    As a fellow immigration lawyer, excellent video and analysis. The only thing i would have talked about is the admin close option (to keep ead going) for those who have pending asylum and cancellation of removal cases

    If I got my case dismissed and I have already a i485 summited to uscis and I put my fingerprints for it like a year ago how long it would take for me to get my green card interview or get my physical green card without an interview?

    The judge granted my prosecutorial discretion and now I can't extend EAD. Now I am married to USC and we are planning to apply for I-130 and adjustment of status. the question is do I still have to withdraw my asylum case from the immigration court or is it not necessary?

    Thank you for this video. If a judge dismisses a xase in removal proceedings and we refile with USCIS vetting center, will the client be resent to removal proceedings once again if the vetting center denies his asylum please?

      Yes, I warn my clients that refiling an I-589 with an asylum office is most likely going to result in a referral to immigration court if denied. The answer is going to depend on the USCIS policies at the time of referral, and whether the client has some other sort of status. For example, if the client also has TPS then I wouldn't worry about a referral to immigration court. Refiling is a risk because the client might not have the option to dismiss/terminate removal proceedings in the future.

    Hi sir, asking in behalf of my cousins he apply for citizenship after everything was done like passing the exam he find out he was denied and had 90 days to appeal but couldn't do it at the times because his dad died in the middle of the process can he still reapply for an appeal wth a lawyer please.     Hello sir i didnt explain in detail why i filed asylum 5 years late in my asylum form i-589 but fortunately i got asylum receipt that my asylum form was accepted and had biometrics. I also didnt include the brief or explanation why im filing asylum late. I will do it at interview. Will this result in denial of my ead of asylum c(8) . Will uscis first check asylum form i-589 and then check and approve or deny i-765. Or i-589 form will be adjudicated at later stage and right now for ead they will only check i-765 c(8) i-589 asylum filing proof. I ll send asylum receipt to uscis while filing i-765 as proof of asylum filing

      You will still probably be able to receive your EAD. Nobody will review your asylum claim before issuing the EAD.

    I filed an asylum application with USCIS when I entered the country, but I received an NTA from DHS to deport me, but the immigration judge ordered dismissal and let me wait for an interview with USCIS, what should I do next? Do I need to refile 1589 with USCIS to reapply for asylum?

      If you qualify for asylum and the judge recently dismissed your case then you should speak with a lawyer about filing the I-589 with the asylum office. Sometimes this isn't a good idea if the chances of being granted asylum are low.

      The appeals usually take 1-2 years, and you can usually renew the work permit while it's pending.

    Hello, please, if you have an impending deportation master hearing case in the immigration and you are unmarried with no kids and you have a chronic medical condition that needs ongoing medical care that you cannot get in your home country, can the person apply for defensive asylum after nearly 7 years based on humanitarian and compassionate grounds . What other options do the person need to remain in the United States apart from marrying a US citizen? Thank you

      You must generally apply for asylum within your first year in the US, although there are exceptions.       If you're under the age of 21 you might qualify for special immigrant juvenile status. If you are older than 21 you are probably limited to marrying a US citizen or applying for a U visa if you have ever been the victim of a crime.

      No, you can't join the army until you have immigration status.

      No, you probably can't renew your work permit if the category on your work permit was "C09" because you will no longer have a pending asylum case (unless you re-file your asylum application with USCIS).

    Hi Pouyan, I arrived to US in 2005 on J1 visa, the same year I applied for Political Asylum, but I was young not speaking English well, so my case was taken together by one of LA company who making money on it, not sure I got enough proof to ask for Asylum. After my firts interview in Chicago I guess it didnt go well so all case went to the court, I show up 2 times (2006, 2007), dates was changed by my lawyer just to buy more time, but then I start working as truck driver I had terrible connection all the time, I changed my lawyer ones and finally I didnt show up at next court (was young and stupid), then after a few years ICE take me from home (2010) and I spent a few months in jail in WI and then deported to my country to Ukraine (2010). I didnt do anything criminal, I just didnt show up at the court. Now I want to migrate to Canada or maybe USA back, is there good chance for me ? Pls advice, thanks

      Yes, exactly. Many people who are seeking asylum will refile their I-589 with USCIS and apply for employment authorization after 150 days.

      This is a complicated question because voluntary departure automatically turns into a deportation order if you fail to depart the US. If you entered the US legally (or with parole) and have an approved I-130 then there might be a way to fix this.
