Amber Heard Sets Her 16-Point Grounds for Appeal
The actor, who was recently spotted in Spain, retained David L. Axelrod and Jay Ward Brown of Ballard Spahr for the appeal.
On Tuesday, Amber Heard filed an appellate brief, listing 16 grounds for appeal, four months after a jury awarded her ex-husband, Johnny Depp, $10.3 million in damages.
During the trial, which ended in June, Depp claimed he had been defamed by a 2018 op-ed Heard wrote at the behest of the ACLU. The opinion piece did not refer to Depp by name, but he successfully argued that readers could infer she was talking about him in two of its sentences, and in its headline.” The jury also awarded Heard $2 million in damages for her countersuit over a statement that Depp’s lawyer, Adam Waldman, made, in which he called her claims of abuse a “hoax.” From the end of the case, it was expected that Heard would appeal.

@@zacharyjochumsen9677 It's a defamation case started by JD, he proved she maliciously defamed him but the court also tried to make it seem like JD's Ex Lawyer Adam Waldman defamed Amber, which he didn't, but the Jury ordered JD to pay for Adam defaming Amber despite Adam not working for JD anymore when he made his statements.
EDIT: Ambers appeal is because she's a narcissistic sore loser who can't take responsibility for her actions.
JD's appeal is to get that jury ruled payment to Amber overturned.

She said Johnny wouldn’t have appealed if she had just moved on but since she did the only way for the appellate court to see ALL the records was for him to also appeal. They didn’t believe Amber’s team would have included everything. I agree. Wish someone would explain how Amber got out of turning over her phone and iPads to Johnny’s team. He turned all his over. Never understood why the jury wasn’t told. She didn’t want her texts known. I understand why she didn’t just not why the jury wasn’t told.

She has no evidence! Not one valid doctors report of injuries. If any of her claims of injury were true she would have seen some doctor at the time. Think about worry for damage to her beauty that might damage her career? Never seeked a doctor. If she was damaged (as she claimed) in Australia. Johnny's doctor and a nurse were there. They would have treated her because of hipocratic oath. They only wanted to have her take meds to calm her down.
As a female DV survivor, I am so completely disgusted with her lies!! She has become the biggest enemy to DV victims being able to voice and plead their cases. She needs to be stopped.

It's astonishing to me that every discussion of this neglects the context of the outrageous and greedy blackmail/extortion letter that Heard sent to JD just before she launched her TRO hoax. Everything else followed that, and that letter makes her intentions abundantly clear: her plan was to take EVERYTHING from Johnny and live in the lap of luxury that he had worked for his entire life. Her actions pertaining to smuggling dogs into Australia demonstrate her lack of moral grounding, her willingness to manipulate others and her lack of respect for law.
It’s all over social media, it’s all out. She doesn’t have a prayer.
And that’s all she’s still fighting for. To take it all she’s so greedy and disgusting.
The divorce was not part of the Virginia trial and therefore not relevant. But, the statement made by Adam Waldman about blackmail which JD got dinged for is in the appeal. The statement was heavily redacted which gave it no context and thus the jury had to award damages to AH. But I agree it's what kicked off this whole debaucle. JD warned her and was even still willing to work with her. I'm astounded at the level of pure greed.
There was messages back and forth where Amber wanted to say Depp and lawyers kept telling her she couldn't. That was made public because they cc others making it not privileged.

What I can’t understand in the verdict against JD is, that calling AH allegations a hoax is defamation, while it’s proven that she was indeed lying with malice, so it was a hoax

They didn't believe JD/Waldman defamed AH 1st and 3rd count, giving Johnny the win on those counts; did believe there was a hoax perpetrated by AH. She won on the 2nd count wherein Waldman described in much detail the hoax, jury not convinced enough evidence provided to support the details of the hoax.🙃
Read the verdict you will understand. The first one and three specifically addressing her abuse claims as a hoax and she lost them. What she won was Waldman specifically describing that she spilled wine and roughed the place with her friends before placing second call to 911. So it is not that hard

Even a speculation how they did it doesn’t change the fact that it was a hoax

What’s interesting is that Amber hired these high profile new appeal lawyers but these arguments look like they’ve been written by Elaine. All the same arguments that were shot down repeatedly before and during the trial. “The definition of insanity is doing the same thing over and over but expecting a different result,” A. Einstein.
They must've mocked Elaine's arguments thinking they could do something better and different🤡. It must be difficult trying to win the case while AH keep digging the hole deeper with her lies,and their team can't control and stop her for doing so.
JD's team must have some lies too but patience and a little bit of silence and less drama wins him the favor.
I love how all her arguments are either blaming the jury , the judge , or calling them both stupid. Nothing with actual facts.
If by some miracle, the appeal wins. It doesn't really change anything, the world knows what a horrible person Amber is. I am pretty sure most of us were aware to a point on liquor and drug use, no surprise there. Surprisingly Amber was the one drinking all the wine. Imagine you would rather be high than enjoy your life, reason your wife is abusing you and you love her dearly but she will never change. I am so happy for Johnny that he told her dirty secret and all the fear he had about what others would think was unfounded because most of us, grew up with John and never suspected any abuse by him toward anyone and we care for him even more. Amber short of a sincere apology, very little will change in a positive manner for you. John loved you but you couldn't hang just wanted his money. Shame

If she wins jd will have to pay all the legal fees. So Johnny will be paying around 10 to 20 million at this point

The outcome of the trial was the right one, the jury were completely fair and just and they came to the right decision. She was guilty, she was the abuser.

Amber’s team called Adam and they kept the objections so it wouldn’t look like Adam was avoiding answering questions and Elaine knew Adam couldn’t answer those questions but she asked them anyway. She is a terrible lawyer

to be fair, as far as I can recall, Amber did not provide any evidence regarding agency with Adam Waldman. He invoked attorney client privilege every time he was asked about it, and there was no other evidence? SHE had the burden to prove it, and in my opinion, she presented no proof at all and there was no proper way the jury could've come to that conclusion based on the facts presented.

What I love about that case, even though I wish JD didn’t have to go through it all is that may it become a great lesson for anyone who is thinking of lying about being abused and making false accusations, so that only, and only real victims of abuse will be heard. So many people have been victims and their lives destroyed because of liars like AH, making real victims of abuse questioned and too often silenced.

During the trial Rottenborn INFERRED in his questions that Waldman was his agent and continued to do so in front of the jury. Is that not drawing a legal conclusion?

I have serious doubts that AH's list of errors was actually written by her new attorneys. They lack verbiage, organization, and specification of details that should be part of any legal filing. AH's docs sound as if they were written by another party, such as Eve B.

@@jackwhitbread4583 I thought the posting to appeal was so if she loses the money goes to Johnny (same amount) if she wins they give it back minus court fees. So she can’t drag out not paying him and tie it up in court for years.

Judge A was spot-on in upholding the decisions of the jury. She was an awesome judge and very wise so I don't see any reason why her judgement should be overturned.
From the point Judge A actually helped Amber over several times in the court to answer questions and so on, there was no way in heck she thought Amber had a hope in hell in winning the case after the first assist. From the 1st assist, I believe if Judge A was the sole person ruling the case, she would have ruled in Depp's favour. By how much though? Who knows but most likely would have been far less than what the Jury awarded Depp only because Judges are too insanely strict and often out of touch of everyday reality of normal folks due to being TOO into the Book of Law. Hope that makes sense.

I watched The case and I remember distinctly Amber heard saying she wants to be left alone and live her life. The same goes for Johnny Depp. During the trial she kept bringing in his children in which he wanted to protect along with Vanessa. This seems so bogus, and Johnny finally looks like Johnny again. He is leaving her alone there are no articles in which he involves her, and he’s living his best life right now. The people (jurors ect) And in this case Johnny finally got to tell the whole world his story. I walk in this morning reading all this BS about going back to court. Can’t she just go on with her life like he is doing with his life! This is ridiculous

Let alone crowds of people waiting for autographs. It is exhausting being on Tour let alone the trial. I hope he takes some time out away from the limelight and has time for himself . @@enya978 Just over the last few days there’s been so many news media articles regarding an appeal. Between what I just said as far as his schedule he has that loaded on his mind as well. I wish him peace, his family peace and we continue to recover from everything he’s been through. His story was told I often say that in my posts because my brothers story was never told and he had taken his life. I thought I was a big fan which I am but I learned a lot more about him during the trial. I understand what you’re saying thanks for sharing

Like Brown-Rudnick said, they really had no desire to appeal except that Heard's team DID so they are appealing just so the appellate judges get ALL the information.

Case was filed in Virginia because Washington Post published Op-Ed in Virginia & publishes in Virginia. Filing is legal. UK trial was a libel suit versus The Sun and it's owners, and legally is a separate lawsuit from defamation suit vs Heard. Heard claims she only stated her opinion in the Op-Ed, but Depp proved she not only is liar, but also got Heard to admit 2x that she wrote the Op-Ed with JD in mind & that she wrote it with malice intended. It's quite obvious she's using delaying tactics given the amount of legal fees and judgments that she's required to pay

I think both appeals failing is the best outcome. Amber obviously doesn't deserve to win on appeal and right now is the best time to finally put this case to rest. His voice was heard, he got the truth out and is living his life happily. Dragging it out for another few years only serves her, not him, at this point. Once the appeals are done, we can finally forget about her ever existing, which will be her biggest punishment.
Nah, JD deserves to have his appeal go through. He wasn't responsible for Adam Waldmans statements, he shouldn't have to pay.

may have decided to take the hit, if that's how it played out, rather than
blame Waldman , which he'd have to do in court to defend his position. Had he done
that AH could then sue Waldman for defamation. JD wouldn't put a good friend thru that and may have decided to take the hit if that's how it played out. It wouldn't surprise me at all considering JD's beautiful heart and incredible generosity. And for all we know,
Waldman is compensating him with legal services etc.
From what I understand, Johnny and Adam are friends, and knowing what we do about Johnny, he doesn't throw people under the bus, even AH got off lightly if you ask me, she had her own words reflected back at her for her to explain, but not her constant drug use and abuse, etc., she was left to shoot herself in the foot. Over three decades and he hasn't shown himself to act in malice, especially not to the man who fought for him, defended him, open investigations on his behalf, which as a lawyer I can't imagine he would do if he thought the evidence he had wasn't real.
I can't remember who's channel I saw this on (TUG, andys someone else? ) but apparently waldman had a statement from Josh drew saying exactly what waldman stated. That it was all a hoax etc. Supposedly waldman sent that information in an email to Johnny's lawyers, specifically Camille. I would think that if his team had a slam dunk statement like that they'd use it so idk...maybe that information/ email, etc was bull or maybe there's a reason they decided not to use it 🤔 🤷♀️

I think the redaction thing is very relevant, because it redacted the fact that Ambers Lawyers also commented in the same article, it added context to what Adam Waldman said, and how he was reacting to what her lawyers said first. Might have opened things up to allow JD to put AH's lawyers on the stand too. Of course they would claim client attorney confidentiality, but it would have neutralised the fact that Adam used it when questioned. I think the Jury would have thrown her counterclaim out had they had all the facts.

*Let me breakdown the bakery and cake situation,* because I very much followed the case..the bakery won through the Supreme Court..the owner was a Christian that didn't do gay wedding cakes, anything with Halloween, hateful messages referencing the WW2 "guy", and a few other reasons tied to his belief system..he NEVER said he wouldn't serve anyone in the LGBTQ community..he has no problem with bday cakes or anything else, tied to that specific community..even people that protested outside his business he brought out fresh cookies to give them..he's a very sweet, elderly gentleman that has a right to his faith..would it be okay to make a Jewish bakery put anything praising the WW2 "guy"? Would it be okay to force a gay bakery to put a hateful message about the LGBTQ on a cake? In fact there are recordings on social media of people calling gay owned bakeries to do that..and every time those bakeries cursed at the caller or flat out refused, then hung up..no one pressed charges against those bakeries, it was done to make a point..some people are being given preferential treatment, while not held to the same standard they demand..a Christian owned bakery, a Jewish owned bakery and an LGBTQ owned bakery should have the right to say no when it comes to their beliefs..and I don't like what Kanye has said or been doing, but as Steph said, it's a slippery slope..when you're a government backed entity that wants to play "the moral police", then it stands to reason how they must scrutinize EVERY SINGLE customer..when you are a part of a government entity, that does open the door of discrimination when it's only concerning freedom of speech..the government doesn't have a right to refuse service BECAUSE of not supporting someone's freedom of speech..again, I do NOT condone Kanye's words..he was flat out wrong..but for a bank to proclaim the moral high ground, then that starts the domino effect of complete overreach..I honestly think the bank did it for political and social brownie points..banks are different than regular businesses..the Federal Deposit Insurance Corporation (FDIC) is an independent government agency in charge of banking..this is not the case with regular businesses 😕

So excellent show. I’ve watched a few LawTubers regarding the appeal. This was the first that I actually understand what each item is, means, and merits. I agree with Christopher that JD’s team file filed appeal to protect the process. I believe even if JD might not have said quotes to Waldman under attorney-client privledge, he wouldn’t throw Waldman under the bus to deny. I also think that the statement that friends helped AH stage the scene for police might not have sufficiently proven that the friends helped, not that it wasn’t staged. I’m sure if courts had been able to get AH legitimate phone & computer history, there would have shit-ton of evidence to prove friends were totally involved.

Christopher Melchin I cannot thank you for all the time you spent explaining to us so simply each point. AH is such a fool and he just cannot move forward in his life. 8 years since the divorce! I watched that trial and not once did I believe her lies. I don't think any appellate court will side with her. No one deserves ruination than she. Judge Penny made certain that she would never get an appeal. She was awesome.
It sounded to me from Kate James that AH got in her face so that spit got on her face, not that she spit on her.
Johnny is making films and concerts while she is holding a baby "on her own terms" in Spain... Appeals seem more than ever a waste of time for everyone.

I wish it were more clearly stated that Waldman made those statements WITHOUT MALICE because he had a whole ass BINDER of evidence against Amber proving it was a hoax. He had valid reasons to believe she was lying and it WAS a hoax. Therefore it was NOT made with malice and he had every right to say what he said. I said what I said! lol I know the appeal won't be granted but dang it would be amazing if he won and didn't have to pay her a dime. She did this to herself. That's why I don't feel bad for her in the slightest. She tried to ruin an innocent man and take his hard earned money. She really thought she would get away with it. It's infuriating!!

People really need to understand the nature of women with borderline personality disorder. These individuals are a blend of narcissists and psycho/sociopaths. What they express and tell you, makes them appear to be morally grounded, honest people just trying to move on, but rest assured their actions never come close to matching. They sadistically extract pleasure from dragging and slandering the name of their partners. The higher people think of their partners (brad and Johnny) the better their mental victory is by being able to trouble and ruin their lives. These people will stop at absolutely nothing. No amount of contracts or “speaking clearly” works with these types. People are just playing into their game and yet the public thinks they are handling it correctly.

BPD isn't the cause of someone being a shitty person. I must say your comment felt a bit hurtful. Though I know who I am and how I function and though I am aware living with people who have bpd can be rather difficult . These type of stereotypes sobly add to the stigma. I have bpd. But I am none of those things. And I know people with bpd and they are none of those things. If anything I project all the abuse onto myself and its an ongoing battle . So please make sure not to ge generalize . We are not all violent and out for vengeance and viscious and self serving and manipulators. Some of us just try to take it one day at a time and it is extremely draining , sure I have had my moments with the fear of abondement and the harsh reactions but I try to be mindful and always double check my reactions if they are valid and always always apologize if I am out of line . I try to revise my actions every moment of every day as to not hurt my loved ones I try to communicate and be honest and forward while keeping in mind not everything I'm feeling is real and true . Sometimes it can be wrong and just my mind playing tricks on me and that the reality is another thing . There's a lot of self work and reflection and tiptoing around the illness always in fear of hurting others and or yourself. So please be mindful of how you spread information. You have no idea how difficult it is to live with illness and people like amber heard and criminals plus the media only adds to people's fear of seeing us as decent people . Some of us are decent people we're not all amber heards and American psychos . 🤍🤍🤍🤍✌✌✌
I agree with most of what you say, but it's a bit more simple. As a midrange narcissist everything is done below the level of consciousness in the here and now. They think they can control even the law if it provides them with the aims to apease their narcissism. It is all about control. There could possibly be sociopathetic tendencies here, but it's difficult to determine and requires evidence. Narcissists see the world differently and as far as they are concerned should have won the case and have done nothing wrong.

Well filing for appeal is a normal step in the American justice system, and he did get a 2 million dollar charge against him. So I don't blame him for trying to get that thrown out.
