In his vlog, he cautions you not to take on home invaders but to defend yourself if necessary to protect you or other home occupants. Law needs to be changed immediately and it should state, that any person unlawfully invading your home or property, no longer has any rights upon entering.
And the occupants of the property shall not face any criminal proceedings if any harm comes to an offender while defending a person or property.

The vagaries of the law regarding home invasion are ridiculous. If a person or persons invade an individuals home, particularly if they are armed IN ANY WAY, then the law should NEVER be used against the individual protecting his home and person, to remove any doubt to the rights of the "homeowner" or legal tenant. To do otherwise is to give full license to the thieves and criminals who always seem to know THEIR RIGHTS as they ignore their VICTIMS RIGHTS. To expect legal analysis as to what action is permitted as one or more home invaders attack, is patently idiotic.
The law's whole purpose is to arrogate all power into the hands of the police who can then control all members of society whether law breakers or victims of crime with their selective use of their power.

I was king hit, with 20 welts from repeated head punches, and my wife got a broken nose, from a 17 year old with a chip on their shoulder. Police simply argued he came from a good home and lost the case file, denied cameras etc. No follow up victim impact statement etc. Next time, I will not give the police the opportunity to make that judgement.

Why are there laws protecting people who break into our house? why? If you break into some one's house your rights should be left outside! We had a Teenager kick our front door in on a Sunday morning, My Elderly parents and wife and I were all upstairs I was in the shower when my wife yelled for me to help. I got dressed really quick and started yelling at him from upstairs, He was trying to steal things from the internal garage. He ran out and jumped on a stolen motorbike and gave me the finger as He rode away. The police said if He got caught because He is under, I think 18? He would get 2 weeks in a juvenile detention and set free and when they turn 18, they have no record because all their crimes were as a juvenile! So, gangs often get young kids to do the crimes because their slate will be clean when they turn 18? Are our Qld laws ridiculous? And I guess if I belted Him with A baseball bat trying to protect my family I would be in jail the same day!

Total bullshit. The peaceful citizen’s fate is in the hands of the criminal with the force of the law protecting the criminal - in fact incentivising the criminal. There should be no restrictions on the homeowner/resident in defending the sanctity of their sanctuary, and no protections for the criminal who invades a home. The law is an ass on this matter.

That poor grandmother, murdered by a 16-year-old youth who towered over the police, was a chilling indictment of the law's failure to protect the elderly and frail. That young person was already on bail for major crimes. When a society fails to defend its most vulnerable. That society is clearly on the verge of collapse, as history has repeatedly demonstrated. The government creates the law, the judiciary enforces it, and lawyers interpret it for personal and financial gain. The Labor government is clearly to blame for this grandmother's death. The police should bear no responsibility for the incident.

Exactly, it’s 2am and you and the family are asleep, it’s pitch black and you are awoken to an invader standing by your bed, how do you know how big he is or if he’s armed? you’re half asleep and it’s dark, by the time you’ve woken up enough to determine any of this it’s too late, you’re stabbed or shot or beheaded with an axe or machete and your daughter is being raped!.
It’s all very easy to analyse this type of situation in the comfort of a law court and apply these garbage laws but in the real world it’s kill or be killed and anyone forced into this situation would act to defend themselves and their family first and foremost……there’s no chance of rationalising your actions when you’re dead.
Anybody violating your right to be safe in your own home should be subject to the maximum force you can muster to protect yourself and your family first and foremost no question and the law should support you otherwise we don’t have a civilised society.

Blame the law mate. The law is much more vague than you'd ever realise on a whole bunch of things, even though it's supposed to be clear and transparent (the rule of law). I only discovered this after starting law school and then understanding why we need so many lawyers. If you think that someone is going to harm your family, and have a good reason to believe that, you can give them a touch up. But don't shoot someone holding a cricket bat in your driveway... that's not going to be good for you.

The way I look at it is like this, if someone comes in to rob or hurt me in my own home, I will do what ever I have to do and worry about the law later. If you come onto someones property with intent to steal or do harm as far as im concerned you have lost all rights. Not everyone is a lawyer and the rules are so many it has to come down to common sense in emergency situation. just my five cents.
What are the rules on trespass. Does putting a sign saying private road no trespass mean anything these days ?
Hypothetical situation: your home gets invaded. An intruder has gained unauthorised entry. You are physically attacked and forced to defend yourself and overpower the intruder who is now unconscious. You call the Police who arrive to find the intruder lying on the kitchen floor with a large kitchen knife close by on the floor. You have a few cuts on the hand and arm, the intruder is lifeless from a lethal stab wound. The kitchen knife is taken into evidence. You provide a statement about the intruder attacking you with the knife and turning it back on him in the scuffle. Forensics later confirm two sets of prints on the knife - his with yours on top. You have no security camera's. The prosecution surmise that in fact the intruder was unarmed, you cut yourself to make out you were injured, stabbed him fatally with the knife while he was unconscious, placed it in his hand after the fact then you overlayed your prints on the knife. I say prove it.
Don't do this, if this scenario ever happened these words will be used to convict you, premeditated they will say no matter the time frame in posting this to the actual event, if unfortunately it ever occurred.
Well i know this. You are going to jail unless you can prove you were cornered and the intruder had a weapon. Your life had to be in danger, which is often too late.
One mistake, get rid of the evidence - leave the police out of it.

"Property can be replaced"?? What about war medals or jewellery inherited? Or things of sentimental value?
Why should one have to replace it anyhow. That is just saying theft is okay. If that is the case, why do we even bother with a police force and a legal system. Especially, when it bites those it should protect and rewards those it should punish.
I believe the only time it should be against the law to use deadly force to stop a trespass on your property is if there is an insignificant chance the trespasser could cause harm to people or property (including stealing the property). So if there is any significant chance at all (from the perspective of the defender, so long as that belief was reasonable) that the invader could harm a person or property, the home owner should be able to use force up to and including lethal force to stop that threat.
Exactly in other words unless they have no arms or legs they’re fair game!
My brother is in jail for 21yrs. in South Australia, because he defended himself whilst two intruders entered his home, one of the intruders died. There is no such thing as home invasion there, so my brother was convicted of murder, mandatory 21yrs. even though he was being physically attacked inside his own home by two thugs! Disgraceful, why is the victim penalised? Why are there different laws in each state?

You enter my home and you will be a permanent resident. Under my new patio.
Someone breaks into my home and is armed I will be placed in fear for my life, I would believe that someone armed with a machete or other weapon was going to do me and mine harm, or even kill us; to protect my family and my own life I would do whatever was necessary to stop someone killing us. Simple!
This is all we need, a gently speaking lawyer telling us that the law is protecting the invader. In the middle of the night, in darkness, some person breaks into your house and you brain them with a golf club as a defence. If you have a wife and a couple of small children in the house with you, how can you ring the police and then quietly slip the entire family out of harm’s way.? Sadly, you are the one who will feel the wrath of the law as the intruder had a rough upbringing and only had handkerchief as a weapon.

What is required is that the defendant genuinely believed that the victim was committing or had just committed a home invasion [s 15C(2)(a)].

I agree the 50 metre rule is good advice but all bedrooms are upstairs in my place on the side of a hill. I shouldn’t have to have this as a primary concern in MY house. It’s not my rights if someone else is in my home at 3am that I am concerned about. My child and wife are first, then all hell breaks loose. Better to be tried by 12 than carried by 6. Law Societies can do more to protect people in their homes than caring for the rights of children who face no sanction in the waste of time childrens court jurisdictions of this country. It does not worry itself about your family or mine. The DFFH are staffed by young people who are over worked in the care houses and the young people in those “care houses” come and go or do as they please on occasions. The only people who believe that they are achieving something in this world are the lawyers who specialise in the defence of these children. They bang on about police heavy handedness, MH, dysfunctional families but want to keep the kid with that family, Kooriness, doli, difficulty with schooling despite never going and maturity. Go and sit in a court as an observer around 10 am and watch the circus. Just don’t leave your wallet or phone in your back pocket and don’t drive your car. While I accept the principle of using no more than "reasonable" force, what I find troubling is the message to the criminals that if you do break in, the residents should let you continue in the hope that the police will get there in time or catch them afterward. That is not a sufficient deterrent. I understand the risk of taking them on, but the risks of _not_ taking them on, i.e. letting them get away with it and sending the message that people should not fight back against them, needs to be taken into consideration also.
Here in the great state of Texas, we are under no obligation to retreat. I am a gimpy old man that can't scrap like I used to and am unable to retreat. Consequently, I have layered security which makes it much more difficult to get in and damn near impossible to get out other than feet first. I stay within arms length of my final deterrent. Like you said, "Things can be replaced, people cannot." I plan on protecting that which cannot be replaced. I cannot run, but I can shoot quite well. Semper Fi!!

Home invaders don't usually tell anyone where they're going or what they're doing so chances are no-one would know where to look if they went missing.
What about establishing a norm where the risk far outweighs the reward? THAT is something that would effectively and meaningfully keep people safe where they have the utmost right to be so. And feel so.
Isn't the denial of such rights one has to exercise powers in/on one's own property, and the resulting absence of capacity that is transfered and vested exclusively with law enforcement officers, who then prove absolutely and irrefutably that they are incapable of exercising that power and capacity on our behalf, a miscarriage of natural justice/positive law of some sort?
We the people are subject to a loss of capacity, without adequate compensation that as a result, occurs injury and loss and yet there is absolutely no challenge to the legislation/laws/acts to prove that the ongoing and increasing engagement of human rights and civil liberties is valid/reasonable/just/fair/lawful/moral/ethical/constructive/productive/constitutional/in violation of treaty/and so on and so on....
How much worse could a solution make a problem before there is some intrinsic form of mandated, authentic accountability determination process is initiated.
Besides the banking 'system' nothing comes close to how far from an authentic 'body' the legal system has become. And no one questions it or even seems to know what, if anything, the people can do about it to take back thier lives form the strangling grip of the established order.
NB: sadly, society has been lead into such levels of degradation that much of it no longer qualifies for such gifts and honours to be bestowed upon them as they would simply use the position to wrongly benefit from other, more morally and principly bound people. So I guess we as a people have accepted what we deserve in some sense, but it's dishonourable to tie this portion of civil society to the fate of honourable and respectable members of the community and damn them all to suffer the same fate with every attempt made to capture as much of the lesser classes into one communal class as is possible....

Thank you Bill Potts for explaining, however I know that you know that this law is simply not here to protect the taxpayers and it feels very fishy that something is not right to me and for a lot of other Residents.
If someone has broken into your home he has further intentions to do mischief - he is not a curious tourist. The home invasions that stick in my mind are those where the invader is not interested in the "home" so much as terrorising the elderly residents by violence. There have been cases in which one of an elderly couple is killed and the other has their face disfigured by hammer blows. Certain gangs require these violent invasions as part of their initiation rituals for promotions within their ranks.
The 2002 Queensland Home Protection Order is very good reading.
Sadly it was open enough that it allows for virtually ANY level of force to be used even before anyone has broken in. I am personally all for it. But there is no way on earth that bill was going anywhere. We need to find some middle ground for any positive changes to be put into law.

The Criminals are very aware of this Law, hence so many home invasions.in QLD by children, Police told me after our QLD home invasion "what do you want us to do about it" I just shut the door and gave up, nothing happened, and they broke into the next home the night after and the next one after that.
Yep I agree with the 12/6 rule. No one should be coming uninvited into your residence especially at night. Good guys don't go around breaking into bad guys places. You/we should be able to use whatever force at our disposal since the bad guys shouldn't be there in the first place. That should be the chance the bad guys take.

What was utterly stupid was South Australian police, about twenty or thirty years ago , made a woman show cause why she had a broom in her hands, at two am in the morning in her own home, and thumped a burglar. I remember that because of a small article in the local paper, and it was so stupid, how can you forget? I am generally very pro police.
This just make me angry. The notion that police will turn up at all is a joke.
As far as I am concerned there is a lock on my front gate. Once you pass the gate you are a threat to me or my possessions. I will not be a victim.
It is exactly this enabling mindset together with a woke justice system that is making the rapidly increasing crime possible.
Criminal lawyers like this... and judges... are the reason these criminals rarely if ever face any real consequences. And these judges and lawyers never face any consequences for the actions of the people they are responsible for being given countless second chances.
You can use force if you fear for your life, and that of the kids/spouse in the house. Just don't go chasing them down a road. Also never give a statement to the cops right after what happened, it's better to wait to have a lawyer present.
I really couldn't say what I'd do in this situation simply because there are too many variables. I do know that I would spend my life in prison for protecting my wife and children rather than spend a day of it having failed.
One has to be mindful that in regard to someone attacking you that the law as practised cannot Not come first in life.
The law is not itself justice and personal justice is any human's right to defend themself. Your own personal protection and that of your family must always come first before the law (i.e. others) which then after the fact judges what happened in your actions and either gets it right or wrong.

Consideration of home invasions should start with the rule that we cannot have guns for personal protection. So invaders know this which robs us of a potential deterrent in the mind of any invader, advantage one to the invader. Then we have the impractical concept of being limited to using reasonable force in defence, advantage two to the invader because whatever is to hand for defence in a emergency situation may be considered unreasonable. So what do we do then? Advantage three to the invader, hesitation likely leads to losing any imitative we may had had.
It's therefore obvious that the law breaker is favoured by the law. Why is this so? Maybe because the State doesn't want you involved in 'police matters', maybe politicians are concerned that the actions of defenders will create adverse publicity for them, maybe if we were graciously allowed by the State to defend unconditionally pressure to allow suitable defence weapons would rise, maybe the State considers that home invasions are minor crimes that don't warrant any sort of active defence. What are the reasons Mr Potts?

Contrary to the title of the video, this doesn't explain what my rights are, Bill. You just go through various scenarios and recommendations on how to handle them. There's actually very little law / legal value information in this video.

The tragedy is that kids get in with knfes then by law you can use equal for you defence and chances are you may kill a kid which could be trauma for life.

Isn't it great that the lawers interpret this way when they can afford personal security while we the working class people are left to suffer the consequences of their wish for a 'peaceful society at all costs'.
I say it comes down to common sense, as it always has throughout human history, protect yourself and what is yours if you deem there is a threat, accept the consequences with your head held high.
What if we get attacked ???? and as an elder person by some miracle we do harm the criminal what then ?????

Clearly by the comments on this video and by my own feelings this law needs to be changed to protect innocent people from being prosecuted for protecting themselves, their families and property. The law needs to be for the innocent not the criminal.
