    Yes, it is very important for this couple convicted for kidnapping and murdering a minor to procreate , i am sure they will make fine parents.
    Taxpayers are already paying for their food, security, medical, lodging etc. Taxpayers should also pay for their conjugal facilities and then their children born in prison.

    It is true that Art21 upholds the conjugal rights of two persons but how would the law protect the interests of the child born out of the marital tie? Since that child didn't commit any offence, law has no authority to punish him/her.
    Another point is that if right to marry is being conferred does that prevent the couples from procreating?
    Furthermore, on the one hand,law has no authority to confine the infant, on the other, mother has the right to demand custody of the child at least till 5yrs of age. Another conflicting situation arises whereby Law fails. We must rethink the 2014 judgement.
    In respect of recent petition, parole can be an option.

      you have to define what incarceration is first and what it's purpose is. most countries including India follow rehabilitation model

    One can also argue that while being incarcerated, expectations from rights accorded by Article 21 may be diminished. In short, don't do the crime if you can't do the time.

    No means no . Most indian are not okay with financing and upkeeping facilities for criminals to procreate. If such criminals wants such services then they have to shell the amount for security and infrastructure for this . Public money can be used for incarceration to protect society from such criminals . There rights they need to finance.
