From Arrest To Release: A Broken Justice System?

  • Touch me, and you'll rot in jail! Not so fast...
In this eye-opening video, I delve into the harsh reality of the justice system, where suspects of crimes often evade significant consequences, leaving victims but even the Police feeling powerless and frustrated.
Despite promises of justice, the stark truth is that incarceration (jail time) rarely becomes a reality for those accused. I explain the process after arrest such as conditions of release, and the disillusionment victims face as their perpetrators seemingly walk away unscathed.
But it's not all despair; I also offer insights on how you can engage and advocate for change, empowering both individuals and communities to push for a more fair and effective justice system.
If you have anything to add, please leave a comment. I read every single one and I respond when appropriate.

I came forward after 10 years of violent Domestic Abuse. He was charged with 6 counts by Toront Police. He didn't spend a day in jail. He's on a restraining order. Big DEAL! He got the best lawyers and got off his charges. Toronto Police couldn't do much more and either could the CROWN. He destroyed my life😢

Our justice system has been broken for a while now. Kinda sad how these criminals get away with things, and not take accountability for it, or responsibility for their own mistakes of their actions. It’s like they get a free slap on the hand or wrist and that’s it, back on the streets doing more crimes.
Thanks again for the video Randy! Please keep continuing to doing more. 🙏🏼

Great video Randall. Great advice, I agree Police and victims of crime need to join forces and advocate together to make this change. I never really gave much though that we can actually get involved in polices that the judges follow. Ron Chhinzer is doing a great job bringing this subject to light as well on his twitter.

Thank you for this video. I was assaulted 18 months ago. The guy spent one night in jail before being let out on conditions (which he has broken in previous charges). Now I am getting pushed around the legal system as he keeps delaying and delaying. We were supposed to go to court next week and now it may not be until next fall or winter. I feel like I have been the one in jail. I can’t leave my house or hang out with friends for fear of running in to him. He spent last summer living on a boat. It’s ridiculous! As you stated, I am a first time victim and at every turn, hospital, police, victim services, lawyers and the crown have let me down. I found out He has had 38 previous convictions and is out living his life! My life has forever changed. I have completely lost faith in the fact that the system, or anyone for that matter, is there to protect my rights and my safety. Thank you for doing what you are doing. I will look for some of those groups and see what I can do to make a change for the next person he assaults.

A sad but true account of our justice system. One aspect that has been very public and recent is the sad state of affairs surrounding auto theft and how long it has taken to make incremental progress with this issue. Sadly politicians may abdicate their responsibility and blame manufacturers when other issues surrounding this topic actually prevent the police from doing their jobs. Justice reform is very much needed.

After serving time on Jury Duty and also being witness to the Crown on a murder case I can wholeheartedly attest to the fact that our Justice System is broken and will not protect the law abiding Canadians. This is not to say that the Police will not try and do their part. The system and jails are not sufficient to deal with the current levels of crime and most of that rests with politicians who do not fund jails and rehabilitation centers the way they should. Diversion programs work if the future criminal is treated early and shown the lawful path. These programs are grossly underfunded and under staffed. For those hardened criminals that rehabilitation does not work on stop the current catch and release program that all governments currently practice. For theses types lock them up and throw away the key. Just my two cents worth feel free to disagree as we still currently live in a free nation.

Hey Randall! Love the video and totally agree. I currently work inside an ontario Correctional Center in Southern ontario on the intake unit. I see every inmate that comes into the correctional center. Within a calendar year I see many individuals come in upwards of 4-6 times. Some on new charges, fail to comply, breach and so on. Their behavior during incarceration is any better either. Theres been times where ive personally escorted someone to admitting and discharge to be released only to see him back within days. I often ask them why they're back and they just laugh and say , " breach of conditions or a new charge" and the cycle goes on and on. With the current inmate population being astronomically high within the prison system at this current time. Most inmates are getting time knocked off sentences due to lock downs and lack of staffing and I believe itll get worst before it gets better.

I have no idea why police now have to let some suspects go after the suspect agrees to certain conditions. I wonder if it's because jails/prisons were too full.
The justice system does need to be overhauled. But the last time the federal government under PM Harper tried to make a change in changing prison time prior to trial to 1 day per day served from 1 and a half day for each day served, the justices ignored the legislation saying that the government and justice have to remain 2 separate entities.
When my daughter was 16 and assaulted, the justice system totally failed her. The creep lived beside us with his parents and the judge gave him permission to visit them yet still have to stay 200 m away from her and any schools. The crosswalk for the elementary school (that was less than 200 m from his parents house) started on their boulevard. The judge refused to let me speak about this.

I was a victim of a stalker who was a customer where I worked back in 2008. He ended up spending some time in jail but then got a call he was released (maybe 6 months later). There was an order that he had to stay away from my workplace and not contact me. After i was told, i've never heard back from the detective. Is that normal? No idea if hes alive or dead but constantly fearing i will bump into him. This is why i refuse to have a profile picture on my instagram and facebook so my photo doesnt appear in google search if you search my name.

I can understand releasing a suspect w conditions as long as it's not serious crime or a repeat offense that is causing harm
I understand there are circumstances w each case but hoping the repeaters are monitored closely or have to do some community service Just letting them out and they do the crime again say auto theft or drugs is not helping anyone especially the suspect IMO

Yes there is a problem with the current catch and release program but sometimes people SHOULD BE released. Let's not try to "fix" the problem by creating another one. Locking up otherwise law abiding people because of an isolated incident in their lives is an extremely bad idea too.

When you mention repeat offenders, it falls under the category of "irresistible impulse". That could land in a psychiatric concept. Come think of it.
As for terms and conditions set by cops, it's just as bad as the "faint hope" clause for murderers. I feel if it's a first offense, OK. Anyone else, repeat offfender rate is through the roof (just speculation on my end).
I see nothing wrong (bit off topic here) using pressure points when arresting suspects so you have a window of a few seconds to arrest the suspect peacefully.

    • @OfficerArsenault
      @OfficerArsenault  6 месяцев назад

The only problem is that not enough officers train physically enough to even know or attempt certain methods which would actually cut down on injuries during arrest. And as far as your first part, that’s a good point, really something to consider. I appreciate the input 🙏🏼

I have learned first hand that the only people the current justice system benefits is the accused. If your a victim you are in for a rude awakening because there is no justice or support for you. Never in a million years would I have thought that until I got to experience it first hand.
Releasing someone on conditions is a joke as they next to never abides by them. Even when they go against those conditions they get off. Restraining orders are nice to have in place but honestly a waste of paper. The accused continues to do what they want because they know they will continue to get away with it. While the victim and their families lives are destroyed.
So, yes the justice system if we can call it that, not only needs an overhaul but a complete rebuild. Not only in the criminal sector either.
