Suing the government also tends to be unnecessarily hard. That is something that needs to be fixed. However, what you are saying is pure speculation. The family have the choice of going after the big bucks and deep pockets by suing the agency of suing the agent personally under civil rights law. If they sue the agent, the agency may not pay for or provide the defense and may not pay the judgement. But, that limits the amount the family can collect to his assets or what they attach of his future wages. Most people and attorneys choose to go after the larger payout.

I feel it's an actual crime: You've got the government who hires people from the population to do a public service, and they become the opposite..a public menace. This happens all over the country everyday. I have bartended from Miami to California for 30 years. They messed up. But got lucky with the judge. That's why you train your people better. Alot of places won't even let children Within 15ft of a bar or were alcohol is served for this reason.
Yep. I know of an alcohol dispensary where you have to manually be let in by the cashier and they card at the door and another that’s got a gas station attached. The upstairs level is where the alcohol is. They’re so careful that they have it where you have to be carded inside the gas station portion and stamped before going back outside and entering through a different door that you have to be buzzed into by the gas station cashier to be able to even look at the alcohol. If you have a minor with you they won’t let you in. The minor has to either sit inside the gas station deli booths or go sit in the person’s car. They’d lose a lot more than $5K if they got shut down until a court hearing.

As someone from Tn, even considering most regular people being very polite or hospitable in most places, the literal worst problem for almost every single county and the entire state is their local and federal government officials and state and local police departments. It's almost like every single person will wake up with every intention of using all means they possibly can to harass, fine, punish and criminalize any resident or even those simply passing through with as many possible infractions or crimes as possible for every interaction. Never carry over a few hundred dollars in cash. The local police will be the first people to remove your cash, because if you are not possibly doing anything wrong, you can simply sue them in court, and if you do, then they'll just send the money up to another higher government agency and claim ignorance, even if the judge demands or jails them with contempt. They know they have qualified immunity, so the police and local officials can and will use those powers to take possession of any potential assets that may bring some financial benefits for themselves while making it look like it's beneficial for the state or county.

They went in there with a minor in tow. So this was a deliberate and premeditated action which is counter to their statement that "This is not our usual practices or high standards of enforcement". They've done this more than once. They just got caught on video this time.
The statement from ABC indicates they are a professional organization and this event is not reflective of their standards. Given this statement the ABC needs to reimburse these people for the costs they incurred as a result of this situation.

We were trained (including at the TLETA and by the department) that we were legally obligated to arrest people we suspected of a DUI even if they passed the field sobriety test and blew a 0.00. I manage a tobacco shop in PA and due to the various products, that we legally sell, the state is constantly trying to get us to sell to minors in a multitude of ways. All are deceitful and illegal. Our employees are vigilant for any and all underage sale attempts and we do stop the sales if we suspect it.
Two years ago, my 16 y/o son went with me into the liquor store, as I wanted to surprise my wife with a new peach whiskey. He asked what I was getting and I told him he'd see soon enough. When I grabbed it from the shelf, he nodded and said "ah, yep that's for mom". When I went to pay, they ask for his ID, but as he didn't have a permit or license yet, I wasn't able to provide, so they refused sale even though it was my son. The girl kept apologizing, but said it looked like he acknowledged I was buying the right one he wanted and that she could be fine. It sucked for me to have to leave without the purchase, as it was the only store in town (30 minute drive to the next), but I told her I wasn't upset and completely understood. That was the first time I ever had an issue with any of my kids in the store with me, but you can bet from then on he stayed in the vehicle!
Yep. Can confirm. A few years back I was in line behind a kid trying to buy tobacco at a quickie-mart. He had a passport but it was expired although it indicated that he was old enough to make the purchase. Clerk refused and the kid kept whining and cajoling until the clerk told him to leave. Then another guy came forward and identified them as both part of a sting operation. Every one in the store was pissed off and just stared at these two assholes until they wisely took off.
This is why I consider the government busy bodies leeches - $5K fine, how many people would spend $40K to deal with it, most would just pay the $5K and complain. The leeches know this, and do their best to keep their pockets lined with their theft. They'd rather us lose good businesses like this than find work that is actually productive and contributes to society, because that might require some effort on their part.
This also shows how inefficient our legal system is. This should have been an easy court case. Likely the ABC stretched the legal proceedings out to run up the bill for the retail store. That keeps others from standing up to their (ABC) corruption.

I work in retail and have had stings when a minor paid by the sheriffs office comes in and tries to buy alcohol. We always check ID so never get busted but my question is, how is it legal for the sheriffs office to pay a minor to commit a crime?

Creeps. This happened locally here, too. An undercover cop came into a place with a 20 yo guy and both sat together at a table (kid was big, full beard, etc.). The waitress recognized the cop from an alcohol related training event several months earlier (he was representing local PD). She made small talk about event with cop and took their orders. Busted. City refused to drop the charges of serving minor even though she stated that she trusted a known local cop wouldn't allow underage drinking and the kid looked 25. Moral of the story? Never trust a cop.
That's why when I worked at a grocery store we were required to card anybody that appeared to be under the age of 30. Now, everybody has to get carded whenever they are trying to buy age restricted items. The kid may have looked 25, but that still doesn't get you off the hook.
They are so dedicated to professionalism at the ABC that even after losing a lawsuit, even after admitting they were wrong, they won’t say if they are disciplining the agents who they admit were wrong and fought porch and nail in court to justify their actions costing this family tens of thousands of dollars. As someone from Tn, even considering most regular people being very polite or hospitable in most places, the literal worst problem for almost every single county and the entire state is their local and federal government officials and state and local police departments. It's almost like every single person will wake up with every intention of using all means they possibly can to harass, fine, punish and criminalize any resident or even those simply passing through with as many possible infractions or crimes as possible for every interaction. Never carry over a few hundred dollars in cash. The local police will be the first people to remove your cash, because if you are not possibly doing anything wrong, you can simply sue them in court, and if you do, then they'll just send the money up to another higher government agency and claim ignorance, even if the judge demands or jails them with contempt. They know they have qualified immunity, so the police and local officials can and will use those powers to take possession of any potential assets that may bring some financial benefits for themselves while making it look like it's beneficial for the state or county.

I manage a tobacco shop in PA and due to the various products, that we legally sell, the state is constantly trying to get us to sell to minors in a multitude of ways. All are deceitful and illegal. Our employees are vigilant for any and all underage sale attempts and we do stop the sales if we suspect it.
Two years ago, my 16 y/o son went with me into the liquor store, as I wanted to surprise my wife with a new peach whiskey. He asked what I was getting and I told him he'd see soon enough. When I grabbed it from the shelf, he nodded and said "ah, yep that's for mom". When I went to pay, they ask for his ID, but as he didn't have a permit or license yet, I wasn't able to provide, so they refused sale even though it was my son. The girl kept apologizing, but said it looked like he acknowledged I was buying the right one he wanted and that she could be fine. It sucked for me to have to leave without the purchase, as it was the only store in town (30 minute drive to the next), but I told her I wasn't upset and completely understood. That was the first time I ever had an issue with any of my kids in the store with me, but you can bet from then on he stayed in the vehicle!
Yep. Can confirm. A few years back I was in line behind a kid trying to buy tobacco at a quickie-mart. He had a passport but it was expired although it indicated that he was old enough to make the purchase. Clerk refused and the kid kept whining and cajoling until the clerk told him to leave. Then another guy came forward and identified them as both part of a sting operation. Every one in the store was pissed off and just stared at these two assholes until they wisely took off.

This is why I consider the government busy bodies leeches - $5K fine, how many people would spend $40K to deal with it, most would just pay the $5K and complain.
The leeches know this, and do their best to keep their pockets lined with their theft. They'd rather us lose good businesses like this than find work that is actually productive and contributes to society, because that might require some effort on their part.
Other states charge less than $1,000.00 for this type of violation. It's nothing but a Racket!
This also shows how inefficient our legal system is. This should have been an easy court case. Likely the ABC stretched the legal proceedings out to run up the bill for the retail store. That keeps others from standing up to their (ABC) corruption.

I work in retail and have had stings when a minor paid by the sheriffs office comes in and tries to buy alcohol. We always check ID so never get busted but my question is, how is it legal for the sheriffs office to pay a minor to commit a crime?

Creeps. This happened locally here, too. An undercover cop came into a place with a 20 yo guy and both sat together at a table (kid was big, full beard, etc.). The waitress recognized the cop from an alcohol related training event several months earlier (he was representing local PD). She made small talk about event with cop and took their orders. Busted. City refused to drop the charges of serving minor even though she stated that she trusted a known local cop wouldn't allow underage drinking and the kid looked 25. Moral of the story? Never trust a cop.
Cops are sworn liars who have qualified immunity.
That's why when I worked at a grocery store we were required to card anybody that appeared to be under the age of 30. Now, everybody has to get carded whenever they are trying to buy age restricted items. The kid may have looked 25, but that still doesn't get you off the hook.
