Ma'am in "due process of law" question, it's asking "in essence" what does "due process of law" mean: They are asking the meaning and not other associated principle. The principle of Natural justice is one of the jurisprudence or we can say one of the facet of "due process of law" and not "ITS MEANING IN ESSENCE". With that logic, "Procedure established by law" also becomes correct because in Menika gandhi case, SC Expanded the scope of "Procedure established by law" by incorporating the principle of "DUE PROCESS OF LAW" under Article 21. And that does not mean that the meaning of "due process of law" becomes "Procedure established by law". So in my opinion, the answer should be "C" that is fair application of law. A very good example in this regard is "Sedition law". The law itself is constitutionally valid but it's application part by Police or other executive authority makes it unfair in most of the cases which violates Article 21 (Liberty) of a person. So Due process in essence requires fair application of law which does not curtails the liberty of an individual. In the above question option "A" "B" and "D" is in itself a principle which has wider interpretation and they are linked to each other and with "Due process of law". But here the question asked was "IN ESSENCE WHAT DOES DUE PROCESS OF LAW MEANS" So the meaning of one principle can't be some other principle. I think when it comes to application word used, it implies after formation of a law, that is the application part, if it would be fair use of law then it could have been correct, but application part if aftermath and that is not due process of law means, it means they can check validity of it even before the formation of it. So what approach we should adopt in our study so that we will be able to attempt these types of factual questions? Please guide.
