    Hi, is severance pay compulsory. My company has closed due to insufficient funds and 30 staff retrenched in a day with the process not followed. We dont know if we will get paid out correctly. Many thanks for all of your very informative videos.

    Hi Carmen, well informed video, need some assistance regarding current retrenchment as per S189A. Can employer decide selection criteria for dismissal as well as redeployment (alternative) in other business units? Employer has host consultation but never gave us any opportunity to propose, who needs to go and who needs to stay and who can move to the other business units. About 30 employees been handpicked by a hiring manager without consulting with us, but we were advised to apply for job when they become available from other business units

    Hi Carmen, love your video, just a question relating to retrenchment, since we as employees don't belong to an union, no workplace forum, the employer had a consultation with the employees an several groups, employer didn't provide us the notice letter prior to the consultation, neither after only on my request 1-2 months afterwards. The consultation was so unbearding to listen to as the employer took charge and decided what the best outcome will be regarding alternative re-deployment - but no option was given to us regarding our proposal. Has forward a request to CCMA for facilitation which failed due to the amount of signatures require from employees which i can represent at the CCMA as all of us working from home and different shift, as well known that employer won't allow us to have an employee meeting. So since the facilitation request failed, I sent a request to the CCMA for Unfair Labour Practice as the employer decided to handpick employees according to their criteria and offer them alternative positions at other business unit, keeping their same salaries but the rest of the employees need to apply for vacancies that will become available during the notice period with less salary. Any thoughts and tips on that? FYI.. still waiting on CCMA to provide setdown date as the 7.11 was sent to them back on the 20 July 2024, contact was made to their office a few days ago, but still waiting on their feedback.

    In the default UK care is basically midwife and even when you have a consultant. Due to baby being presumed at risk due to being a >5 centile I ended up with a c section with no1 it was meant to be inductions but that didn’t happen. Baby 2 no, I wanted a VBAC but my waters broke and I hadn’t gone into labour for almost 2 days so I decided to have a second c section. So the most interventions you can have. But both babies were successfully breastfed into young toddlerhood. So I want people to know you can make it happen even if you have to have a section! The hospitals push the formula very fast though you can make breast feeding happen even if you have had interventions. Women need to know this too!

      @@carmenfourie5346 yes and it’s really good you had in your birth plan what you wanted if your birth didn’t go exactly as you’d hoped. I think many women are very ill prepared for breast feeding and unfortunately the marketing of formula has really worked and they think they have “low milk” etc etc. and they underestimate how hard it is to get baby back to the breast once you start bottle feeding, it requires a huge amount of will power and time. I was pushed to give bottle at the hospital with my first and she didn’t need it, with my 2nd I was ready to fend off the midwife’s with formula but fortunately didn’t need to!

      Refer your alleged unfair dismissal to the CCMA within 30 days. At the onset of the case, you will need to prove that you are an employee and not a contractor before the dismissal will be discussed.

    If an employee calls in sick for two consecutive days being yesterday and today and does produce a valid sick note when they return to work are they allowed to still be off sick without a sick note (self diagnosis) in the next 8 weeks?

      The legislation that pertains to the 8 weeks is "on two occasions" in an 8-week period. It isn't days, but rather occasions. The 2 days yesterday is one occasion. The employee has another occasion in the 8 weeks to be absent without a medical certificate. On the 3rd occasion they will need to produce a medical certificate irrespective of the number of days (i.e. it can be 1 day). In any of the occasions, if the number of days exceed 2 consecutive ones - they can be required to produce a medical certificate.

    Good day Carmen I've got a question i was retrenched a couple of year's back and immediately after this retrenchment took place the employer rehired in the same position's and rehired numerous worker's and refused to rehired most recently I've reapplied for a vacancy but the employer refused to reply to my emails in applying for said vacancy I've met all the requirements for said vacancy but got no replying email from the employer note i was a shop steward at the time of the retrenchments

      See Section 186(d) - Section 186 defines dismissals and (d) states "an employer who dismissed a number of employees for the same or similar reasons has offered to re-employ one or more of them but has refused to re-employ another". It sounds like this is applicable to you. You can refer the matter to the CCMA and at the start of the case you will need to prove that a dismissal took place. This information provided in Section 186d is applicable to proving that.

    This was such a personally relatable video, so thank you for sharing! Though I wouldn’t refer to myself as a crunchy Mum, I’ve done almost all the things you’ve mentioned for my first daughter, who happens to be just about 16 months as well! And if I recall correctly from a previous video I watched of yours, I also live in Alberta but in the south. With not having many Mum friends, its nice to hear I was not alone in my experiences!

      I recommend making sure that the employer is not entitled to require you to work overtime (check your contract, see how the relationship has worked in the past, etc) and if the employer is not entitled to require you to work overtime - then you can simply refuse to do so. I recommend making very sure, because if you refuse a legal and reasonable instruction you can face disciplinary action for insubordination.

    As a soon to be first time mom who had a MC with our first baby at 13 weeks (that was the hardest thing I’ve ever been through…so hard emotionally but physically too), I enjoyed your realness and perspective in this video. Thanks for sharing! My husband and I are taking a birthing class from a very wise retired midwife who believes birth is a picture of spiritual rebirth (John 3:3-10). This adds beautiful meaning to me as someone who has been born-again due to my Savior’s suffering on my behalf on the cross so that I could be born-again. She has been telling us the importance of surrender (relinquishment of control…) but also “staying open” by keeping the inlet and outlet of your pelvis open. It gives the baby more space in our pelvis during pregnancy and helps the baby pass through during birth. She says most midwives don’t even know about this to teach this. She first learned about it from a midwife in Australia. I’ve been practicing this by pushing my bum back, which curves your spine and ends up pooching your stomach outward a bit. It helps the baby get in the head down position because s/he has space. When you said that it felt like your baby was stuck on some sort of bone, I wonder if this was because baby was stuck on your sacrum/coccyx because the way (inlet and outlet of your pelvis) wasn’t open. Hopefully this is helpful to you. God bless you and your family! <3 P.S. Your videos have convinced me to buy the Go Diaper Free book and strongly consider EC. I first read of this idea from my SIL and I thought it was crazy but I wasn’t told the reasoning. Now it seems like the only way for me. Thank you for your thoughtful discussion around this :).

      aaah what a lovely comment to receive. The inlet and oulet of the pelvis is such valuable work - I worked with a birthing physio in pregnancy who helped me with this, but amidst everything happening I wasn't conscious of this during birth. I do assume she was stuck, but it seemed the use of the stairs helped shift her into position (similarly having one leg on the toilet and swaying my hips seemed to help a lot). Maybe if I had focused more on opening - the stairs wouldn't have been necessary (although my entire labour was on the back, so hard to know). I am so excited for your EC journey and I am sending you so much care for birth!!! I trust it will be a beautiful empowering experience.
