      @@unlimitedrabbit yeah, but this went beyond what I’ve seen in other parts of the country. I’ve seen cops try to get out of a DUI. Never seen them switch seats and fake a heart attack. I’ve seen cops not care about rights. I’ve never seen something so blatant as picking up someone’s phone, stating they know its owner, then searching the phone by saying it has an unknown owner. All while just laughing about it. There were 2 people faking heart attacks at the same time. That’s nuts lol! Seeing this coming from other parts of the CPD really puts Sean’s situation into context. The way they’ve treated him (which is extreme, even for someone who has his job) is just the way the state police act.

      @@LongIslandAudit I'm a former police officer (20 years ago) and was responsible for teaching constitutional law to new officers out of the academy. As soon as they hit FTO, the older officers would ruin it all by saying things like "forget everything they taught you in the academy, and I'll show you how to really do this job". That's the mentality we see today, and what allows the senselessness to perpetuate generationally.

The guys in the car are obviously wrong… but the troopers use a confrontational tone, illegally search his phone while childishly mocking him, also make fun of an alleged [albeit less than credible] medical condition. The troopers display lack of professionalism and escalate the situation in every possible way.

      As gross as it feels, a court would likely argue that the search of the phone was legal. It was found in plain sight outside of his possession, and the officer could argue that the map data, videos/photos, and call history could be relevant to their investigation to establish who was driving.
      Also courts have ruled that even if the phone was locked, officers could force a face or fingerprint to unlock the device, however they cannot force you to give them the password as that falls under the 5th amendment.
      Now, because I know how these things go, here's the disclaimer because I know some people are already halfway through typing out "bootlicker". I'm not saying I agree with it or that it is right that they did so, merely that it was lawful based on previous rulings. Lawful and right are two different things, and have very different standards of proof.

      Depends on the approach the state/your employer takes on folks with alcohol/drug problems. This is part of the process folks have to go through. Can't imagine I would like EVERYONE I work with to know I had to do a breathalyzer to start my car/work car. Embarrassing.

    A police officer here in Utica NY was arrested for a DUI in Canada about 12 years ago. Not only did he keep his job, he got promoted and is now retired with a full pension.

      If you were driving while under the influence of alcohol (DUI) or a substance and the police had probable cause, then the police can search your vehicle.

      @@hwynyt I think you are right, but think it might vary dependent on state law... I'd really like to know an answer from a lawyer or reputable source actually, as I've heard this long ago as well, but never could find any case law or anything of the sorts.
