A wonderful explanation sir. I have a doubt that if a complainant of the FIR has been turned out to be the real accused,what is the state of his FIR & part II statement , Can he be called to the witness box for the chief examination in the court ???

Trial starts with framing of charges..inquiry ends and trial starts no overlapping possible...once charges are framed the case becomes static...but during trial also for some specific purpose only an investigation or inquiry can be conducted...no specific section for this purpose...during inquiry for investigation there is section 202..
When cognizable offence has happened at a different place but a person was not able to register it at that place or that place comes under different police station's jurisdiction but he goes to another police station or he is in another city or state then zero FIR is registered by the police and they leave the no. of FIR for the rightful station to which that FIR is transferred later.
Yes upon recieving the information of cognizable offence, police can reach the place to investigate the matter and then register the FIR and mention his proceedings in daily diary or he can first mention it in daily diary and go to the place and then register FIR .
Q: If Institution of Uniform (Police Department), who is constitutionally governed to follow the Rule of Law in relation to performing his/ her duties to ordinary citizens, which is an acceptable mechanism (Tax Payers Benefits for security) for registering FIR, Charge Sheet, Police Investigation, etc. is appropriately NOT performed. However, in 26 riots cases of Gujarat 2002 and Delhi Riots 2020, citizens belongs to minority communities are inappropriately apprehended, and proper FIR, Chargesheetes are not take care due to indulgence of right wing politicians and phone calls from respective Home Departments, CMs, PMO, accused belong to majority communities are given soft corners with Evidence Act, which results in exonerated at the stage of judicial level. Students/ researchers could review all Police Papers vis-a-vis judicial papers for an honest review in terms of Constitutional Governance!
