    @Waseem Khan hi Khan thank you for you reply. Magistrate record 164 statement of compromise under oath and close 420 cheating case.
    Is it possible to close case 420 case by recording 164 statement from complainant and close the case by magistrate.

    Not first class it may be recorded by any JM or MM
    Read very 1st word of the section.

      Under section 164 only Magistrate is having power to record confession, confession to police officer is not admissible.

      @@WaseemKhanlaw सर, मान लीजिए मैंने कोई चोरी 1 January 2021 को की थी और उसी दिन मैंनें पुलिस के सामने जाकर ये जुर्म कुबूल कर लिया । मेरे खिलाफ FIR हुई , Chargesheet file हुई । केस का ट्रायल चला । Charge, Prosecution witness जैसी Stages पार करने के बाद लगभग डेढ साल बाद कोर्ट में मेरी Witness हुई और तब मैंनें दोबारा मजिस्ट्रेट के सामने अपना Confession किया । सवाल ये है कि मेरा जो डेढ़ साल कोर्ट की बकवास बाजी में बरबाद हुआ उसका क्या ? मैंने तो पहले दिन ही जुर्म कुबूल कर लिया था फिर मुझे उसी दिन ही सजा क्यों नहीं हुई ? मेरा डेढ़ साल तो Totally waste हो ही गया ना ? मुझे तो पहले दिन ही सजा चाहिए थी । (प्लीज़ सर, जवाब दीजिए ये एक Real case है और मुझे कोर्ट की बकवासबाजी (Prosecution Evidence) झेलते हुए डेढ़ नहीं बल्कि चार साल हो चुके हैं । मेरे जीवन के अनमोल चार वर्ष मिट्टी में मिल चुके हैं सजा तो अभी पूरी बाकी है ।

    If a major (18+ years) girl under 164 crpc states in front of the magistrate that she got married to a person according to her own wish. Is this a confession or a statement?

      This is mere statement, for confession acknowledgement of guilt must be there, it means only accused or the person who has committed any offence can make confession.

      @@WaseemKhanlaw Sir is not that she is accepting/confessing that she gets married,she herself accepting that she committed marriage likewise a person accepting that he/she has committed any crime.
      Can't it be a confession sir Or a statement only?

      It may be confession in general sense but under section 164 of CrPC only accused of an offence can make confession by accepting that he has committed crime.

      Sub section 5 speaks about non confessional statement, it may be recorded by the magistrate as other evidence and before recording such statement, magistrate will administer oath to the person whose statement is to be recorded.

    I think when in the opinion of magistrate the statement fited to circumstances of the case and magistrate shall have power to administer the oath
