Dumbest thing I have ever heard. A Trust is a private document. Why would anyone disclose these matters with their Accountant? Clearly this content creator has never had a client put property into a Trust. No mention of a warranty deed vs Quick Claim.
Some of these boundaries were "Ye old oak tree at the junction of red creak and wild river in the NE corner following the creak 700 paces to large boulder" unless you had it GPSed and all your neighbors agreed and the stated signed off you're fuc@ed

I think we all can learn from this pay someone to use GPS to know where our property lines just incase good survey company will figure this out but
As a realtor, home inspector, and seller, there are several things I don't do when selling personal property. I don't accept home sale contingencies. I don't want to be a domino in the train if one sale in the line fails. I sell as-is and welcome a home inspection. No repairs, dont ask. I hold the buyer to the closing date in the contract. Any lender delay is on the buyer, its a contract performance issue and loss of EM. They can pay another fee to extend the contract, but I wont sign an extension without a nonrefundable payment. I ask for a high EM deposit and limit the financing contingency. If a buyer just wont pay a higher rate versus being approved for a loan, that is not a failure to finance. Same for insurability contingencies. Just because a buyer cant find a reasonable insurance premium does not make the property uninsurable. This is true on coastal properties. Finally, the following are not considered when selling: assignment contracts, 1031 exchanges, any loan that requires the seller pay for repairs (The VA used to do this), wholesale investors, short-term lease with a purchase balloon payment.

Most all CCNRs I see where I am have a time limit of 25 years. I have seen a 50 and they can be good and bad depending on what you want to do. Thing is, you should know on the front end and decide if this is something you want to abide by for the chain of title. One I currently live under expire in less than 7 years. Most everything around here ends up getting broke into plots and CCNRs enacted. Most are pretty basic, but there are some that are just a bit overreach IMO.
Another reason to not have a bank account. Can't even pay who you wanna pay unless it's the gov. Be it wouldnt delay then

My county has a gis program that has property lines in a grid view you can view. They arent always perfect. But they're very close in my property's case.
Another major headache for these peeps
A couple of things on this one. Some places See that a detached garage could eventually be remodeled and become an additional dwelling and or subdivided and create an additional lot or multi family occupancy on single family land. Another issue is possible that if in forest service lan 99 year lease you may be bound to the 99 year contingency.

The sad thing is most of these town clerks have no interest in doing anything about the scam. I own property in two states and in three locales and only the town clerk in the town which I live in has the email alert system set up. One town never returned my email requests and the third town showed no interest in doing anything about it.

Farmer 'A' sold a section of land with a CC&R to un-related party. That party, person "B", built a home. 30 years later (now 2024) person "B" passed. We have purchase the property from the heir, person "C", of person "B". We are trying to locate ANY family member of Farmer 'A' or are we able to ask person "C" to clear some items in the CC&R - thank you for this video!
