    1:30 The Terrorism Act doesn't enable name and address to be asked for. Section 43 allows for searching, but doesn't specify that ID needs to be given unless actually arrested.

      @@lizgreen2936 I'm not a total fan of UK-MTT or of his style, but he occasionally gets some good content. He pushes the boundaries sometimes just a tad too far, but he is still within the law.
      There is no one correct way of conducting an audit, you can be polite and bow to the perceived authority and being able to get your footage published. Or you can let the other side go over the top and resort to the law and courts to back your case as when auditor get arrested, equipment seized and then sue for compensation.
      MTT is one end, AB is the other. With DJ/PJ and Kolee/AuditEd/PttP/etc being in the middle.

    The worst part of this is the fact it was clear the second officer was happy to stand by knowing that a member of the public was being treated like that. This is how the Wayne Couzens get away with it as the rest turn a blind eye. She should have spoken up and ended this.

    Terrible behaviour from that cop. Looks like an unlawful stop and you don’t need to give your details under section 43. He appeared to know neither the section or that he’d no right for your details. Seemed to me he realised he messed up and hopefully you’ll pursue a civil claim.

    And this video in a nutshell neatly sums up why the general public have totally lost confidence in policing in the UK. Detaining someone without sufficient grounds (any) and then not even knowing the actual name of the legislation (what exactly is the 'Counter Terrorism' Law!!?) he was using to detain the person. Dreadful, DREADFUL policing - it's frankly embarrassing if this is the standard at GMP.

      NOT just GMP, exactly the same throughout the approx 40 other police forces in Britain. The police are intellectually and educationally 'remedial' quality, in other words, the average police/man/woman/those who haven't decided terminally thick as the proverbially and this incontrovertible fact is confirmed on a daily basis by the numerous posts of various auditors.

    Photography is not a crime and he knows that. You don’t need to do anything but keep quite. You don’t need to give your name and address for section 43 it’s just a search nothing more unless they find something related to terrorism.
    So he’s detaining you but does not know the law. We are all citizen journalists anyone can be press. You don’t need to have ID for anything. You never needed to give your details, because it’s under section 43 that’s a search only. He’s really really messed up here,I think inside he knows it but his ego won’t let him go. What an idiot, she’s a fool as well.
    Up to no good but where is the crime. When he goes to court will he tell the judge you were up to no good. Suspicious activity is not a crime, you don’t get help from the police as they are the criminals just look at the misconduct hearing if you don’t believe me. Next time give them nothing and never take any ID out with you we don’t need to carry ID in the U.K. He said a private area, I saw plenty of people there. We are in a police state now.

      This is why I left the UK. I was harassed by an officer after I respectfully got off my electric scooter. The bad cops sense manners / weakness and go after it to feel important. To be fair though, they have been briefed to protect the stadium from stakeouts that might lead to bombing.

    You MUST pursue legal action against these two officers. Discusting abuse of powers. Every action was unlawful. You did not have to disclose any medical conditions to him but undoubtedly that's what made his pants go brown and for the interaction to change course so quickly. He needs striking off as clearly doesn't know even the basics of policing/ law.

      I'd have said he couldv'e been much more assertive and beat the cop down, as the cop had nothing, zero and zip diddly and was walking into a civil action against him. The copper even said about the owner, so there hadn't been any complaint, the copper was just making the whole thing up just to inconvenience the lad going about his daily business, nothing to do with the copper whatsoever

    The biggest problem I have with this type of incident is even if you follow through with a claim and win, absolutely nothing will happen to the officer. There will be no repercussions and he will do exactly the same the next time as he still believes he did nothing wrong.

    So the cops work for private companies now? That's what the copper said at 2:05 when he asked if Fritzmedia had permission from the football club to be where he was and then added, *"this is a football fixture and we're ... we're ... on behalf of the company"*

    Filming anything from a publicly accessible area is lawful unless,when on private property the cameraman is asked to stop filming and to leave the private property .. an example of this is some shopping malls. Fritzmedia was committing no offence at all and I'm surprised he didn't pick up on the point just mentioned. The words, almost stuck in the copper's throat when he realised what he was saying! Listen at 2 mins into the video! Unbelievable!

    Well handled mate, but refrain from using compliant or neutral phrases such as “that’s fine” or “no problem” during these encounters. In any complaint or civil claim police will use these to try to claim that you consented to providing your ID and participating in the stop and account process.
    I hope you file a civil claim and get your £500

    These two muppets are why GMP has such an appalling record. They didn't know the law and even when told the correct section(43) wrongly applied it. There is no obligation to give your details it allows them to search. No objects were stated for the search. He hadn't a clue what he was doing, just a stupid power abusing copper with no personal skills and a limited vocabulary. This is one of the reasons why the public have lost all respect and faith in our police. It is time for reform and put them on performance related pay, and every time they screw up like this they should be personally fined, that would ensure they learn the law.

      He didn't have to supply his details, but doing that when a (unlawful) demand was made by the Police supports any civil action that may be taken.

    I am sure you don't need to give your name and address on a terrorism stop? They can search you and ask questions which you don't have to answer. I am sure they would need to arrest you to get your details? Get the stop receipt as that is important for you if you wish to pursue this further.

    Asking for you to confirm any details on your civil contract with dvla whilst driving a vehicle is above and beyond his powers so you being on foot patrol is laudable .. and as for it being an offence to not update details on a driving licence... its got nothing to do with them ware you lay your head.. the only addresse they require is a contactable addresse which dosent have to be the place you live...

    Definite unlawful detainment. Walker vs Commissioner of Police of the Metropolis 2014. Constable may not forcibly detain a member of the public without arrest for the purposes of conducting further enquiries. He clearly said you were being detained, and after getting your details, changed it to stop and account.
    Being up to no good. There is no crime in that one. No charging code. Suspicious behaviour in and of itself is not a crime. Making up the law. She aided and abetted her colleague and this means she is guilty of the offence as well.
    Please do take them both to court. Civil claims against both, and the force.
    Ask for the body worn video as well.
    They will most likely settle out of court. However, he might just double down in which case wring it out of him and her.

    I think this part you might be looking for but as you can see, although it is contained in the terrorism act 2000, its quite some distance from 43.
    89Power to stop and question.
    (1)An officer may stop a person for so long as is necessary to question him to ascertain-
    (a)his identity and movements;
    (b)what he knows about a recent explosion or another recent incident endangering life;
    (c)what he knows about a person killed or injured in a recent explosion or incident.
    (2)A person commits an offence if he-
    (a)fails to stop when required to do so under this section,
    (b)refuses to answer a question addressed to him under this section, or
    (c)fails to answer to the best of his knowledge and ability a question addressed to him under this section.
    (3)A person guilty of an offence under this section shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale.
    (4)In this section “officer” means-
    (a)a member of Her Majesty’s forces on duty, or
    (b)a constable.
    Its hard (actually it isnt is it?) to see a police officer being so clueless about laws/acts that I'm sure, are taught to the police as part of their training or later training and are so EASILY found by doing a very simple search.
    Further to that, if this police officer is going to be using 43, then there is no need for anyone to provide personal details as very simply the right to demand is not there.
