sigh and I’m moving and do not know how much I can afford. I’m soooo frustrated!!!

Hi, I’ve been advised that requesting special accommodations could be risky and might even lead to termination. If I apply for FERS disability and end up getting fired, I’m not sure whether they would ask me to resign or simply terminate my employment. In either case, would this impact my FERS disability application?
It's not recommended to resign during the application process, but if your agency fires you due to a medical inability to perform your job, that could benefit your case. Basically, it's recommended to wait for your agency to remove you instead of removing yourself.
Does the need for a treatment period of at least 6 months apply to independent forensic psychology opinions?

I had neck Surgery in 2018 on my Federal job and was force to retire in 2019 c5 c6 c7.

What satisfies the requirement for excessive use. I have almost a year of SL saved up. I have used 5000% more SL in the past 6 mo than I have in the past 10 years.

Medically retired as Air Force Captain and Air Force GS 12. Now on OWCP. I can be medically reviewed at any time and be terminated from OWCP. Proactive options to appeal.

I was approved for accommodations, but they have not been met yet. One of which is a chair that elevates my legs to waist level. I am in extreme pain, and can hardly move. I was working from home, and they do not want to let me do it any longer although I can do my job 100% remotely. I have emailed the HR department regarding the results of my working in office outside of my accommodations, and they asked me if I would be in office tomorrow since I mentioned being in pain. (My supervisor actually threatened to fire me if WFH was written on my ADA paperwork btw). What is your advice?
It sounds like you may qualify for Federal Disability Retirement! If your agency is unable to (or unwilling to) accommodate your medical condition, you could still qualify. Harris law firm helped me receive my OPM FERS retirement 5 years ago. I didn’t work that whole time until now. I am trying to be a 1099 worker. If I create a LLC and just take a low enough salary from that LLC to meet OPM disability retirement requirements, is that all the income that I have to claim? The rest of it would be in the business (invested back in the business or used as expenses, etc). Or would OPM count the entire amount made as the LLC business? What about if I had a partner and paid them a salary too? That would be an expense in the business so it would reduce my overall business accounts.
This is a great question, and we would absolutely recommend reaching out to a financial advisor in this situation. We want you to be perfectly clear on reporting your LLC to the OPM, and a financial advisor would be able to provide more concrete advice.

You may qualify for a schedule award if your injury occurred due to your job! You would not qualify for Federal Disability Retirement at this age, but OWCP may be beneficial.

If you are approved for SSDI there's a very strict earning limit. If you earn more than the substantial gainful activity limit, which is currently $1,550 per month, your benefits may be stopped. At age 62, your Federal Disability Retirement benefits will automatically transition into your regular FERS retirement!

I was just recently approved for FERS Medical retirement, but I’m required to apply for SSD. If, I’m approved for SSD, my medical retirement will decrease. Can I withdraw from SSD without it affecting my medical retirement? I asked social security and they told me if I deny or withdraw, they notate it on there. So, what do I need to do to make sure SSD doesn’t approve me?
Applying for SSDI is a requirement set by the OPM. You cannot withdraw your application without it affecting your Federal Disability Retirement. But the requirements for SSDI are pretty strict and there is a very low earning cap, so if you are not permanently disabled you likely will not be approved.

If you only have 5 years service would you then get 1.7% per year of your highest 3 after age 62? (5X1.7% = 8.5%) Or do you get credit from your date of hire to age 62? Does the Government also pay out on injuries acquired on the job which led to your disability? Do you guys handle that too?

That would likely still be considered a federal organization which would impact your FERS disability annuity. We do not recommend working for any federal organization as it may risk your annuity.

Great question! Unfortunately, on Federal Disability Retirement you can no longer contribute to your TSP and you will not receive any matching from your agency. You can either leave your TSP account alone and allow it to accrue interest, roll it over into a private sector account, or cash it out, but you may incur a penalty depending on your age.

It will depend on your specific case whether OWCP will pay you in a lump sum or payments. If you are receiving another form of monthly payment, like disability retirement, you are more likely to receive your schedule award in a lump sum.
I hired Harris Federal to work on my federal medical disability retirement. However my claim just got denied. Even though I’m a VA 💯 P&T, OPM still denied my claim. I’m a little bit concerned because even though I haven’t resigned, I can’t perform my job duties due to my disabilities. The agency also won’t accommodate me to a new position. The OPM has been denying more cases so don't worry, this isn't unexpected. Your case manager is already on top of the situation and is working on the next steps for you.
