The national guard in its default status in under control of the state governor where it can be called upon for an emergency but the president can also choose to call on the national guard so it serves both the federal and state governments depending on the scenario.

Damn right the State of Texas has the right to defend itself against the ongoing invasion. I lived in Yuma, Arizona a border town for over 10 years. I left a couple years ago and one of the reasons why is the thousands of illegals pouring into my town and making local residents miserable. People are afraid to go to the park!

The issue isn’t who has control of the border. The Federal government has control over border. The park is state property. The razor wire is far enough back from the bank of the river so that the illegal immigrants can enter the nation at a legal point of entry.

No, the Federal government does not have control over the border if they have failed to protect the States and have failed to live up to their duty and obligation, Article 4, Section 4 of the Constitution. and the States have the authority and the right of self-defense, Article 1, Section 10. The Constitution itself is the Supreme Law of the Land. No Federal Government, Federal Courts, are above the Constitution, the Supreme Law of the Land.
@@user-ob5nk3ss1p while we agree that the Biden administration has failed massively to perform their duties, the Federal Government still has the Constitutional obligation and authority over the border.
Article 4, Section 4 charges the federal government to defend the states against invasion. It makes no mention of the States. If we are ever going to get control of the federal government we must stop expanding the constitutional language.
Article 1, Section 10 makes the exception of keeping troops in the event of invasion. Reading from the authors writings in the Federalist Papers makes it clear that they never anticipated a mass migration, they were speaking specifically to military forces.
The Constitution itself places the sole authority to determine those cases where the states or federal government disagree on the interpretation of the Constitution. Effectively placing them over the document. You are grossly mistaken in your statement.
If we are going to argue the Constitutional issues than we must stick strictly to the facts.
Biden has failed to enforce the law. The 10th Amendment recognizes that any authority not specifically granted to the Federal Government is reserved for the states and the people. That makes the Abbott action legal and Constitutional, provided they leave a buffer for DHS, ICE, and Border Patrol to work.
SCOTUS ruled that Border Patrol could cut the wire in order to work and to perform rescues. It did not cede the park to the Federal Government. The Biden Administration has extended the ruling beyond the intent. Which makes the Abbott refusal to the Biden cease and desist letter the correct action.
Next step is murky. Abbott can start arresting DHS, ICE, and Border Patrol for trespass on state property (the park). The State can also start arresting and removing illegal immigrants to a holding facility directly on the border and informing these criminals that they can self deport and not face criminal prosecution. Completely legal.
My personal favorite put them on buses and drive them to open and uncontrolled spaces between Canadian ports of entry.
