This cause of action does not preempt or exclude other causes of action against a cheating spouse as you suggest. This does seem ridiculous to us because our society tends to view fidelity as a personal lifestyle choice. Some other cultures still hold fidelity in marriage as a matter in the common interest of the people and hold everybody accountable for any damage to that fidelity.

As a legal paraprofessional, if YOUR State allows, it Is permissible to sue the side piece. She was correct to do so. Unfortunately, her State does not allow it. In addition, she needs legal counsel to assist with compensation should she decide to divorce. She is operating under different moral standards than someone marrying in 2022. I feel sad for the plaintiff, unfortunately, many women were/are raised to focus on their marriage/kids so their entire lives revolve around their family/husband, it becomes their identity, source of income, joy, and social status. So, when that man leaves them after 40+ years it's devastating, she has no pension and must restart at 60+. I was told before I add benefits to divorce my husband because as long as I'm married to him regardless of separation, he's entitled to my benefits. I pray she's able to move on. This does seem ridiculous to us because our society tends to view fidelity as a personal lifestyle choice. Some other cultures still hold fidelity in marriage as a matter in the common interest of the people and hold everybody accountable for any damage to that fidelity.

I feel sad for the plaintiff, unfortunately, many women were/are raised to focus on their marriage/kids so their entire lives revolve around their family/husband, it becomes their identity, source of income, joy, and social status. So, when that man leaves them after 40+ years it's devastating, she has no pension and must restart at 60+. Hawaii, Mississippi, New Mexico, North Carolina, South Dakota, and Utah.

She is suing the wrong person. The defendant never made an oath to be faithful to the plaintiff. It was her husband that promised to be faithful, not this other lady. She should be suing her husband, IMHO. She has no reason to be mad at this lady. She should only be mad at her husband. SHEESH!
She has a pretty good reason to be mad at the defendant, but I agree that she should be addressing the issue with the husband since he is the one who broke their vows. It's a normal and completely natural response to be angry with the cheating spouse and the person they're cheating with. It's what you do with that anger that really matters.

Messing with a married man is wrong but the stress from your husband cheating is HIS fault not hers! She has no legal responsibility to you but he does. She's been suspecting him of cheating that long and she stayed with him so it seems she just wants money from the girl.
