Is this learner legal? - Aprila Bike deafening all on Battersea Park Road

- On my way home tonight, I was passed by a "motorbike" with the loudest exhaust I have heard in about 5 years. Just compare it to the other bikes, esp at 01:11
It not only does this make the bike not road legal and highlights is just a crappy little learner bike - but, in this case, it makes the noise so loud as to be truly painful.
Why do people do this?
PS He also broke the law by riding over an ASL at Red - but I'm some- what resigned that far too many motorbikes do this
PPS sorry about the beeps I've had to put in, but my ears were hurting so much I couldn't stop swearing.
PPPS I've just found the guy has the bike up for sale on another website and says it has 33bhp. Is he allowed to ride it as a learner?

Oops, I mean it has to be either an RS125 or RS50, based on the pipe being on the left-hand side and single. And it has to be an RS125 if the 33bhp claim is right.
youd love america. almost everyone over hear modifies their exhaust to sound louder then hell. especially the harleys you can hear them from 3 blocks away. southpark did a great episode on it
33bhp is the limit for a rider who has just passed his test on a bike of 125cc or less, if he passed on a 500cc bike limited to 33 bhp then he would be able to ride any bike. if he had passed his test on a 125 then he can ride it as long as it ont produce more than 33 bhp. however I think this bike has a race exhaust system and doubt that it has a legal mot certificate for the exhaust fitted.
That's an Aprilia RS125, which is definitely a proper motorbike. It's obviously nowhere as fast as bigger bikes, but it'll embarrass cars 10x the price away from the lights, and it'll hold its own against bigger bikes on twisty tracks - perhaps even beat them. And yeah, it's too noisy - though, I have a bit of soft spot for the sound of 2-strokes. (I once had an Aprilia 250 with race pipes, *that* was loud at 9k to 12k rpm ;) ).
What Gaz said, it's not a "proper" motorbike, just one that the little child can ride on his crappy license with the piss poor engine made up to look like a nicer bike. Normally spotted by the stupid exhaust noise and the skinny tyres. He probably thinks he looks cool but would shit his pants on a Ducati...

All motorcyclist have had to ride 125 at some point on their trip to 'proper' bikes.
May as well go for the quickest 125 you can have!
They are good little bikes! its actually surprising how quickly it can accelerate for a 125.
Not really allowed to ride them on a cbt though.
And he clearly is a chav (not nike logo) so hes probably broken/modded it to sound so poo.
Visit us here in Holland. More then 95% of all Motorbikes/moped's etc. sound like this. I drive one myself but it's 21years old and i can't get it to produce less sound. But then again cops can't do anything because in the paper work of my motorbike it says it has no limit on the sound it makes. But i understand why you hate these things because they sound worse then hell.
this section of battersea park road is really bad. It's full of motorcyclists who don't have a clue, riding up on their fart gas machines from the suburbs, they don't care about the noise limits, or the pollution limits, or the speed limits, or respecting anybodies life at all. They undertake and careen away from red lights forcing the locals to scatter. People come in on those awful machines at 0530 waking up thousands of people. But they don't care. They're aggression personified.
