It is why it didn't kill Dumbledore when Snap used it - The fall killed him. But, you know, in the game mechanics and everything - They should have had a morality system for its usage.

He was quick to draw a wand on us at the Three Broomsticks in the beginning. Also don’t understand why Officer Singer’s first thought wasn’t disarming him, taking his wand as soon as she arrived on scene.

While a bullet sure is faster and easier to fire that the majority of spells (don't know if actually exist one spell faster that a bullet), it can be easily blocked (I think a protego spell casted beforehand would suffice as it can tank other spells like diffindo with the power to break or destroy objects). On the other hand, spells are fast enough to surely hit a target at medium range which is the distance where most duels happen (problem would be casting time, not the speed of the spell). And you can't easily block a spell even less an unforgivable curse (armor don't protect you from a spell effect), and if my memory doesn't fail, in the fifth book harry avoided being killed by an avada kedabra fired by Voldemort only because a massive animated statue received the hit instead of him, and even so the statue was completely destroyed.

The books tells us that spell-making is very dangeruous practice. Luna's mother was one and died in an attempt to make a new spell.
