Probably because John Terry went to court over it and was found not guilty under the rule of law. Just because the FA wanted to make an example of him and banned him anyway doesn't mean he actually committed the act.
The one i find surprising that never comes up is the schmicheal Ian Wright incident. Ferguson called Wright a race card player. He accused schmicheal of racism. Did Fergie or United ever apologise to wrighty.
