    "Dismissed with prejudice" means that dismissal is permanent. There will be no refiling for the government, and the Bundys can't sue the government after that dismissal. It indicates MUCH MORE than a technicality but normally that the case was harassing or frivolous in nature or based on some unfair bias.

    I love the fact that when you do so much research wherever you go and tell about the locations. I think it would be amazing to travel with you someday but I'm 73 now and my hiking days have long since past. Now I travel vicariously thru you.     Harry Reid had a lot to do with trying to remove the Bundies from the land. He had a deal going on to lease the land for solar energy farms. The whole thing was Reid forcing his will over the ranchers

    The bulldozers were there to bury the carcass of the cattle, they were not there to impound his cattle. They were there to remove his reason to be there.

      Bundy's showed up to retrieve their cattle and the Feds were refusing to let them have them , that's when everything started getting tense .

    I appreciate that you did your research and in fairness presented the information that was available. Too many folk believe that these lands are government owned and nothing could be further from the truth. Public lands belong to we the people and not the government.

    "With Prejudice" means that it is final and you cannot refile and start over. Misbehavior by the prosecution is a serious issue under law and it totally poisoned the case so the judge made this thing final.

      I was there for many of the court proceedings in Las Vegas. Judge Navarro leaned heavily toward the side of the prosecution for most of two years, but the extent of the prosecution's misbehavior in this case made it impossible to go on without leaving the government, including the judge, with major egg on its face so Navarro let it go, in her own best interest, as well as that of the various law enforcement witnesses and the US Attorney in Nevada.

    I remember when the government spent millions of dollars putting up fences along the old hiway 93 so the tortoise would not cross the roads and get hit. The fences were up for a couple of years and the government decided it was doing more harm than good and took them all down.

      Why did the tortoise cross the road?
      Gopher Turtles are protected in Florida. They dig under our fences to get to the other side.

      Cattle eat grasses&forbs; cattle poop; poop regenerates soil AND grasses/forms evolved to be grazed
      The rangeland & habitat is improved. Turtles were overpopulation Vegas gol course due lush grass, using more water than Bundy ever dreamed of, so many tortles were euthanized. If you want the story, look to the many articles in Range Magazine. She did a decent job though & her interest in this should be applauded.

    Great (unbiased) deep dive. For a different and actual account I recommend Pete Santilli's Rumble channel where he archives his shows. Pete was there, took some footage, and personally knows the people involved. You might be able to find the episode on D-Live also. Pete was also present during the Malheur Preserve incident involving Lavoy Fimnicum.

      @@XtomJamesExtra and @SteveKY 9 Wrong. They'd been using that land for decades...then all of a sudden the law was changed, and by a bureaucracy at that. That's simply federal
      government over reach it is not federal soil, it is part of an individual state. And that state should have been allowed to weigh in. I can't remember any time that
      that state uttered one word one way or another. Had the state been allowed input, the whole thing would have probably a lot different. Each state should decide
      what should be protected and what shouldn't.

      @@tomfrye9037 He was using that land under a lease, it wasn't his to do with as he pleased. His lease wasn't renewed, but he continued to use it anyways.
      Imagine if you were a landlord and you leased an apartment. You had a lease agreement, and then you decided you weren't going to rent anymore and informed the renter they weren't allowed to stay once their lease was up. But then they decided to stay anyways, refused to vacate, and used the electricity and water without paying the bills, and refused to pay rent...how is that any different than what Bundy (et al) did? The only difference is, the Bundy's owed tens of thousands of back pay for their illegal use of protected land, and they did it for decades.

      Not only did they shoot him they fired into the truck occupied by his family who had their child with them.Two rounds penetrated the roof of cab.The government lied and said Lavoy had a weapon.The cell phone video clearly shows he was unarmed and no threat upon exiting his vehicle.

    Off road vehicles do a lot of damage but aren't charged to use the land.

      Why should they? I mean the land is desolate and no one thinks it is worth anything. Off roaders do damage very little of it but once the roads are created, they stick to them. And besides it is their land as well.

    I like the way you research and explain during your videos! I remember the incident, but was not aware the Desert Tortoise was part of It. I was involved in a construction project and we had special inspectors for the Desert Tortoise and had to attend Tortoise Training in order to work on the construction site!

    I don't know the history of ranching fees but fees do get old. Land in my own back yard went from open to needing a free pass to now paying a fee to the forest service. State land is accessible if i am hunting with a valid state license, but if i am riding my dirt bike that requires another fifteen dollars to one agency and twenty five dollars per machine to another. Yes i have seen the negative impact on the land by all land users but the fees do nothing but generate revenue for a fat bloated do nothing government.

    Believe it or not, those cows actually eat cactus,as well as other vegetation. Gives me a while new respect for cows watching them munch down a mouthful of prickly pear.

    I would think that once the Bundy's started paying the BLM for the rights to graze, that was tantamount to recognizing the authority of the Federal Government to have jurisdiction over the land, but I'm not an attorney or anything

      Not really accurate. The BLM came in and offered to act as mediators for any of the ranchers land disputes AND to maintain the water supply system which the Bundy family had installed long before Nevada became a state. The BLM failed to do what it said, so the ranchers stopped paying. And rightly so. The BLM does not own the land, Nevada does.

      @@shereesheree7735 PRE-PLANNED murder. Proven in court. Also proven that the FBI ordered the Oregon State Police to keep ALL body cams off during the operation. The dead-mans road block is illegal in Oregon. Tree branches were trimmed the day before in order that the snipers would have clear shots at the stop. I could go on. It is far worse than what I have said so far.

    In the herpetology world, the tortoise is NOT considered "endangered".. There are major issues with how the population was surveyed, and it was not surveyed by herpetologists, it was surveyed by NGO wildlife organizations, whose starting assumption was that the tortoise was "endangered". No surprise, the conclusion was that they are "endangered." If you look at the very large solar farms that are being built in desert environments, the tortoise is definitely endangered in those areas. The same way that windmills are endangering bird populations.
    County sheriffs are held to be the chief law enforcement officer in every county, with authority that exceeds that of the feds...

    The history of grazing fees is interesting. Federal grazing fees used to be closer to public rates, but they have been reduced over the years so they are now far below private grazing prices. The fact that the Bundy family paid their grazing fees for generations suggests this is less about state's rights and more about Bundy not wanting to pay for grazing his cattle on public land. In my mind, this is the equivalent of someone drilling oil on public land without paying for the oil lease. The Supreme court has affirmed that the government can own land, which is core to the Bundy argument that he can graze cattle wherever he wants without paying.

    After living through the Spotted Owl debacle in the Pacific Northwest, I have decided that given two options, the federal government will invariably choose the worst one for the local people living in the area.
    Sadly, I know many of the federal government employees and they are decent neighbors and members of the community. The problems seem to escalate the further up the organization you go.
