  • The plaintiff says she bought a car from her niece on a payment plan, but when she had two payments left, her niece snapped and called the cops on her to say it was stolen. She’s suing for what she paid. The defendant says her aunt was always late with the payments and she needed that money to take care of her children.

    The plaintiff says she’ll never deal with family again when it comes to buying a car? Is it b/c no one else in the family would put up with that crap after this deal? The plaintiff was in the wrong.

    The aunt is SO shady dude. How could you do that to your own niece and then turn around and SUE her?

      Because the niece refused to register the car in her own name she was riding around and a car that was registered in her aunt's name if something happened they would be coming after the end and she was only paying for it here and there in pieces how can a niece do that to her own aunt her ass was in the car she needed the pay more than 1500 if you rent a car it would cost much more than $1,500 for 6 months

    $1500 was paid toward the 2K purchase price. $750 was ordered to be returned to the plaintiff, which splits the amount paid down the middle.
    I read some of the comments here and people seem to be confused.
    The plaintiff is an idiot. She got a 3K car for 2K, but blew it with disrespect and attitude, by trying to take advantage of her niece.
    So the plaintiff ended up paying $750 for the car for time used, because she clearly breached the sale contract.
    The defendant gets to keep $750.
    It was a fair judgement.

      The plaintiff should not have gotten anything back. If you are constantly late with paying your car note to a bank (which is a serious breach of the contract), and they repo the car, you will not get any of the amounts you paid back, no matter when they repo the car. Furthermore, if the bank sells the car for less than the amount owed, you will owe the bank more money. So, why should it be any different because a family member was the lienholder?

    Never do business with relatives because if all goes wrong it'll ruin the relationship maybe even for life. So it's never a good practice to do this.

    I never understand this type of case because if a dealership repo’s my car, I can’t sue for money back. Can someone help me understand?

      That was my thought process as well. I believe it's because the niece repossessed the vehicle before the 10th of January because all her previous payments were made monthly on the 10th prior to that. Still doesn't seem right. She drove the car that whole time!

      I think maybe it’s because they have it somewhere in the contract they sign at dealerships that state they forfeit all monies paid if they default or breach in the payments. I’m not sure though.

      The dealership keeps the car in their name or the bank until we fully pay it off... I don't see any difference here. Do you?

      That’s what banks do. You don’t get your tittle until you pay it off. Also, if she would have gotten the title the aunt probably would have stopped paying completely. She was already LATE EVERY month

    All I have to say is if you are an auntie or an uncle that has to buy a car from your niece for $1500 and make $200 payments per month, you have failed in life.

    I think she got her to pay it off, and she was always gonna take it back when it was zero. Cuz she couldn't pay it no job. And she still took payments late.

      No. The aunt was MONTHS behind on the agreed payment. Then hassled her EVERY time she asked for payment. The niece shouldn't even have to ask in the first place.

    Both were wrong here. She was generally paying around the 8th of the month. Why didn't the niece at least wait until then in January?. I don't know what suddenly triggered her to take it back on the 5th. That said she should not have been giving the niece the runaround on payments. I think it was right that the aunt received some money back as she was close to paying off the car. The aunt should have registered the car in her name and been proactive with the payments. The niece should not have had to chase her. Money and family don't mix. It was a shame that the plaintiff could not even be gracious in the exit interview and just blame the niece, not admitting any fault of her own.

    Question 🙋🏽‍♀️, let’s say you sue and you win right and the defendant doesn’t pay do you sue again or it’s tough luck ?

      This show pays for the judgement which is why people go on, guaranteed payment. But once you have a judgement if the person don’t pay you can garnish their wages or put it on their credit report.

      Yeah, a judgement has a set date attached. If you don't pay by that date, you get a lien on your credit. Those stay on for up to ten years unpaid THEN 15 years from when you do pay. And yes, they will garnish wages and if you get a tax refund they take all of that too. Basically, the government becomes your collection agency.

      The winning party can donate garnishments on wages, or from personal property. You can also hire a lawyer or collection agency to deal with them.

      We sued again when the defendant didn’t pay us for totaling our truck. The second judge warned the defendant that if she is one day late he would throw her in jail.

    I sold a car to a “friend” once. Got a down payment then I signed the title over. Big mistake. He didn’t pay me another dime. I had a signed payment agreement and coulda sued but I just didn’t care that much. I don’t give what I can’t afford to lose.
