I think legally the most an employer can do is ask if the previous employer would recommend that employee, at which point the previous employer can only really say "yes" or "no". Anything beyond that is liable for lawsuit shenanigans IF it gets found out.
You're normally allowed to ask the guy to provide references, but you can't force them and they're allowed to pick who the people are. Honestly you'd have to be really stupid or totally lacking in self-awareness to end up with bad references.

Had something sort of like this happen. Graduated with a bachelor's in biology with a chemistry minor. Applied to 100 jobs and the only one I could get was selling popcorn at the movie theater. Old classmate came in and I instantly recognized her. And she happen to recognize me too. We weren't friends, just knew of each other. And I was making $7.25/hr. 😅
