I am a store manager for a big box department store. I have a guy with a pick up that goes around every two weeks picking up carts. We receive calls from apartment buildings and the like and then go pick them up. It has been a problem at some of our stores, and the carts are quite expensive, so at those stores we have added wheels that lock up at the perimeter of the parking lot. It is our responsibility. Law enforcement has better things to do.
Unfortunately in NYS cops can legally do what they want, as long as they say they are doing it, on duty, as long as the cop is directing himself to do it. The only possible exception would be to prove that the cop is not behaving in his official capacity, like the Civil Rights Lawyer got the Family court judge search case. NYS Vehicle & Traffic Law Section 1202 Stopping, standing or parking prohibited in specified places (a) Except when necessary to avoid conflict with other traffic, or when in compliance with law or the directions of a police officer or official traffic-control device, no person shall: 1. He had to prove she was acting out of her official capacity bc he was trying to sue her civilly and need to get around her judicial immunity. I'm not trying to say that people should be able to sue cops if they see them parked like this, unless someone ends up injured as a direct result of the cop's negligence. Police also can not legally do whatever they want "as long as the cop is directing himself to do it." That's not even a thing. They legally are not allowed to "do what they want" as long as they're on duty, but I do believe they're allowed to park like this when responding to even the most mundane call for service. The risk to the public over shopping carts is not justified and should be addressed. However, they can make all the laws they want that dictate the conduct and procedure for police, but without anyone to enforce them, it's all but pointless. Whoever gave the police departments the legal authority to police themselves should be tarred and feathered, and then give the police someone independent of the department to oversee them that has the legal authority to press charges against them and make maintaining that job be dependent on their results, with no connections to the department that would give them reason to look the other way. Create the position(s) in a way where they will not be able to like each other.

Edit for clarification- Double parking is when a car is already parked legally on the side of the road, and another person parks in the roadway. (Their passenger door next to the driver's door of the parked car.) This also applies to stopping or standing. (Usually meaning loading or unloading goods or passengers.) The statute you were quoting basically means you can't stop in the middle of the street for any reason, just because there isn't an open parking space on the side of the street.

I am a store manager for a big box department store. I have a guy with a pick up that goes around every two weeks picking up carts. We receive calls from apartment buildings and the like and then go pick them up. It has been a problem at some of our stores, and the carts are quite expensive, so at those stores we have added wheels that lock up at the perimeter of the parking lot. It is our responsibility. Law enforcement has better things to do.
In this video the officer proved he had nothing to do and waited an hour, the other 35 minutes to retaliate.

Parking directly against traffic like that should be unlawful for police unless it's an actual emergency and their lights are on.
Unfortunately in NYS cops can legally do what they want, as long as they say they are doing it, on duty, as long as the cop is directing himself to do it. The only possible exception would be to prove that the cop is not behaving in his official capacity, like the Civil Rights Lawyer got the Family court judge search case.

He had to prove she was acting out of her official capacity bc he was trying to sue her civilly and need to get around her judicial immunity. I'm not trying to say that people should be able to sue cops if they see them parked like this, unless someone ends up injured as a direct result of the cop's negligence. Police also can not legally do whatever they want "as long as the cop is directing himself to do it." That's not even a thing. They legally are not allowed to "do what they want" as long as they're on duty, but I do believe they're allowed to park like this when responding to even the most mundane call for service. The risk to the public over shopping carts is not justified and should be addressed. However, they can make all the laws they want that dictate the conduct and procedure for police, but without anyone to enforce them, it's all but pointless. Whoever gave the police departments the legal authority to police themselves should be tarred and feathered, and then give the police someone independent of the department to oversee them that has the legal authority to press charges against them and make maintaining that job be dependent on their results, with no connections to the department that would give them reason to look the other way. Create the position(s) in a way where they will not be able to like each other.

Edit for clarification- Double parking is when a car is already parked legally on the side of the road, and another person parks in the roadway. (Their passenger door next to the driver's door of the parked car.) This also applies to stopping or standing. (Usually meaning loading or unloading goods or passengers.) The statute you were quoting basically means you can't stop in the middle of the street for any reason, just because there isn't an open parking space on the side of the street.
