We'll walk you through the process of analyzing your VA decision letter to identify the reason behind your denial, which could be one of three things:
    Insufficient evidence provided by the veteran (best resolved with a supplemental claim)
    Errors made by the compensation and pension examiner (also best addressed with a supplemental claim)
    Mistakes made by the VA rater (in this case, a higher level review is the optimal course of action)

    They recognized my service connection for back injury but denied benefits, also denied Timitus as " hearing loss" prior to service, I didn't develop ringing/ buzz in ears until almost 6 months after leaving flight line to ship Deck Dept

    Spot on as usual! I recently did an HLR informal conference because the examiner based their decision on the wrong evidence I brought forward for the claim. I spoke with a senior rater, and she agreed that they made a mistake. I got the favorable rating! This was due to a strong personal statement and an amazing Nexus provided on your website (which i revised)!

      I got the same thing happening... the HLR said there was an error that there was proof but they had to order another exam, that I'm scheduled for this week!

      Bro something is seriously wrong if you been waiting that long for one claim. You need to contact the VA.

      I've heard it takes two years for tinnitus, so I've always believed 2yrs was standard

      @@dlc85007 it only took 6 months for me. Everybody is different for sure but that long for one claims seems crazy.

      @@dlc85007 I got Tinnitus approved 2 months after submitting my claim and going to my C&P.

    4:35 - that is LITERALLY what happened! I could barely move in my lower back exam - waaay less than 20% forward motion - and my examiner wrote 50-60% on the C&P! :O

    What do you do if the VA rater goes against the C&P exam opinion that states “you have a diagnosis of the claimed condition & the nexus is established” then the rater still denies the claim!?! It’s like they totally ignored the rater’s opinion! Are there any regulations in 38CFR like under the “Duty to Assist” that covers BS like this?

    Since FOIA requests take 6-8 months and alot of these claims are getting banged out in 3-6, would you say that it may not be necessary to get CFILE since the raters feedback will probably tell us whether we need a supplemental for a new DBQ, or an HLR etc?

    Are these C&P examiners typically told to reject claims by their superiors? Like…to find any tiny reason to reject it and reject the claim? It seems the examiner is so vital and if they are biased toward denial…which could be the reason why so many vets get denied all the fringin time

    Greetings Legend here is some info about why third parties examiners can't release a copy of the c&p exam to the veteran - in the third party contracts it states that the C&P exam is not a medical exam it's a legal document therefore the veterans got to file a foyer request - The VA contract is violating the HIPPA law the law states 3 business days or 30 days at the most - Funny how the VA uses the 30 day for a VA employee c&p examiner also the VA health care system releases your doctor notes in 36 hours after being completed -

    Hey just got denial for lower back had plenty of inservice records but said i didnt see va enough for chronic and been out service 25 can you help with nexus letters also C&P said less likely

    How many claim's can a c&p examiner do in one visit. I had 8 in one visit and they never asked about my gout in my knees which I'm diagnosed with from the VA

    I went to VERA to ask for my ACE exam for a claim that’s on a HLR . He printed them out but said he couldn’t give them to me because the claim is in going . Is this true ?

    SSi diagnosed me in 2017 with Trauma and Stressor Disorder, Anxiety Disorder and I was awarded SSDI. A VA Psychologist in San Francisco during therapy diagnosed me in 2020 with C-PTSD and major depression and wrote me a Nexus letter stating my C-PTSD IS service connected from 1975. Filed an" Intent to File" in 2020 thru a VSO that screwed it up. Waited over two years for a C&P exam. I had a Video C&P exam with a Doctor here in the Philippines where I live on my $800 a month SSI in Dec. 2023. The Doctor here didn't go over my DBQ or DSM-5 (rated at 60) from my Psychologist in the US. His only interest was my childhood which I explained was a normal upbringing in a Military family. The Dr conclusion was "NO Medical Opinion". WTF does that mean? I thought the reason for a C&P exam was for A medical opinion.
    What can I expect now??

    Recently got denied for GERD from what the letter said there was no evidence while I was in to service connect it. Would text messages with dates on them be enough evidence to start an appeal process??

    I filed claims myself. Can a vso get c&p results, and if so faster then me?

      They can if they have access to some VA system . Not of them do

      Yes, they can with their access to VBMS. I got copies of my C&P exams from my VSO.

    How does Vet complain or can he about the doctor and the C&P exam he just went through. Dr did not ask any questions.

    VA denied my claims because not in my records,they cannot find my records. 7 years army and ng was not given exams at discharge in 1984 or after discharge 1986 they had them they lost them regional can't find them.

    I was LITERALLY just DENIED from the VA on April 9th, 2024 !
    FOR THE 3rd TIME ! 😡 I’m DONE !

      Dont quit. it took me 20 years to get 20% for my in-service injury on my back, as of last year...hit 80% last month cause I kept fighting and doing my homework.

      70% Sleep insomnia secondary to 10% tinnitus. 20% spine. 10%L and 10%R radiculopathy secondary to spine. Working on neck and upper radiculopathy secondary to spine now.
