चार्ज शीट एवं क्लोजर रिपोर्ट में क्या अंतर होता है,what is the charge sheet and closure report.

in this video I am explaining about the difference between the charge sheet and the closure report. when any offences registered under section 154 CRPC that is called the first information report after investigation the investigating officer found that some offences made out by evidence final report in the form of challan aur abhiyog Patra, if the offence is not made out by any evidence, that is called the closure report or FR is file before the magistrate.
इस वीडियो में यह बताया जा रहा है कि धारा 154 CRPCके रूप में रिपोर्ट दर्ज होती है, विवेचना अधिकारी मामले से संबंधित साक्ष उपलब्ध होने की दशा में चार्ज शीट,आरोप पत्र न्यायालय में प्रस्तुत कियाजाता है। इसके बाद मजिस्ट्रेट संज्ञान लेकरआरोप क। गुण दोष पर विच। रण करता है। गुण दोष पर मामले का निराकरण होने के बाद उसका प्रभाव निर्णय के रूप में आता है जिसमें दोष मुक्ति यह दोश सिद्धि हो सकती है
यदिएफआईआर के संबंध मैं मामले में कोई भी अपराध की प्रमाणिकता के संबंध में कोई साक्ष नहीं मिलती है ,तो ऐसे मामले में क्लोजर रिपोर्ट या फाइनल रिपोर्ट प्रस्तुत की जाती है ,मजिस्ट्रेट चाहे तो क्लोजर रिपोर्ट स्वीकार न करते हुए उसमें री इन्वेस्टिगेशन के ऑर्डर दे सकता है।
धारा 173 सीआरपीसी के अंतर्गत यह सारी कार्यवाही की जाती है सफिशिएंट एविडेंस आने की दशा में चालान या चार्ज शीट न्यायालय में प्रस्तुत होती है, तथा साक्ष के अभाव में मामला प्रमाणित नहीं होने पर क्लोजररिपोर्ट प्रस्तुत होती है ,जिसे मजिस्ट्रेट मान्य करता है। झूठी एफआईआर होने की दशा में मामले में ई आर magistrate के समक्ष प्रस्तुत की जाती है।
