    Mr Datar, small businesses were easily escaping the taxation and hoarded black money for decades. Now they are brought under the radar.
    Also till now the so called learned people of India never even bothered to look at restaurant bills where even Non-AC stinky hotels used to charge 15-20 % tax in the name of Service charge. Now they shouldnt do that. Its all transparent.
    Also this Govt made you aware of looking at the tax in your bill, which is a big achievement in itself.

    Both the opposition and the government agreed to each and every article of the GST. The Congress and the opposition were trying to get this tax reform on the floor from the past 10 years.
    The only problem with this tax is, that it is almost leak proof, so no hiding tax. That's the pain.
    The positive thing is that the near future it will reduce the burden of the salaried middle class class by expanding the tax net.

    The saddest part of GST in India is that the baby formula is taxed at 18% while condoms are taxed at 5%. Dosa batter is taxed at 18% while pizza has a tax of 5%. What an anti national GST this is which prefers condoms over country's future and foreign fast food over Indian homemade meal.

      Suchindranath Aiyer fully agreed... gst is not coming with same platform as the idea was expected... some things are smoother...but a lot things are messy...and I personally feel gst will also cause cascading...

      +pawarvs I would never vote Khangress. Raoul or anybody. Please remember that GST passed with the support of the Khangress Parivar that loots together to stay together. Modi's deliberative democracy, Padma vi Bhushan to Sharad Pawar, induction of SM Krishna giving Jailtey yet another barrel to fire from, non prosecution of VIPs for corruption and so on are signs of Modi becoming another Khangress clone. One looks from pig to man and man to pig and cannot say which is which.

    The GST allows input tax credit across IGST, CGST and SGST. Thus a retailer selling bike can claim input credit and therefore lower prices and therefore higher consumption and GDP.

    CGST, SGST, TN adds entertainment tax on 4th July 2017 in addition to SGST. Maharashtra increase registration tax on 4th July in addition to SGST.
    so taxes in India after 1st July, CGST, SGST, entertainment Tax, Registration Tax, and any other tax the State government wants to add.

      If India is not ready for GST.. I wonder was India ready for IT mid 1990 and look where is India today in IT..
      On one side you appreciate idea of GST (single tax for multiple taxes) but you have problem with how govt is implementing GST in India (even after knowing the facts/complications that Mr. Datar stated like power of state and centre has on levying taxes)
      Don't be hypocrat either you appreciate GST or don't..
      Also with all respect to Mr. Datar he must get clarity on how GST is implemented in other countries.. he only stated points proving his thoughts.

    Around 6 minutes 30 seconds, you compared Post-GST's 49 (36 GST + 12 TDS + 1 Annual) returns vs Pre-GST's 2 (2 Service Tax) returns in case of a service provider. I would like to point out that Pre-GST returns were 6 (2 Service Tax and 4 TDS) and not 2.

      The following are the specified person (s) who are liable to deduct TDS:
      An Individual or an H.U.F. is not liable to deduct TDS on such payment except where the individual or H.U.F. is carrying on a business/profession where accounts are required to be audited u/s 44AB, in the immediately preceding financial year.
      A person is liable to get its accounts audited u/s 44AB if during the relevant financial year its gross sales, turnover or gross receipts exceeds Rs. 1 Crore in case of a business, or Rs. 50 lacs in case of a profession.

      CA. Anirudh Bagai ACA, LLB sir you're partly correct, the TDS returns you mentioned are the ones under the IT act, which have to be filed by all tax audit persons be it a manufacturer, retailer, wholesaler or service provider.
      but here, the 12 TDS returns are under the GST act, which is applicable only for supply of goods/services above 2.5 lakhs and only for specific goods/services, yet to be notified.
      these two TDS return types are completely distinct, please don't merge them together.

    Why petrol and diesel prices are not brought under GST. Now for petrol and diesel the central exise duty is 23% and state VAT is 34%. Total tax is 57%. If these essential products are brought under GST , the maximum tax will be only 28%, which means the prices of petrol and diesel can come down by almost 50%. The public at large will be benefited. Please spread this message .

    Can any one tell me why a diagnostic center is filling 36 returns of 12 returns each on 10, 15 and 20 per month and 12 more Tedious returns , what is a tedious return ? . And why is he filing only 2 returns right now. How did the value 12 come into play here.

    Mr. Datar,
    you are perfect in telling the gathering of intellectuals that what the GST holds for them in future but nobody is bothered. The addition of 2 percent is simply baseless & idiotic. The most serious problem is in relation to exports where refunds replace exemption. The world is not foolish to work with exemptions under the aegis of WTO. Refunds are simply unworkable because they are a distortion, capital is very costly in this country, there is no free lunch & this gives bureaucracy a chance to hold the businesses to a ransom. It is rather unfortunate that no business leader has spine to call spade a spade & stop singing praises of the impending disaster. Last but not the least important is the missing infrastructure therefore the system without a trial run is going to create chaos & wreak a havoc because I believe nobody has a magic wand in the government.

    I am astonished to hear this from Datar. He has clearly not understood what CST is all about, and so have the majority of commentators on this video. in essence, both you and Mr Datar have failed to see the bigger picture in the Indian context of simplyfying the tax, removing the bottlenecks in the transport of goods across the country, the elimination of corruption at these toll nakas and bringing a sense on oneness amongst Indians. I am on the winning side, you are on the losing side in this debate, live with it. And now that CST is operational, embrace it and move forward WITH the country.

    I have a question and i would like answer on it. Let me put up my question through an example to simplify it.
    I went to a hotel for a coffee. The rate was INR 40/-. This incident I want to explain is when the GST was implemented and the GST was 18% (9% local + 9% center). I got the bill of 40 + 7.20 = 47.20 total. I paid the bill at counter and asked how old was the menu card printed and the rate not being changed. I came to know it was about 2 yrs old.
    Now I want to understand that when that menu card was printed there was no GST implemented. But on products like coffee, sugar, milk there must be some sort of taxes like excise, VAT, octroi (where applicable). So the question that came to my mind was why the actual product rate never decrease as those taxes are now out and if GST has simplified and lessen the tax burden than that coffee rate should be like 30 to 35 and than 18% GST implemented.
    Still today I see the rates are same as before the GST and on top of that GST is implemented. When will the actual effect of GST come in play and which government body or sub-body is responsible and on the field to that and show the result in numbers.

    The economy is so down today, the reason can be easily connected to GST, its compliance issues, the government has gone thinking that the high rate would budget its expenses, what actually happened was that it reduced the demand so much that we are heading into recession...... Let Mukeshbhai (RIL) run the tax department, I am sure that he shall reduce rates and increase volume and remove compliance bottlenecks to spurt the economy back on track....

    Good points. My main concern is the lack of digital infrastructure for it's implementation. Amp up your data speed. Long delays in exchange of service is expected.

    I 100% convinced by Mr. Datar. In my opinion State VAT Laws are not success and GST is nothing new but it is a Nationwide VAT. State VAT laws are unsuccessful in absence of proper infrastructure i.e. Computerization. Our view is, Center must go through the reasons of failure of State wide VAT system thereafter introduce GST.

    I had said so the moment Modi spoke about his "Deliberative Democracy". All that Modi and his Parivar that loots together to stay together (SC/ST/BC/OBC/MLA/MP/IAS/IPS/IRS/IFS etc ) did was to increase the taxes and procedural opportunities for extorting "bribes. This was never GST. To begin with or end with!

    Finally, the contours of the Goods and Services Tax (GST) regime has become clear with the two-day session of the GST Council at Srinagar coming to an end on 19 May (Friday). The GST Council has largely worked out the details of the fixation of the items to the four-fold tax-structure (0 percent, 5 percent, 12 percent, 18 percent and 28 percent) that has been agreed upon.
    We have now effectively a five-fold tax structure if we take into consideration the fact that the so-called ‘sin’ goods or ‘demerit’ goods are still outside the purview of the GST.
    As such, if we take into account only the four rates that have been agreed upon by the GST Council, how does it compare with the other nations of the world, rich or poor, who have implemented a GST regime?
    Well, with 28 percent as the highest taxation slab in our scheme of things, we acquire the dubious distinction of the most taxed country as far as the indirect taxes are concerned.
    Let us do a brief comparison. Let us first focus on some outliers.Reuters
    Saudi Arabia, the oil rich country, has no consumption tax regime (bliss for the consumers). Singapore, the city-state, has a standard 7 percent taxation structure. And, Switzerland, the traveller’s paradise, has a standard rate of 8 percent, with the reduced rate of 4 percent for hotel accommodation.
    Let us then take, for example a country like Australia where the 10 percent tax rate applies to all goods and services eligible for tax. Indonesia too has a standard 10 percent tax rate, with a stipulation that some goods would attract 15 percent tax and others 5 percent tax. South Korea again has a standard rate of 10 percent.
    Japan is, of course, a rich country and it has a standard consumption tax of 8 percent. But the Japanese government has announced that the GST rate would increase to 10 percent effective from October 1, 2019 (this is unlike our country where the rulers decide and increase the tax rate overnight at their whims).
    Canada is one country where a two-tier GST regime has been laid out. The federal tax is fixed at 5 percent and the states have been given the option to decide on a standard rate. Two states there have chosen to levy no additional tax and four states have decided on a maximum 10 percent tax. Other states fall in between. Citizens of Canada pay between 5 percent and 15 percent of consumption tax, depending on where they live.
    Let us now take a look at the European countries. Even the Scandinavian countries, best known for the social welfare oriented economies, have the highest GST rate of 25 percent, with many average consumer utilities charged at a lower rate. Sweden, for example, charges 12 percent for hotel accommodation and restaurant food (our stipulated rate is 28 percent for the higher category and 18 percent for the lower category). Sweden charges just 6 percent for cinema (we have stipulated 28 percent tax for it).
    Netherlands has a highest GST rate pegged at 21 percent, but most consumer utility items such as domestic passenger transport, hotel accommodation, restaurants and entertainment activities etc are covered under the only other taxation category - that of 6 percent.
    The United Kingdom has been in the news for some time for the economic distress that has led to increase in taxation across the board, but even after the increase its standard GST rate is 20 percent and the only other slab of 5 percent covers supplies of electricity, LPG etc. What is important to note that in the UK no tax is levied on household water supplies, food stuff (including processed or pre-cooked food), domestic and international passenger transport, construction of residential buildings etc (compare this with how much tax we have to pay in our country for such items).
    Greece, another European country in the news for its economic meltdown, has the highest GST rate of 24 percent and reduced rate of 13 percent and 6 percent for various categories of goods and services.
    Argentina, the Latin American country struggling with its economic woes for decades, is the only state which, with a 27 percent highest slab GST rate, is just a notch below our 28 percent. But that is a small consolation for us who are aspiring to be an economic superpower in the years to come.
    We should compare ourselves with the country which is mostly on our radar in the sphere of economic competition, i.e. China. China has the highest GST rate of 17 percent, with seven different rates for a range of goods and services. What is significant is that it levies just 11 percent tax for entertainment (cinemas and the like) and restaurants (we have stipulated 28 percent for cinemas and five-star hotels and 18 percent for other restaurants).
    What is still more noteworthy is that China has fixed 6 percent tax rate for financial services, insurances, and telecom services. And what have we done? We have fixed the rate of 18 percent for all these services - which is 300 percent higher compared to that of China.
    Is there anything to save our face? There is none even when we look around us - the smaller countries in our neighbourhood. Bangladesh, for example, has the highest rate of 15 percent, with seven reduced rates for varying goods and services. The other island country in our neighbourhood, Sri Lanka, has again the standard and only GST rate of 15 percent.
    Even our bedevilled neighbour, Pakistan, has the highest sales tax rate of 17 percent, with four reduced tiers of taxation. The tiny Himalayan neighbour, Nepal, has a standard and only rate of 13 percent.
    Our finance ministers (union and state) may gloat over the fact that they have devised tax rates that would not increase the burden on the average taxpayer, but that would also greatly depend on whether the companies would actually pass on to the end-consumers the benefits of the input credit that they would get in the new GST regime.
    But what is more important for us, the citizens, is to cogitate on this: Do we deserve to live in the most-taxed country in the democratic comity of the nations?
    It would have a welcome move for us had the distinction of the highest tax rate been attained as regards the direct taxes because such taxes are progressive and citizens pay according to their income and wealth.
    But the GST is an indirect tax, which is necessarily regressive -- every citizen, rich or poor, pays the same rate of tax.
    That is why the test for a nation that is pro-poor is: it pegs the indirect taxes as low as possible. We have clearly failed that test miserably, as we have happily created a GST regime with a taxation structure that is highest in the democratic world.

The head of a prosperous family of Sikh transport operators (they drove the trucks themselves) based in Hoshiarpur old me in 1977, that they did not pay tax because the Government does nothing for them. They do not even have proper roads or traffic management ad regulation. If one of the boys lost his legs in a Government created accident, would the Government pay for quality medical facilities and make good the loss of income? Certainly not. Everybody from President of India to lowest peon is corrupt. Why pay taxes when you have to pay bribes.
      Look at Banking today. We are being forced to pay all sorts of arbitrary charges with no appeal to compensate for the enormous profligacy of the Neta-Babu-Banker-Crony rascals who have stolen away our wealth in return for "Non Performing Assets"!

Increasing the number of non productive persons on Government and Quasi Government Pay and Corruption Roll?
      Since the days of ancient Athens, every democracy achieves mediocrity. if, unlike "Commonwealth" countries like India, Pakistan, Kenya, South Africa, Australia, Zimbabwe, Canada, Nigeria and so on, they are not fortunate enough to be born into mediocrity or sub humanity.
      "Democracy" plays to the lumpen to get the votes. It dumbs down the lumpen to retain those votes. Either through propaganda in the short term or by agnotology and corrupting education in the long term. It garners wealth into the hands of the powerful to perpetuate their own pomp, pelf, pleasure, and perpetuation at the expense of the many and builds nations weaker in intellect and moral fiber than the ruling class which then throws up the next generation of rulers of still lower intellect and moral fiber in a reflexive and downward spiral. (Justin Trudeau, Rahul Gandhi and Prince Charles are the more egregious examples).
      India's most significant democratic achievement in Seventy Years has been the inability to produce a single President or Presidential candidate of Eminence and Integrity.
      And so, inevitably, democracies collapse until redeemed through conquest by an authoritarian and barbaric force (such as Communism, Islam, Fascism or some other Imperial force) to commence the next journey towards appeasing the slaves, then the serfs, then subjects, and then, perhaps, citizens if they get that far into "democracy".
      At the root of the problem is the unfailing corruption of all States through inequality under law and exceptions to the rule of law through lawful or unlawful (but winked at) means and the tendency of People to prey on others and betters while eliminating the principle so well enunciated in the Brahmin Prathamo Upanishad "None may be happy while any are unhappy"

    There are problems of implementation and filling returns but not agreed with him totally.. Their might be initial hiccups but going farward it can be customised....5 slabs 0 to 28 % can easily be reduced to 3 but keeping grain and SUV in same tax slab cannot make a sense...tax evaders will never like it at all..

    A dissenting view always needs serious consideration. But, prospect of living with 30 plus VAT laws is worse than GST's problems. Perhaps the government can reduce monthly returns to quarterly returns for reducing the compliance burden.

    The government has very well explained the taxation system to us. But have they explained us what the heck they are doing with the tax collected from us??? Is there really any improvement in the infrastructure, medicine, education system, even in our basic needs etc??? And what the heck is this cashless system?? What if our account is hacked??? Also has demonetisation done any good to us??? Why havent they given any account on what they have done with the black money collected??

    In the present VAT, the Tax structure on a particular product differed from State to State, whereas under the GST the Tax is uniform of any particular product. There were any number of other Taxes levied b the State and Central Govts., Under the GST the uniform VAT rate and all other service taxes etc and duties have been consolidated oin the GST.
    The wisdom of the GST Council comprising of all Sates and the Centre has been challenged by the personal opinion of an individual... Comparing the GST of Singapore, a city State and the GST of India which has 29 States and the Central Government...
    The earlier UPA Govt at the Centre attempted but due to resistance of some State Govts, the GST could not be passed in the Parliament and the State Assemblies.
    Finally, during the present NDA Govt., all State Govts (comprising of various political parties) and the Centre (NDA) managed to pass the GST Bill.

    I don't understnd, this guy is saying 20 lakhs limit in service tax means, more companies will be created in different names, right now 10 lakhs is the limit, only now are there more companies being registered in different names, to be honest, with 20 lakhs limit, the creation of fake companies will come down!! Actually majority of small scale industries I know, are breathing a sigh of relief, for the exemption being increased from 10L to 20L!!

    Thanks sir .As for as middle class people any tax is hard on us,particularly charging GST on medicine, Mediclaim is terrible.On all senior citizens in Mediclaim already the amount is very heavy charged by all insurece companies.for example Apolomunich is charged actual amount health insurance is 22,000 appreciate for my wife aged 62 years for this GST is 4500 nearabot 40 percent. And service tax and all came to rs29,585.i normally advise my family instead have a RD account keep seperate for mediclaim.this will serve ourpupose if we won't fall sick atleast this money help us.but in Mediclaim all will go to the insurance company.we all Indian people's were created and we are very helpless.
