    You know what’s better than trashing FPI? Not mentioning it at all! You don’t need to wait for Week 4 to decide about FPI. It’s been absolute garbage for a few years now and people act like it’s some great predictor. All it is now is ESPN propaganda and so bizarre it creates buzz for being so bad. If you don’t believe me, just look at the final rankings the last few years. The biggest flaw is acting like perceived team talent will produce a great team. That’s why Texas 8-4 (A&M) always shows up high no matter how bad they play. It way overrates the ratings for teams that lose to the top teams. The 11-2 Washington team finished 20th and way behind the Texas and Oregon teams they beat. The 14-1 team finished 12th and was behind Texas and Oregon again. Check out how 6-7 Oklahoma and Baylor were both in the 2022 Top 26. People roast FPI on twitter every week because of teams that lose to other teams are often ranked higher. Every year is different and the NIL era isn’t the past, but history says there’s a 2/3 chance JY is wrong on Air Force. History says they’re going to a bowl game: It says they’re going to have a winning (Not .500) record in conference play. They’re always likely to go 3-1 or 4-0 in non-conference. The odds say they’re likely to win at least 8 games. They’re a top team in the division and conference most years. Yeah, I’ve seen some losing records and I’ve also seem some bad stretches, but that’s a lot less likely than being one of the better teams.

    The PAC-2 have made it clear they have no interest in a MWC merger. They split up their sports for a reason. Wait and see is the best play. Best case scenario is Big 12. Worst case scenario is rebuilding with mostly MWC schools. Wazzu/OSU are more valuable to them than that conference is to Wazzu/OSU. They shouldn’t lock themselves in when there’s still so many realignment dominos to go

      Explain your opinion, please. A Florida judge ruling that the acc didn't act as an agency to the state of Florida (FSU), that FSU attorneys didn't view the documents as part of a legal dispute, and that not even a trade secrets-redacted version will be ruled to be public record? 😬 I doubt that very much. Seems very possible, maybe even likely, that this is ruled in Moody's favor (again, WITH actual trade secrets redacted/protected, which all 100+ pages clearly aren't all trade secrets).

      ​​1. Pretty sure you're wrong. I know you keep saying that, but I've yet to see you provide any explanation as to why you think that. What is the specific language that you can cite to support your claim? I'm looking at the mandamus filing, and I don't see anywhere that it states a 100% unredacted espn agreement should be released to the public. In fact, I see where it actually references the FL trade secret statutes, which makes me believe it's unlikely Moody has any expectation of the full, unredacted document being made public. 2. Even if your assertion is true (which I don't believe it is), it doesn't matter. Judge Dempsey - not AG Moody - is who will be determining a) if it's a public record and b) if there are any trade secrets that need to be protected. Obviously the entire document is not a trade secret considering the acc has literally divulged information from the contract via press releases, which espn itself also posted online on its website. Shirley even you would agree with that. ​@@TheBigMountainPodcast

    Clemson better have a ‘solid’ offer from the B10..or SEC …but they may be jumping ahead of the gun….and find themselves out the door without a landing place in either the B10 or SEC….hhhmmm….will ACC take them back…or is the B12 their only alternative ?? I am sure they are briefed on their alternatives and repercussion’s. Miami could sneak in…but the more likelihood of Notre Dame becoming that second partner along with FSU for the B10….and the SEC…just passing for now….or zeroing in on UNC and another more well rounded program or venture into another state…ie Virginia or Kansas… with Virginia of more value ..especially with the negative feedback from Mizzou and South Carolina as well as Florida nixing Miami . SEC will do whatever and whoever they want…all will come out in the wash….but I think unless one of these schools settle/ pay an exit fee….this may be litigated for a good while….meaning ..wait till next summer to go thru this mess again! Lawyers always win ! Especially in litigation type issues…where per diem and fees keep everyone in turmoil and dragging it out!

      The courts cannot order the AG to break state laws. Florida has some of the most, if not the most, liberal sunshine laws in the country.

    As I've said before, I've become very weary of FL AG Ashley Moody's intentions. I need to see more substance behind her intentions regarding the suit against the ACC. It seems like she pops up whenever she wants and that she's not showing any real urgency to get to the truth of this matter. I question if she's being sincere at all about her legal pressure on the ACC. In other words, I'm really on the fence about Moody. Actions speak louder than words Floridians would like to hear.

    I have lost interest in the writ of mananus aspect of this. I am much more interested in the Clemson summary judgment even if it is unlikely to come to fruition. I fail to see how a summary judgement would be a bad thing for the ACC either or why they would fight it. Both sides have the exact wording of the media document. Both believe they are correct on what it says or means. Why not cut to the chase and let a judge interpret it? Loser goes home with nothing. How confident is each side that they are correct?

    I kinda agree with you but how do we know fraud hasn't been committed by ESPN and the ACC? just a thought! If it isn't Moody looking into this matter then someone has to because this seems unfair to all the institutions involved with the corrupt conference heads and ESPN calling the shots!

      Imo there's a possibility that something very illegal and fraudulent has been committed by ESPN and ACC. Hence, one reason why they're covering up the Media Agreement.

    I can’t imagine the big 12 loses any teams to an ACC that would be rebuilding. I think it goes the other way. I think the big 12 cannibalize is what they want from the ACC. The Big Ten and SEC don’t need anymore teams. If it’s down to three leagues, it would be the big 12 over the ACC if the ACC implodes

      Not a dumb question at all. It could have weight and that is an issue that FSU has brought to the court in Leon Co, FL. So far the judge in FL has shown he is very interested in the “taking of FL property”. This very well could be a significant issue in SC as well.

    McKenzie is generally correct that motions for summary judgment/partial summary judgment are rarely granted. That’s because it’s rare that a dispute involves no genuine issues of material fact that bear on whether the judgment should be granted. That said, there is a subset of disputes that involve only questions of law. Disputes such as the interpretation (construction) of a statute or the terms of a contract. That Clemson’s motion is for partial summary judgment is notable. It suggests the motion was narrowly crafted such that it only asks for a legal interpretation of the GOR (presumably the claim by Clemson that based on the GOR’s unambiguous language it only applies to schools that are in the conference and has no application when they leave). If the court agrees with CU that the issue is purely a legal one, and that the interpretation urged by CU (which CU undoubtedly argues is the only interpretation) is correct, and finally that a ruling on this issue will simplify the issues in the case that left to be tried, it should grant CU’s motion for PSJ. Using shorthand, that the GOR doesn’t travel with departing members then becomes “the law of case”, and its application to the remaining issues can go a long way towards facilitating a settlement.

    Isn’t Clemson’s best argument is that the ACC doesn’t have the right to keep Clemson s media rights if they are no longer in the conference? The exit fee is $120 M. Clemson should be able to pay the exit fee and take thrust media rights. ACC would keep rights to home games played while in the conference.

    The ACC complaining about "misdirection" with Clemson's filing is really a hoot given the ACC's filing before FSU. The ACC is trying to have it's cake and eat it too. Does anyone else find it funny that the ACC has not given an official number to either FSU or Clemson? They're (ACC) doing their best to keep their two prime schools in a conference they do not want to be in. Sadly, I had hope that Judge Bledsole would be fair but it appears to me that he is the head chef in the NC kitchen.

      If what the ACC asserted is correct it is actually pretty clearly a misdirection. In one of the ACC filings they claim that Clemson had asked to begin negotiations with an assurance that there would be no legal action taken. The ACC agreed and they were hammering out the details when Clemson suddenly filed their suit. As for Judge Bledsole, he is an honorable and fair man. He will make his decisions based on the law as they apply to the facts. To claim otherwise is slanderous.

      @@williamsheen837 According to what the ACC said in it's filing negotiations hadn't begun yet. They were putting the details of an agreement assuring Clemson that they wouldn't go to the courts if they negotiated when Clemson filed. It will be interesting to see how each side paints this picture. We will see.

    The ACC’s claim that the conference accepted the GoR in North Carolina is pure baloney. Each and every member school executed the contract in their OWN state and electronically transmitted it to the conference offices. In the legal realm, where a party to a contract actually signed it matters greatly.

    Can Bledsoe rightfully say that the Clemson case should be heard in NC while the FSU case is on hold in NC due to appeal to the NC Supreme Court?

      Just because FSU filed and appeal, it won’t stop this case from being heard by Judge Bledsoe. This to may be appealed to the NCSC, but it’s a process.

    Who knows what will happen at this point. Clemson obviously found something in the contract that made them push this in my view. The judge will see the exact language and will make the determination. This has been the wildest offseason I can remember.

    The State of Florida will not hand over its Sovereign Authority to govern Florida State University for a Justice aka Judge in the State of North Carolina. The Judge in North Carolina will not pick up that case again until 2025. The local concern & its impact is “Wake Forest” & “Duke”. The ACC is still addressing most of the same issues,but they’ve flipped their arguments. FSU had to comply with the Sunshine Law. That is the reason everyone got a front seat for Florida State University Board of Trustee meeting’s. When Maryland left they payed the exit fee & the ACC kept their last Athletic year’s $$ funds. That could be a “Precedent”. Maryland came into the B1G broke, Florida State University is far from broke.

      I don't think it is wise to hang your hat on the Sovereign Authority (Immunity) argument. We will know soon enough when the NCSSC rules in a few weeks.

      Ironically, the past failures of Under Armour= Maryland and breaking the massive UCLA deal, helped the BIG become and maintain a coast-to-coast conference making the most money. Maryland and later UCLA both needed the BIG cash and the BIG made millions in cable rates and overall value.

    The partial summary judgment makes sense in this scenario because interpretation of the verbiage of in the redacted document is literally their entire case. If it says what Clemson thinks, case closed and no additional money wasted by either party or the state. If the judge disagrees with Clemson’s claim of interpretation, Clemson has no real case and it gets dropped. Seems like a great thing for both parties

    The price of admission to the FBS club is now $5,000,000, and 2 schools have paid it, Delaware and Missouri State. I believe that Kennesaw St. was the last school to get into the club for only $5,000. That's right in October 2023, the club added three zeroes to their entry fee, and in less than 9 months, two schools have agreed to pay it and many more have asked to pay it, but didn't have an engraved club invitation allowing them to pay the fee! Whether this trend continues is probably dependent on the practical effects of these lawsuits. The future is too uncertain to me, to be placing wagers, although rebuilding the Pac in the short run, might be bettable.

    You are wrong about New Mexico State University on several accounts. The enrollment is not shrinking and its not 11,000. It's at 25,300 plus. The attendance at football games is growing faster than any other FBS program in the country growing 27% since 2021. It's in a larger metroplex population area than Albuquerque University of New Mexico, who's enrollment is shrinking. When I attended UNM in the late 70s the university claimed to have an enrollment over 35,000 while today it's only about 19,000 with the undergraduate population at 15,000. UNM also has an outdated football stadium that once had a track around the field, making the seats at a bad angle for good view of the field, while New Mexico State has a modern football stadium built for football only, with all seat having a good view of the field. NMSU only disadvantage is the pay the coaches earn, but they are correcting that.

    Sorry for being late here. Been busy studying an online course. As for the PAC-2, I believe the most likely scenario is OrSU and WSU joining the MWC. They'll try to rebuild the PAC with various G5 schools, but I think they're not going to have enough time (and cooperation) to get it done.

    Why would any team leave a conference for a conference of two schools? I think WSU and OSU will end up in the ACC once FSU and Clemson leave the conference. If UNC decides to stay in the ACC, adding those two team will help with traveling with Stanford and Cal.

      Are you ignoring the point that the private company did business with a state owned entity? I do not know the particulars of the FL Sunshine laws, but your observation ignores that key fact. If this were U Miami, I agree that the FL AG would have no standing to ask for or do anything. I have no clue where this ends, but it is a very logical move by the FL AG.

In ridiculous theory at least, the legislature and governor could close either university. Investing through a pension fund is not even vaguely similar.

    See, so the P4 conferences can work together. 😃 By the way, it is at least possible that the State of FL Sunshine Laws are stronger than those of some other states, but what happens here may not be applicable elsewhere. I am not admitted to the bar of the State of FL and know nothing of FL Sunshine Laws, so I have no opinion on that.

      There are good faith workarounds and exceptions to sunshine laws, and conferences like to have a private school member to trigger some. Moreover, it was reported that somehow FSU was able to negotiate with private equity in secret and even sign a confidentiality agreement. I also claim no expertise in FL law, but I suspect that FSU has intentionally not used legal workarounds and exceptions when they would normally be used. Why would another conference risk this behavior in the future?

      @@tarheel7406 you could be correct, but it is all speculation, as we know no details. Other conferences in theory could immediately get from all of their members some sort of legally binding waiver of the sunshine laws in each state. I take for granted that this is possible, if explicitly done. The ACC apparently did not do that. I certainly understand why the other conferences do not want or need that aggravation, but they probably can get voluntary protection from their members. Again this is speculation on my part since I do not know all of the various state sunshine laws, nor do I have any interest in trying to figure it out.

Regardless, my point is that there certainly is a now established "way to do business" in this industry regarding sunshine laws and that FSU has likely intentionally broke expected norms to pursue its own interests. Scorched earth. The difference between what one can do vs. should do. Add on top of that the Florida AG's efforts (which were certainly requested by FSU or in consultation with) that have drawn some ire from the other P4s. Honestly, why would either the SEC or B1G want to risk that type of poison when FSU isn't that necessary of an expansion?

    FSU made a bad emotional decision that regardless of the final outcome will cost them many, many more millions more than the revenue gap central to their complaint. Clemson got suckered in because they believed all the talking heads saying it was all going FSUs way and the ACC is done next year. Unfortunately that was another bad decision. It will end up being costly for them as well.

      How do you know that? None of us have seen the underlying documents, so we have real basis to reach any definitive conclusion. If Clemson and now FSU are correct and their withdrawal means that they are not subject to the GOR, they could be huge financial winners. As a lawyer, I have no opinion on that, since I have not seen the actually seen the documents. FSU and Clemson could be huge winners by getting in the B1G or SEC, or it might take them years to make up what it will cost. We have no way to know.

      @@tarheel7406 there is some difference, but Clemson is the school that now makes the strange claim that the ACC owes it damages. Good luck. FSU going scorched earth does not mean that it will not ultimately make lots of sense financially. Beyond that FSU has the excuse (though it is arguably a weak excuse) that they were the undefeated team that got screwed.

      @@observer466 a) I'm so far ignoring CLEMSON's frivolous damage claim. b) If scorched earth ruins both the departure and destination points? c) I'm increasingly confident that the scorched earth played a role in FSU's CFP snub. BTW... If FSU to the B1G has been a "done deal" for a long time, why didn't the B1G get FSU in over BAMA? I keep saying that this may all be a desperation Hail Marry play by FSU which will end in either the B1G or the BIG12. Maybe the B1G knows that UNC (and perhaps UVA) are 100% lost, but I can still see it holding 4 slots for ND, It's +1, UVA & UNC until some actual official to SEC announcement.
