    What's the difference between this and an airport situation where luggage is involved? Seems i remember a case where a suspect was detained but let go but they seized the luggage pending a search warrant?

      If an officer decided to let the person go pending a warrant that is their choice. I think you’re referring to the Supreme Court case called Place. But police don’t necessary need to do that. I think it’s a case by case decision.

      @@christophercampbell2929 hmmmm. Not necessarily. Fourth amendment applies either way.

      @BluetoGoldPolice I'm just thinking there is a different expectation of privacy at an airport, you know they're scanning your belongings, your body, looking for contraband to get in. Even with just drugs, There's agricultural issues, there's foreign relations, so many different issues. But I've never worked an airport. "Private property" was just sort of a simple answer, but that's what I was getting at. I think exigency or destruction of evidence can easily be articulated at an airport, especially since intent is to be mobile with those items. Exigency is probably more bright-line because the safety of passengers shouldn't be up for debate by a single person or even small group of people on a case by case situation thousands of times a day where there is elevated risk to hundreds or thousands of people. Even if you let them walk, property is probably being seized, searched or inventoried immediately to reduce risk of imminent danger.

    Whats the rawlings case citation? Does the same outcome (search without warrant) apply to Texas?
