It was found in plain sight outside of his possession, and the officer could argue that the map data, videos/photos, and call history could be relevant to their investigation to establish who was driving. Also courts have ruled that even if the phone was locked, officers could force a face or fingerprint to unlock the device, however they cannot force you to give them the password as that falls under the 5th amendment. Now, because I know how these things go, here's the disclaimer because I know some people are already halfway through typing out "bootlicker". I'm not saying I agree with it or that it is right that they did so, merely that it was lawful based on previous rulings. Lawful and right are two different things, and have very different standards of proof.
